alimony, division of property, lawyer's fees or expenses if I do

By order of Court of Prosident Judge Harold E. Sheely
dated August 22, 1996, the full-time Master has been appointed
in the above referenced divorce proceedings.
A divorce complaint was filed on August 11, 1994, raising
grounds for divorce of irr.etrievable broakdown of. the marriage
and the economic claims of equitable distribution, alimony
pendente lite, and attorney fees Dnd cost. Alimony has not been
raised in the action.
On August 16, 1996, on amended complaint was filed
averring that the parties hove been separated f.or a period in
exoess of two years. An affidavit under Section JJ01(d) was
filed on the same dote averring that the parties separated on
July 9, 1994. Therefore, grounds for divorce are not at is~ue
unless the Defendant is contesting the date of separation.
The motion for appointment of Master indicated that Mr.
Cramer has entered an appearance on behalf of the D~fendant.
However, no appearance has been entered of record and I ask that
Mr. Cramer verify his representation of the Defendant by
entering his appearance in this action.
I am directing each counsel in accordance with P.R.C.P.
1920.33(b) to file a pre-trial statement on or before Monday,

AND NOW, comes your Petitioner, ROBERT C. MoJILTON, by
and through his attorneys, MANCKE, WAGNER, HERSHEY & TULLY, and
tiles the following petition for apeoial Relief pursuant to the
provisions of the Divorce Codel
1. Your Petitioner, ROBERT C. McJILTON, is an adult
individual ourrently residing at 336 Juniata Parkway East,
Newport, Perry county, Pennsylvania.
2. The Respondent, GERI CASS-McJILTON, is an adult
individual currently residing at 204 New Bloomfield Road,
Duncannon, Perry county, Pennsylvania.
3. The parties were divorced March 2, 1998, in the
Court of Common Pleas of Cumberland county.
4. As part of that divorce proceeding, the parties
entered into a comprehensive Property Settlement Agreement, a
copy of which is attached hareto, incorporated herein by
reference and marked as Exhibit A. (The Petitioner herein has a
tully executed copy identical to Exhibit A),
6. Pursuant to the provisions of the Agreement, the
Respondent herein was to be solely responsible tor the mortgage
on the home, which said mortgage was through PNC Mortgage corp of
America.
6. on or about May 3, 1999, Petitioner herein received
notice from PNC Mortgage Company that the Respondent has failed
to comply with the provisions of the Agreement in that she has
not made the mortgage payments generating a total balanoe due and
owing for the period of 1/25/99 through 5/3/99 of $1,457.03.
7. Failure to pay the mortgage is in direct
contravention of the provisions of the Agreement.
8. In addition to the above mortgage, at the
conclusion of the divorce, the parties had oertain debts that
each assumed, one of which was a credit card,
9. Respondent herein made payments on said credit
card, then defaulted on said payments, which has resulted a
charge to the Petitioner herein.
10. Petitioner is forced to pay approximately
$3,000.00 for this credit card debt, which was the debt of the
Respondent herein.
11. As a result of the aforementioned Agreement, the
Petitioner has been forced to pay almost $3,000.00 to PNC, and
has been requested to pay $1,457.03, because of the default in
the payment of the mortgags, both of which obligations were that
ot the Respondent herein.
12. Respondent has violated the provisions of the
Agreement, and Petitioner seeks relief from the court.
WHEREFORE, petitioner prays this court that the Court
grant Petitioner's reliet by direotingl
B.
Respondent pay unto Petitioner all sums of money
that he has paid to PNC on the aforementioned
credit card debt,
Respondent pay unto Petitioner herein all sums of
monBY that he is now required or in the future to

pay on ac~ount of the mortgage with PNC Mortgage
Corp of America,
C. grant Petitioner's request for counsel fees/ and
D. such other relief as the Court deems appropriate.
