The Plaintiff is BRAD D. paNTZ, an adult individual who ourrently resides at 309 Virginia Road, Mechaniosbur.g, Cumberland County, Pennsylvania 17055. 2. The Defendant is SUSAN K. PONTZ, an adult individual who ourrently resides at 309 Virginia Road, Mechanicsburg, Cumberland county, pennsylvania 17055. 3. Both the Plaintiff and Defendant have resided in the Commonwealth of Pennsylvania for at least six months immediately previous to the commencement of this aotion. 4. Plaintiff and Defendant were married on November 16, 1976, at Mechanicsburg, Cumberland County, Pennsylvania. 5. There have been no prior actions for divoroe or annulment between the parties. 6. Plaintiff averB that he is entitled to a divorce on the qround that the marriage iB irretrievably broken. 7. The children were not born out of wedlock. The children are presently in the custody of both Plaintiff and Defendant, who both reside at 309 Virginia Road, Mechanicsburg, cumberland county, Pennsylvania. The Defendant suffers frolU a severe mental disorder which has required hospitalization in the past and which inhibits " her ability to be a nurturing and oaring parent to the ohildren, b. The Defendant has engaged in adulteress oonduot and has abused the use of presoription drugs and has not shown the ability or wherewithal to oonvey to these children a sense of values whioh are oonsistent with acceptable community standsrds, c. The Defendant has been incaroerated as a result of criminal convictions in the past, and may very well engage in future criminal conduct which would result in additional inoarcoration. 22. Each parent whose parental rights to the children have not been terminated and the person who has physical custody ot the children have been named as parties to this action. 23. Plaintiff requests the Court to grant custody of the children to Plaintiff. Sheely dated March 27, 1996, the fUll-time Master has been appointed in the above referenced divorce proceedings. A divorce complaint was filed on August 9, 1994, raising grounds for divorce of irretrievable breakdown of the marriage, adultery, and indignities. If the parties are not willing to execute affidavits of consent to conclude the divorce under seotion 3301(c) of the Domestic Relations Code, please advise me immediately so I can schedule a hearing on the alternative grounds of adultery and/or indignities. The divorce complaint raised the economic claim of equitable distribution. However, the motion for appointment of Master indicates that alimony is at issue. It does not appear as if that economic claim has been raised in the pleadings and if alimony is to be litigated the party wishing to raise the issue should file the appropriate pleadings. I am going to proceed on the basis that we do not have an issue with respect to grounds for divorce, and I am going to direct that each counsel in accordance with P.R.C.P. 1920.33(b) file a pre-trial statement on or before Friday, April 26, 1996. PONTZ, Derendant IN DIVORCE REI Pre-Hearing conference Memorandum DATEI Monday, February 2, 199B present for the plaintiff, Brad D. pontz, is attorney R. Mark Thomas, and present for the Defendant, susan K. Pontz, is the Family Law Clinic represented by Dawn Lisi, certified Legal Internl Thomas Place, supervisorl and Donald Marritz, staff attorney. A divorce complaint was filed on August 9, 1994, raising the grounds for divorce of irretrievable breakdown of the marriage, indignities, and adultery and the economic claim of equitable distribution. Counsel have advised that the parties will sign and file affidavits of consent prior to the hearing to be scheduled in these proceedings so that the divorce can be concluded under section 3301(C) of the Domestic Relations Code. an April 16, 1996, the Defendant filed a claim for alimony and alimony pendente lite. Counsel for wife have indicated that they are going to review wife's alimony claim to determine if the claim is one they wish to pursue based on the fact that many circumstances have changed since the claim was raised. Counsel for wife are going to let the Master and opposing counsel know if the alimony claim is going to be litigated. If the alimony claim is to be litigated, then Mr. Thomas has indicated that he is going to raise the factor of marital misconduct as that factor affects wife's alimony claim. Mr. Thomas will then advise the Master and opposing counsel of witnesses which he intends to call on that issue. counsel for wife will respond with a list of their witnesses on that issue. The parties were married on November 16, 1976, and separated accor.ding to wife in July 1994. Husband claims the parties separated January 29, 1992, because that was the date when wife requested that the court order husband to leave the marital residence. The date of separation may be relevant in determining how we value the few assets in this case involving pension benefits. counsel have indicated that they are probably going to need to present testimony on the date of separation . ~ illUe. Husband is 45 years at age and resides at 2001 Red Bank Road, Dover, Pennsylvania, where he lives with two ot the three ohildren of the marriage. He is a registered tield engineer. He has a high sohool diploma and a number at years as a surveyor. He is currently solt-employed, having been terminated tram employment with an engineering firm August 12, 1994. sinoe that time husband has been selt-employed. In 1993 his gross inoome annually was $41,000.00. currently his income annually is around $26,000.00. Husband has not raised any health issues and apparently he has health insuranoe on himself and the children. There is some question about whether or not husband is working up to his earning potentiall hOWever, husband's attorney J.ndicated that because of the severe problems in the home that husband's wor.k was affected and ultimately he lost his job. It counsel intend to pursue any issues with regard to husband's earning potential, they should advise Mr. Thomas as to any witnesses they intend to call on that issue so Mr. Thomas oan be prepared to present counter-testimony regarding husband's household circumstances around the time he was terminated from his employment. Wife is 43 years of age and resides at Second Floor, Front Apartment, 59 West Main street, Mechanicsburg, Pennsylvania, where she lives with the oldest child of the marriage. She was living with a Khalden B. Rasheed until Mr. Rasheed was incarcerated in the Cumberland County Prison as a result of the domestic problems with the Defendant arising out of their living arrangement. Wife is a high school graduate and is currently receiving social security disabJ.lity in the amount of $593.20 per month plus $43.Ba in medicare benefits. She is also receiving alimony pendente lite pursuant to an order entered August 7, 1997, in the amount of $150.00 per month. Wife has been diagnosed with a bi-polar disease and is using medication to control her illness. Counsel have indicated that after two years of receiving social security disability, wife will be eligible for medicare. The parties owned real estate at 309 Virginia Road, Mechanicsburg, Pennsylvania, which was sold and the proceeds placed in escrow. The amount of money which Mr. Thomas is currently holding is in a non-interest bearing account in the amount of $9,336.00. In 1995 husband received a disbursement from his pension which amounted to $22,B27.62 after taxes. His claim is that he used the funds for the family. The amount of the pension which is marital will depend on the date of separation r which is ultimately decided upon. Wife claims that a portion of the funds were used sclely for husband's own benefit1 therefore, counsel are requested to do a computation showing what portion of the pension distributed would be marital in their point of view and what portion of the funds should be considered used for marital purposes as opposed to individual expenses of husband. Counsel for wife wants to have the dates of distribution of the monies from husband's pension plan and evidence of payment of the marital debts. Counsel for wife is going to get in touch with Mr. Thomas within the next ten (10) days if 6he detormines there are any other documents or information which would help her in constructing the expenses that were paid out of the checking account for individual or marital purposes. Wife r~ceived a disbursement from her pension fund in May of 1992 in the approximate amount of $10,OaO.oo. She claims that this was all received before the date of separation and the funds were used for the family. Neither party has reported any marital debt which needs to be considered. The issues, therefore, revolve around establishing a date of separation and how the receipt of the funds from the pensions were spent, either for the marital interest or for individual interests. Also, depending on the date of separation we will have to establish what portion of the monies received from the pension of the husband was marital and what was nonmarital. Mr. Thomas indicated, however, that with respect to the statement made about marital debt, his client is going to claim that a portion of the monies that were disbursed to husband from his pension were used to pay on account of the marital obligations inclUding specific debts of the parties. In an effort to save time in unnecessary litigation, as well as costs, we would like to make a proposal tor settlement ot the Equitable Distribution issues. since Mr. Pontz I s pension was spent in preservation ot the marital residence, we will limit our proposal to the amount now held in the escrow account trom the sale of the home. Mr. Pontz had exclusive possession of the marital residence trom June 1997 to october 1997, so we believe that Mrs. Pontz is entitled to a credit for the fair rental value of her one-half interest in the marital property during that period. Assessing a $600.00 per-month fair rental value for the property, Mrs. Pontz would be entitled to three hundred dollars per month as compensation tor her interest in the marital property. Mrs. Pontz is willing to settle this matter if she receives one-halt the amount including interest held in the escrow account, plus $1500.00 for the tair rental value for the five months during which Mr. Pontz had sole possession of the marital home. The Petitioner has entered a plea of guilty to a char.ge of Retail Theft, felony offense, and is currently scheduled to be sentenced on that offense on October 15, 1996 in the Cumberland County Courthouse. 4. Over the past several years Petitioner has been incarcerated on several occasions and following her periods of incarceration has returned to the marital residence. 5. Trevor GUY Pontz, age 16, the oldest of the three minor children involved in this case, is demonstrating serious difficulties at this time in his life. Speoifically, tho following issues have risen within the past several months: a. He has exceeded the a llowed number of unexcused absences from school, and therefore may not receive credit for the current school year; b. He has indicated a desire to withdraw from sohool, and his mother, the Defendant/Respondent herein, has ." advised him that she would sign the neoessary doouments to allow him to withdraw from sohool, c. The tather, Plaintiff/Petitioner herein I has sought to oounsel Trevor, and has sought to have sohool administrators and ohurch oounselors work with Trevor to help him with his difficulties, and d. The father, Plaintiff/Petitioner, has reason to believe that his son is involved in the use of illegal drugs. 4. currently / both the Plaintiff /Peti tioner and the Defendant/Respondent have legal custody over this minor ohild. 5. PONTZ, I IN DIVORCE, CUSTODY, Defendant I EQUITABLE DISTRIBUTION BILL or PARTICULARS Pursuant to Pa.R.C.P 1920.21 the Plaintiff hereby files the following Bill of Particularsl 1. The Plaintiff has raised allegations that the Defendant has committed adultery and in support ot these allegations he sets forth the followingl (a) The person with whcm the Defendant committed adultery lived across the street from the parties in February, 1992. His first name is Doug, and the Plaintiff will have Doug's last name and present it to counsel in the near future. (b) These incidents would have taken place in tha Fall of 1991 and Winter of 1992. There has been no reconciliation between the parties since these acts of adultery occurred. (c) The acts of adultery were committed within the marital residence and the Americana Motel. The Plaintiff has photographs of Doug in the bedroom of the marital residence unclothed and sexually aroused. The Plaintiff confronted the Defendant with these photographs and at that time the Defendant admitted that she had taken the photographs and admitted that she had engaged in sexual intercourse with Doug. (d) The Plaintiff intends to call Doug as a witness and Doug , would testify to the commission of adultery with the plaintiff's wife. (e) The Defendant engagod in other adulterous acts with unknown men at the Defendant's mother's residence within the past two years. The Defendant's sisters found the Defendant in her mother's residenoe in bed with another man. (f) with regard to the oount concerning indignitie8 the Plaintiff aS8erte that the Defendant falsely brought a Protection From Abuse action against him on February 11, 1992. (g) Onoo the Plaintiff was removed from the house pursuant to the Protection From Abuse aotion the Defendant engaged in the adulterous conduct complained of above. (h) Prior to filing for the Protection From Abuse action the Defendant, in September 1991, hired Doug to repair the Dofendant'5 carport. While Doug was present and in the preael1ce of the Plaintiff Doug stated to the Defendant "Why don/t we go back to youX' bedroom and see what happens". (i) On one occasion the Defendant and Doug entered the marital residence while Plaintiff was present after having been out drinking together. They both lived In the home UlllU June, 1997, when Defendwlt moved Into her own residence. The parties purchased the home for approximately 553,000.00. The balance on the mortllalle is approximately 540,000. Because of the deteriorated condition of the home, II realtor will not market the house; however, Ihere is currently a contract to purchase tlle hllme for 557,500. The closlnll Is scheduled to occur around the middle of October, 1997. The parties have agreed that the proceeds from the fillle will be placed in WI escrow account at the Law Office of Walter WId Thomas, Plaintlfrs attorney. b. Plalnllrrs I.enslon FundI Plaintifrs pension fund, which accumulatcd during the course of the marrlaae, was disbursed in 1995, after the divorce action was l1led in tllis case. The value of the pension fund was 528,374.27 before Federal Income TII.X and 522,827.62 after lII.Xes. It Is alleged that Plaintiff purchased various Items willI llle pension money, including a 1988 Saab purchased for 54,500; a Jon boat purchased for 5800.00; various fishing equipment, value unkno1vn; and various business and office equipment with which to start his own surveying buslneSll, value unknown. Mark Thomas, files this Petition for a Custody Concil iation Conference, and in support thereof respectfully represents I L On August 9, 1994, the Plaintiff/Petitioner caused a Complaint for Divorce, Equitable Distribution and custody to be filed against the above-captioned Defendant/Respondent in this matter. 2. The Complaint was not served on the Defendant/Respondent and therefore a Praecipe to Reinstate the Complaint WIlS filed on March 24, 1995. 3. Pursuant to reinstatement of the complaint, a Custody Conciliation Conference was ordered to be held on April 26, 1995. 4. The Custody Conciliation Conference was held on April 26, 1995 before Dawn S. Sunday, Custody Conciliator. 5. A limited agreement was entered between the parties at the Custody conciliation Conference, and pursuant to that limited agreement an Order of Court was issued on May 8, 1995. (A copy of that Order of Court is attached hereto and marked Exhibit "A".) 6, sinoe the Order of May 8, 1995, issues have arisen whioh neoe..itate the need for Plaintiff/Petitioner to pursue this matter further. The speoifio issues are as folloWSl a. Defendant/Respondent has been arrested on criminal charges and is currently incarcerated in the York county Prison in lieu of bail, b. Defendant/Respondent is currently the SUbject of a oriminal investigation by the East pennsboro polioe Department in Cumberland county and may have oriminal oharges of forgery brought against her in the immediate future 1 and o. The parties' oldest child, Trevor GUY Pontz, age 16, has indicated a desire to quit school, and Defendant/Respondent has already advised him that she will sign the necessary documents to allow him to quit sohool. On the alternating weeks mother shall be entitled to visit with her children if she is able to arrange transportation through a friend or a family member to whom father would then release custody of the children to for purposes of facilitating the visitation. The current visitation privilegea for mother are acheduled for Sunday night from 7100 p,m, until 8130 p.m. The viaitation is aubject to change depending on where she is housed. Therefore, for purposes of thia Order, the period of viaitation which father shall be required to release and or tranaport the children for ahall coincide with that which ia acheduled by the Institution in which mother ia reaiding. 5. In the event that the father intends to change the residence of the minor children, he shall provide the mother with written notice as soon as poasible, but at least ten days prior to making any such move. 6. Neither party shall engage in any conduct, particularly in the presence of the children, which would tend to denigrate the other parent. Each parent shall encourage the children' a love and respect towards the other parent. 7, While the mother ia incarcerated, the children shall be encouraged to maintain contact with her by telephone. OPINION AHD OIDIR or COQBI A hearing was hold on September 4, 1997, with regard to plaintiff's appeal of the reoommended order of the Domestio Relations Offioe (DRO) dated July 30, 1997, denying her an award of alimony pendente lite (APL). The ORa officer oomputed APL in the amount of $34 and deviated to zero. After brief testimony from the parties ooncerning their inoome and expenses, oounsel presented cloaing argumenta. For the reasona discuased below, petitioner's appeal is granted in part. FINDINGS OF FAC'f 1. The partiea were married in 1976 and have three children ages 11, 12 and 18. Although respondent filed for divorce in August of 1994, the parties continued to live separate and apart under the same roof until four month a ago. 2. The two younger children reaide with respondent while the emancipated child reaides with petitioner. 3. Petitioner applied for Social Security Disability (SSD) benefita in 1994 becauae of depreaaion, and became eligible for benefits in 1995. She receivea monthly benefita in the amount of $637.00, with caah payments of $593.20 and Medicare benefits in DOMESTIC RELATIONS BECTION DR. 26,697 the amount of $43.00. These benefits are her sole source of income. As dependents o! petitioner, the two children receive a combined total of $310.00 per month in SSD b~nefits. Neither party is able to provide the children with medical coverage, respondent pays any medical and dental bills out of pocket. 4. Petitioner pays monthly rent in the amount of $425 (which includos heating) and incurs approximately $200 per month for personal expenses. She is on a budget plan for her electric bill and also pays for gas, sewage, trash, water and telephone. Petitioner's disability has impeded her from obtaining employment, and she is behind in her bills. 5. Respondent has been self~employed as a regiatered surveyor since he was permanently laid off from a consulting engineering firm in Harrisburg three years ago. Respondent claims to be earning at least 40% less than his salary last year at this time, but there are no documents to substantiate this drop in income. The Court therefore finds respondent's income to be $1,606 which is reflected on his 1996 federal income tax form. 6. Since the parties have been living separate and apart, respondent has been solely responsible for the $606.40 monthly mortgage owed on the marital home as well as maintenance. Respondent's other monthly expenses include $200 for the phone ($157 accounts for advertising in the phono book for his surveying business), $50 for water, $75 for electric, $40 for trash and sewage, and $10 for gas. Feeding the family costs an 2 DOMESTIC RELATIONS SECTION DR. 26,697 additional $100.00 per week. He pays oounsel fees when able. 7. After respondent lost his position with the engineering firm, he put his house up for sale. He oashed out his pension in order to pay baok mortgage payments and other overdue bills. The house is now under oontraot far sale with olosing expected to ocour at the end of September. DISCUSSION Four i.sues have been presented by this case. Petitioner maintains that the oRO offioer incorreotly caloulated the award of APL, first by disallowing her $318 in oredit toward ohild support and aeoondly, by giving reopondent a housing allowanoe. Petitioner further contends that the offioer laoked the authority to deviate from the guidelinea and reduce her award of APL to zero. Respondent's position is that petitioner is not entitled to an award of APL. We firat will address respondent's argument regarding petitioner'S right to reoeive APL. The Superior Court has recently summarized the purpose of awarding alimony pendsnte lite in Litmans v. Litmans, 449 Pa.Super. 209, 673 A.2d 382 (1996)1 'An award of alimony pendente lite is designed to enable the dependent spouse to prosecute or to defend a divorce aotion.' Demasi v. Demasi, 366 Pa.Super. 19, 38, 530 A.2d B71, BBO (19B7), appeal denied, 517 Pa, 631, 539 A.2d 811 (1988).' 'It is also designed to help the dependent spouse maintain the atandard of living enjoyed while living with the independent spouse.' rd. at 38, 530 414, 1380 , On subsequent appeal, Demasi V. Demasi, 408 Pa.Super. 597 A.2d 101 (1991), appeal denied 535 Pa, 619, 629 A.2d (1993). 3 OOMESTIC RELA'rIONS SECTION OR. 26,697 A.2d at BBO. In ruling on a olaim for alimony pendente lite, the oourt should oonsider the following faotors, the ability of the other party to pay, the separate estate and inoome of the petitioning party, and the oharaoter, situation, and surroundings of the parties. Orr v. Orr, 315 Pa.Super. 16B, 461 A.2d 1150 (19B31. Lltmans, 449 Pa.Super. at 224, 673 A.2d at 31l9. Respondent olaims that petitioner voluntarily inourred her present debts by moving from the marital home where she had no obligation to pay for the mortgage, maintenanoe of the home or the utilities. However, Pennsylvania oourts have not required a spouse to remain in the marital home, espeoially under the ciroumstanoe6 of a pending divorce. In view of the aforementioned factors set forth in Lltmans, this Court believes that petitioner is entitled to an award of APL. Regarding the amount of APL that petitioner should reoeive, Rule 1910.16-1 of the Pennsylvania Rules of civil Procedure provides as follows, a. The amount of ... alimony pendente lite to be awarded pursuant to the procedures under Rules 1910.11 and 1910.12 shall be determined in accordance with the support guidelines. Pa, R.C.P. No. 1910.16-1. Rule 1910.16-5(j), applicable to the present case, sets forth the following prooedure for determining support I (11 Determine the spousal support obligation of the custodial parent to tile non-custodial. parent based upon their net incomes from the grid for the spouse only, (21 Recompute the net income of the parties subtracting the payment of spousal support from the custodial parent's net income and add that amount to the 4 DOMSSTIC RELATIONS SECTION DR. 26,697 non-custodial parent's net income, (3) Determine the ohild support obligation of the non-custodial parent baaed upon the reoomputed net incomes in step 2 from the grid for two ohildren, and (4) Determine the recomputed support obligation of the custodial parent to the non-custodial parent by subtracting the non-custodial parent's child support obligation from step (3) from the original support obligation determined in step (1). The first of petitioner's issues arises from the support officer's determination of respondent's income. She found his income to be $1606 per month but then gave him a 28% housing allowance in view of this Court's deuision in Bear v. Bear, 52 Support 1990, in which the wife was given a 25\ housing allowance. As petitioner has argued, the facts of that case are entirely inapposite to those of the inetant case. In Bear, the wife's earning capacity was assessed at $712.08 per month yet she was responsible for the monthly mortgage of the marital home in the amcunt of $1,404 per month. Additionally, the husband had been earning an annual salary of $150,000 and after voluntarily leaving hiB el1lployment was earning $80,000. While we understand the support officer's compassion for the circumstances of respondent, we do not believe that providing him with a housing allowance is appropriate. As noted in the facts, the records reflects respondent's income to be $1606 a month. After applying the formula in the guidelines, the Court can deviate from the amount of APL upon discussing the faotors Bet 5 DOMESTIC RELATIONS SECTION ~ DR' 26,697 forth in Rule 1010 .16~4. See MoCarty v. Smith, 440 Pa.Super. 280, 285, 655 A.2d 563, 565 (1995) (deviation must be made after the guideline amount ia determined). After oomputing the parties' incomes, the support officer used the grid to determine petitioner's child support obligation. She then subtraoted this obligation from the APL, aB the guidelines direot. $ 315' ~ ill $ 34 APL child support owed APL The officer deviated from the $34 to zero and denied APL. Petitioner argues that ahe should have been given $318 in credit to offset the child support obligation which would make the amount owed in support zero. The Pennsylvania Superior Court held in Children and Youth Servioes of Allegheny County v. Chorgo, 341 Pa.Super. 512, 491 A.2d 1374 (1985) that oredit should be given for sooial security payments made directly to the child when the obligor's employment oooasioned the benefits. However, Chorgo WIlS later oonstrued as setting forth A rebuttable presumption that oredit is appropriate, if a party opposing credit persuades the court otherwise, the oourt must artioulate the reaeons for its findings on the reoord. Preston v. Preston, 435 Pa.Super. 459, 646 A.2d 1186 (1994). In the present case, respondent filed for support of the two ohildren and WAS denied by the Honorable Kevin A. Hess for the reAson that the children were receiving money from SSD benefits in excess of the recommended guideline amount. Thus, Judge Hees' deoision followed the presumption that petitioner should receive oredit for the payments, otherwise, petitioner would have owed child support. Moreover, respondent did not attempt to rebut the presumption either by appealing th~ support decision or pursuing the issue in the present action. Aocordingly, we will use zero as the amount of child support owed by petitioner, and the award of APL is therefore oomputed at $400 per month. $ 400 APL to petitioner o child support 400 APL - $ 7 DOKBSTIC RELATIONS SBCTION ~ DR' 26,697 However, as alluded to previously, this Court has the power to deviate from the APL amount determined by the guidelines upon oonsideration of these faotorsl (11 unusual needs and unusual fixed obligations, (2) other support obligations of the parties, (3) other inoome in the household, (41 ages of the children, (51 ass~ts of the parties, (61 medioal expenses not covered by insuranoe, (71 standard of living of the partios and their ohildren, and (81 other relevant Ilnd appropriate factors, inoluding the best interests of the ohild or ohildren. Pa.R.C.P. No. 1910.16-4(bl. After taking into oonsideration the faot that the children are not oovered by medioal insurance, ~hat respondent oashed in his pension to pay expenseB after a reduction in salary, the pending divorce, and the best intorests of the ohildren, this Court believes that APL should be rsduced to $150.00 per month. Although the sale of the home will provide funds, if and when finalized, respondent still has to provide housing for himself and the two ohildren.
