COMPLAINT
1. The Plaintiff is HARRIS SAVINGS DANK, which formerly was
Harris Savings Association and forlllerly thereto The Harris Savings
Association, a corporation organized and existing under the laws
of the State of Pennsylvania and having its principal place of
business at Second and Pine Streets, Harrisburg, Pennsylvania,
l7101.
2. The Defendants are LEROY II. RUFF IInd PAULETTE M. RUFF,
two adult indiViduals, residing at 35 Old Stonehouse Road,
Carlisle, Silver Springs Township, Cumberland County, Pennsylvania,
l7013.
3. Defendants, on Auguat 11, 19BB, entered into a mortgsge
loan indenture with Harris Saving!! Association, now HARRIS SAVINGS
DANK, in the principal amount of FIFTY SEVEN THOUSAND SIX HUNDRED
DOLLARS and 00/100 (~57,600.00), the terms of which loan are more
specifically evidenced and set forth in the mortgage indenture
dated August 11, 198B, and recorded August 15, 19BB, in the
Cumberland County Recorder's Office in Mortgage Dook 913, Page 662,
a copy of which is attached hereto, marked Exhibit "A", and made
II part Ilereof by reference, which mortgage contains and is a lien
upon the property aituate at 35 Old fltonchoullll Road, Carlisle,
Silver Spring" Townahip, CUllIberland County, Panllaylvallia, 170l3,
being improved upon with n dwelling.
4. Said loan WolS further evidellced and secured by a note
which accompanied aaid mortgage dated Auguat 11, 1988, a oopy of
which is attached hereto, marked Exhibit "B", and made a part
hereof by reference.
5. lIarri II :3llvings Association, now lIarris Savings Dank, in
consideration of the said mortgage and accompanying note, advanced
to LEROY 11. HUI''!' and l'AULE'l"n: N. HUt"F', hia wife the 6um of FU''l'Y-
SF:VEN 'l'1I0USAND SIX liUNllHEU llOLIJAHS and 00/100 ($57,600.00).
6. 'l'he premises subject to said mortgage is more
specifically set forth in l':xhibit "A", attached heretQ and made a
part hereof by reference.
7. LEROY 11. HUFF and l'AULE'l"l'E N. RUi'I" are the sole owners
of the aaid premises contained in 6aid mortgago.
8. Said mortgage and note have not been assigned in whole
or in part by the Plaintiff herein.
9. LEHOY II. RUFF and l'AULl::'l"J'E ~I. HUFl" are the record owner's
in fee simple of said premioes by virtue of a Deed dated June 13,
1988, and recorded in the Cumberland County Recorder's Office in
Deed Book M-33, Page 1125.
10. No judgment has previously been entered on said mortgage
or note in any juriadiction, and aaid inatruments are lesa than
twenty (20) yeara old.
11. The said mortgage ia in default because Defendants herein
have failed to pay the monthly payment of $442.00 that was due and

owing for each of the months of Maroh, April, May, June and July
1994.
12. The Plaintiff has given to the Defendants written notice
of intention to forecloae on lIaid mortgage all required by law under
Act 6, dated May 12, 1994, copiea of which /Ire marked l>xhib1.tll "c"
and "D", and attached hcrlito and made II [lal't hereof by reference.
13. 'I'he Plaintiff haa given written notice of default aa
required by the Homeowner'a Emergency Assiutance Act of 1983, dated
May 12, 1994, copies of which are marked Exhibits "E" and "P", and
attached hereto and made a part hereof by reference.
14. The entire principal amount of FIPTY SEVEN THOUSAND SIX
HUNDHED DOl.LARS alld 00/100 ($57,600.00) haa become due and payable,
together with interest at the rate of 5.875% per annum, reasonable
legal fees for collection of said sum in accordance with the terms
of said mortgage less such sums as have been paid on account of
principal of the said mortgage and costs.
l5. The P laintif f believes and therefore avers that
reasonable legal fees for collection is $2,822.00.
16. The Defendants /Ire liable to the Plaintiff for interest
at the current rate of 5.875% per annum until paid, late charges,
property taxes and expenses as provided in and collectible under
the mortgage documents that will accrue until distribution by the
Sheriff of Cumberland County, Pennsylvan1.a, to be computed at the
time of judgment in these proceedings in addition to the current
loan balance.

Defendants are mombers of the armed forces or are in the militory
service of the United Statea of IImerica.
WUERBPORE, the Plaintiff prays the Court to enter Judgment
against the Defendants, LEROY H. RUFF and PAULETTE M. RUFF, his
wife, of Mortgage Foreclosure against and aale of the mortgaged
property, with damages in the amount of SIXTY THOUSAND SIX HUNDRED
NINETY EIGHT DOLLARS and 64/l00 ($60,698.64), together with
additional interest thereon, costs and all other amounts advanced
by Plaintiff.
