1. The Plaintiff I LOWer Allen 'l'ownahip, is a first-olass
township organized and existing under the laws of the commonwealth
of Pennsylvania, with its principal office at Township Municipal
Building, 1993 Hummel Avenue, camp Hill, PA 17011.
2. The Defendant, Gerald L. Gilbert, is an adult individual
residing at 50 Palmer Ddve, Camp Hill (LOWer Allen TOWllShip),
Cumberland county, Pennsylvania 17011.
3. The Defendant, Gerald [" Gilbert, is the owner of the
property and dwelling unit at 50 Palmer Drive, Lower Allen
Township, cumberland county, Pennsylvania.
4. At all times relevant hereto, garbage, ashes, and refuse
were collected from 50 Palmer Drive, Lower Allen Township,
cumberland county, Pennsylvania, and disposed of under the terms
and provisions of Agreements between Waste Management of Central
Pennsylvania, a division of Waste Management of Pennsylvania, Inc.,
as >>Contractor>> and Plaintiff, Lower Allen Township setting forth,
in.t..lu: lill, charges to the Plaintiff, Lower Allen Township, for
such services.
Plaintiff, Lower Allen Township, then paid the
Contractor for such services.
15. Under Seotion 95!1.015(8) of ordinances 90-7, enacted I\pril
2, 1990, effeotive April 1, 1990, copy of which is marked Exhibit
"1\", hereto attached and made part hereof, the Defendant, Gerald L.
Gilbert, the owner of the dwelling unit at 50 Palmer Drive, was
required to pay for oollection and disposal of garbage, ashes, and
refuse $47.05 per quarter in advance within thirty (30) days after
the first day of the first month of each calendar quarter and, in
addition thereto, a penalty of ten (10\) percent if not so paid.
For collection and di~posal of garbage, ashes, and refuse by the
Contractor from said dwelling unit, Defendant, Gerald L. Gilbert,
was charged by the Plaintiff, Lower Allen Township, as follows,
which charges have not been paid.

6. Under Section 955.05(a) of Ordinance No. 92-5, enacted
Deoember 14, 1992, effective January 1, 1993, copy of which is
marked Exhibit "B", hereto attached anr,l made part hereof, the
Defendant, Gerald L. Gilbert, the owner of the dwelling unit at 50
Palmer Drive, was required to pay for collection and disposal of
garbage, ashes, and refuse $43.50 per quarter in advance within
thirty (30) days after the first day of the first month of each

oalendar quarter and, in addition thereto, a penalty of ten (10\)
peroent if not so paid. For oolleotion and disposal of garbage,
ashes, and refuse by the contractor from I!aid dwelling unit,

7. Plaintiff has demanded from Defendant the amount due, to
wit $494.14, bllt Defendant has refused and still refuses to pay the
same or any part thereof, which amount is within the limits of
oompulsory arbitration of cumberland County.
WHEREFORE, Plaintiff, Lower Allen Township, demands judgment
against Defendant, Gerald L. Gilbert, in the amount of $494.14,
together with interest and cOl!ts of suit.

AN ORDINANCE OF THE BOARD OF COMMISSIONERS
OF LOWER ALLEN TOWNSHIP, CUMBERLAND COUNTV,
PENNSVLVANIA, AMENDING, CHANGING, AND
KODIFVING THE CODIFIED ORDINANCES OF LOWER
ALLEN TOWNSHIP, 1985, SECTION 955.02(b)
ESTABLISHING ANNUAL CHARGE OR FEE FOR A
LICENSE AND 955.05 ESTABLISHING FEES FOR
COLLEC'rION AND DISPOSAL OF REFUSE FROM
DWELLINGS OR DWELLING UNITS.
BE IT ENACTED AND ORDAINED by the Board of commimsioners of
Lower Allen Township, Cumberland county, Pennsylvania, and it is
hereby enacted and ordained by the samel
sacHon I.
Article 955, Section 955.02(b) of the codified ordinances of
Lower Allen Township, 1985, shall be amended to change the first
sentence to provide that there shall be an annual charge or fee in
the amount of Ona Hundred ($100.00) Dollars for issuance of such
license.
Section II,
Article 955, Section 955.05, of the Codified ordinances of
Lower Allen Township, 1985, shall be amended to read as followSl
955.05
FEES.
(a) Dwellinqs and Dwellina Units. The fees for collection
and disposal of refuse under Article 955 and recyclable materials
under Article 956 from Dwellings or dwelling units shall be at the
~ate of Forty-Three and 50/100 ($43.50) Dollars per dwelling unit
per quarter. The fees provided herein shall be paid quarterly in
advance by the owner of the dwelling unit. The Township may
designate an agent, inclUding any bank or trust company, to act on
its behalf in the collection and accounting matters involved.
Billing will be done not later than the first day of the first
month of each calendar quarter. Fees shall be subject to a penalty
of ten (10%) per.cent per dwelling unit per quarter, if not paid by
the thirtieth (30th) day of the first calendar month of the
quarter. All accounts shall be considered delinquent if not paid
by the thirtieth day of ths first calendar month of the quarter and
all delinquent accounts are SUbject to stoppage of service without
notice. Upon stoppage, service will be resumed thereafter only on
payment of the accumulated fees for the period of collection and
the period of noncollection plus the ten percent penalty aa
aforesaid and interest. The stoppage of service herein provided
for shall be in addition to the right of the Township to proceed
for the collection of such unpaid charges by action in assumpsit,
