COMPLAINT
AND NOW comes Vlaintiff, SSGC, rnc., t/d/b/a Silvor spring
Golf Course, by its attorneys NAUMAN, BMITH, BHIBBuma & HAuu and
makes the within Complaint against the Defendants, Michael J.
Vllvrick and Terri Vavrick, s/k/a Terry L. Vavrick, his wife / as
follows I
1. Plaintiff, SSGe, Inc., is a business corporation
organized under the laws of the Commonwealth of Pennsylvania,
having offices located at 136 Sample Bridge Road, Mechanicsburg,
Cumberland county, Pennsylvania.
2. Defendant, Michael J. Vavrick (hereinafter "Vavrick"), is
an adult individual residing at 326 Oeerfield Road, Camp Hill,
Cumberland County, Pennsylvania.
3. Defendant, Terri Vavrick, a/k/a Terry ~. Vavrick, is an
adult individual residing at 325 Deerfield Road, Cal1Jp Hill,
Cumberland county, Pennsylvania, and is the wife of Michael J.
Vavrick.
", At all times material hereto, Plaintiff, SSGC/ Inc. /
owned and operated a public golf course under the fictitious name
Silver Spring Golf Course,

5. On or about May 27, 1994, Defendants, Michael J. Vavrick
and Terry L. Vavrick, executed a demand note (hereinafter the
~Note~) wherein Defendants obligated themselves to pay to
Plaintiff, SSGe, Inc., or its assigns, the principal sum of Seven
Thousand Eight Hundred Dollars ($7,800.00) with interest and
authorJ. zed the Prothonotary to enter j udgl1Jent against them for. said
SUI1J plus reasonable attorneys collection fees of f.ive percent (5%).
6. A true and correct copy of the original Note instrument
authorizing the entry of judgment by confession and fully executed
by Defendants is attached hereto as Exhibit "A" and made a part
hereof.
7. The Note attached as Exhibit ~A~ has not been assigned.
8. Plaintiff has mude demand upon Defendants for payment of
t.he sum due it in the amount of Seven Thousand Eight Hundred
Dollars ($7,800.00) but Defendants have failed and continue to fail
to make payment to Plaintiff. A true and correct copy of
Plaintiff's letter demands dated June 17 and Augul3t 31, 1994/
respectively are attached hereto as Exhibit ~B~ and made a part
hereof.
9. Defendants, Michael J. Vavrick and Terry L. Vavrick, his
wife, are in default in their obligation to Plaintiff whereby under
the Note the entire principal sum of Seven Thousand Eight Hundred
Dollars ($7,800.00) plus attorneys collection fees of five percent
(5%) is in default and immediately payable.
10. Defendants, Michael J. Vavrick and Terry L. Vavrick, his
wife, are liable to Plaintiff as follows:

Plaintiff, and against the Defendants, Michael J. Vavrick and Terri
VavJ:ick a/Kia TerJ:Y L, Vavrick, for their failure to plead to the
Complaint in the above-captioned proceeding within the required
time. 'fhe Complaint contains II Notice to Pefend within twenty days
from the date of service thereof. Defendants were served with the
Complaint on October 12, 1994, and their AnsweJ: was due to be filed
on November 1, 1994,
Attached as Exhibit "A" is a copy of Plaintiff's written
Notice of Intention to File Praecipe fol' Entry of Default Judgment
which I certify was mailed to the Defendants at their last known
address by Certified Mail, Return Receipt Requested on November 3,
1994, and were received by the Defendants on November 4, 1994, as
evidenced by the return receipts attached hereto and marked Exhibit
"B", which is at least ten days prior to the filing of this
Praecipe.
Please assess damages in the amount of Eight Thousand Three
Hundred Eighty-five ($8,385.00) Dollars, being the amount demanded
in the Complaint.
