1, The Plaintiff, T. Jill Derr, is an adult individual
currently residing at 312 Easl; chestnut Street, Selinsgrove,
Pennsylvania,
2, The Defendant, Woodrow William Adams, Jr. is an adult
individual with a last known address of 13643 Harrisville Road, Mt.
Airy, Maryland 21771, This address is also the last known address
of the Woodrow William Adams, Jr, Trucking Company,
3, The events herein related took place on southbound Route
11 in Eaet J?ennsboro Township, Cumberland County, Pennsylvania on
or about March 30, 1994 at approximately 6:45 p.m,
4, At that time and place, George R, Derr, Jr. was driving
the Plaintiff's 1984 Mercury Colony Park title number 36458162703,
registration plate number JGM-696. The Plaintiff and four minors
were passengers in the vehicle at the time of the accident.
5, Also at that time and place, the Defendant Woodrow
William Adams, Jr., was operating a 1990 Peterbilt tractor trailer
title number IXP5DR9XILD302469, Maryland registration plate number
123-P18, which tractor trailer was owned by the Defendant,
6. 'rhe subj ect accident occurred as George R, Derr, Jr.,
slowed the Plaintiff's vehicle and eased into the berm to position
the vehicle to make a right hand turn into the parking lot of a
business establishment,
7, As George R, Derr, Jr, was engaged in the above-deacribed
conduct, the Defendant was also travelling in the same direction
and made a right hand turn directly into the path of the
Plaintiff's vehicle and collided with the same,
B, Impact occurred between the right side of the Defendant's
trailer and the l.eft side of the Plaintiff's vehicle,
9, The Defendant's negligent, careless I and reckless conduct
was the proximate cause of the subject accident and such negligence
included, inter alia:
a, Maldng a right turn into the path ot a vehicle travelling
in the samB direction and colliding with such vehiclel
b. Failing to be attentive to the position of other vehicles
on the roadwaYr
c. Driving in a car.elese and reckless mannerr
d. Failing to properly utilize rear-view and side-view
mirrors and other devices on the tractor trailer,
e. Failing to yield the right of way of the Plaintiff's
vehicle,
10. solely as a result of the negligence of the Defendant,
the Plaintiff incurred the fOllowing damages!
a. Total loss of Plaint iff's vehicle appraised at $3,286.00,
b. Transfer and title fees - $54,00,
o. Car rental. $957,13, necessary to complete family trip
to Florida, which was the destination at the time of the
accident 1
d, Towing $100.00,
e. Loss of use of vehiole,
f. Loss of personal property in the vehicle.
11. The damages pleaded are less than $10,000 and are within
the limits of compulsory arbitration in Cumberland County.
WHEREFORE, Plaintiff demands judgment in her favor and against
the Defendant in this case and such costa and fees which this Court
deems just and appropriate under the circumstances,
