PETITION OF JAMES L. GOLDSMITH, ESQUIRE,
CHAIRMAN OF UNINSURED MOTORIST ARBITRATION
PANEL. FOR ISSUANCE OF SUBPOENA
1. Plaintiffs, Joan D. Karczewski, Laura KarczewEki and
Judith Karczewski ("Plaintiffs"), have made a claim for uninsured
motorist benefits to Defendant, State Farm Mutual Automobile
Insurance Company ("State Farm"), pursuant to the terms of a
private passenger automobile insurance policy issued by State Farm,
under which Plaintiffs were insured. This claim arises out of a
motor vehicle accident which occurred on or about October 1, 1989.
2. Plaintiffs are represented by Marcus A. McKnight,
III, Esquire, of the firm of Irwin, Irwin & McKnight, 60 West
Pomfret Street, CarliSle, Pennsylvania 17013-3216.
3. state Farm is represented by Stephen L. Banko, Jr.,
Esquire, of the firm of Foulkrod, Reynolds , Havas, 101 Pine
street, Harrisburg, Pennsylvania 17108-0932.
4. Pursuant to the terms of the aforesaid insurance
policy, Plaintiffs selected as their arbitrator, Albert H. Masland,
Esquire, and Harvey Freedenberg, Esquire, was selected to serve as
state Farm's arbitrator. These two individuals chose Petitioner
herein, James L. Goldsmith, Esquire, as the neutral arbitrator and
chairman of the arbitration panel.
5. The parties hereto have not been able to agree upon
the parameters of permissible discovery pursuant to the terms of
the aforesaid insurance policy. It is state Farm's position that,
under the terms of the policy, it is entitled to obtain the office
records of Plaintiff's treating physicians.
6. The arbitration panel has decided that the records
of the treating physicians are material to the proceeding, that
state Farm is entitled to obtain such discovery and that a
subpoenas should issue so records depositions may be utilized to
obtain the requested medical records.
WHEREFORE, Petitioner, James L. Goldsmith, Esquire, prays
this Honorable Court enter an Order directing the Prothonotary to
issue a miscellaneous docket number to this proceeding and issue
subpoenas for the purposes of obtaining medical records relating to
Plaintiff Joan D. Karczewski from George P. Branscum, Jr., M.D.;
Holy Spirit Hospital; Carlisle Hospital; Chambersburg Hospital;
