'l'he Plaintiff is barred from recovery in that by engaging in conduct previously concerning the coffee mug, failing to take appropriate action, and failing to disengage from the Defendant, Plaintiff asaumed the risk and in barred from recovery. 30, As to the count in negligence, the Plaintiff, by his actions of quickly opening the door in a sudden offensive manner, was partially responsible, and the comparative negligence aot bars him from recovery, WHEREFORE, Defendant demands the Complaint filed against him be dismissed.
