LAW vs. NO, 94. CIVIL R & A BENDER, INC. and CHARLES LEON SHEW, Defendants. ~ COUNT I, MARLIN E, JOHNSON. SR. v, CHARLES LEON SHEW AND NOW, comes the Plaintiff by and through his attorneys, FLOWER, MORGENTHAL, FLOWER & LINDSAY, and states as follows: 1. Plaintiff, MARLIN E. JOHNSON, SR., Is an adult Individual, residing at 15 Quarry Hill Road, Newville, Cumberland County, Pennsylvania, 17241, 2, Defendant, CHARLES LEON SHEW, Is an adult Individual residing at 3755 White Church Road, Chambersburg, Franklin County, Pennsylvania 17201. 3, Defendant, R & A BENDER, INC, is a Pennsylvania corporation, with offices at p, O. Box 399, Scotland, Franklin County, Pennsylvania 17254, engaged In the business of rubbish removal. 4. At all times relevant hereto, Defendant CHARLES LEON SHEW was the agent and employee of Defendant R & A BENDER, INC., and operated a 1984 Mack refuse truck. 2 il Ii c:'wpSI~.com " ~ ..,.", 5. On or about August 29, 1992, at or about 9:15 a.m., Plaintiff was operating a 1978 Datsun automobile westbound on West Orange Street In the Borough of Shlppensburg, Cumberland County, and had stopped his motor vehicle at the stop sign at the intersection of West Orange Street with South Morris Street. 6. As Plaintiff's motor vehicle was stopped at the Intersection, Defendant CHARLES LEON SHEW caused the 198458,400 pound Mack garbage truck which he was driving to strike the rear of the vehicle driven by Plaintiff, causing Plaintiff's head to snap back Into the glass back window of his truck. 7, The accident In question was the sole result of the negligence of Defendant CHARLES LEON SHEW, In the following particulars: A. Operating his motor vehicle at an excessive speed under the Failing to take into account the weight and mass of the motor vehicle he was operating, and the degree of damage which It would cause upon rear-ending another motor vehicle. circumstances; B. As a result of the Impact, which was caused solely by the negligence of Defendant, Plaintiff suffered a blow to the head and a flexion/extension Injury to his neck and cervical vertebrae, causing severe headaches, neck pain, and loss of stamina, causing him substantial pain, suffering and Inconvenience In the past, and continuing to cause him substantial pain, suffering and Inconvenience in the future, and causing him to suffer a loss of wages as a result of a temporary total disability, and an extended partial disability, resulting In past work loss, which extended partial disability and lack of stamina Is expected to cause Plaintiff substantial loss of earning capacity in the future.
