The Office of Attorney General is prepared to enter into a plea agreement with Anderson Brooks in exchange for his complete and truthful cooperation with this Office's investigation into narcotics trafficking. Anderson Brooks will plead .quH:1ly- to the offense of Unlawful Manufacture, Delivery, or Possession with Intent to Manufacture or Deliver Cocaine, a schedule II controlled substance, 35 Pa.C.S, S700-113 (a)(30), such count representing two to 100 grams of cocaine. l.'he Commonwealth will not file any notice of mandatory minimum sentence nor will the Commonwealth seek any mandatory Ininimum sentence. The Commonwealth will outline Anderson Brooks' cooperation to the Court at the time of sen tencing , At- the-, time-the-,gu,i..Lty-plea-,i,s-entered-the-' defendant, sha.1J.-admit.,to-the,Court that he is,. in fact, guilty of the offen8e-~harged" The Commonwealth will be entitled to bring to the sentencing courts attention and the court will be entitled to consider any failure by Anderson Brooks to fulfill any obligation under this agreement. Otherwise, the Commonwealth will make no other recommendation at the time of sentencing. 2. Anderson Brooks shall provide the Office of Attorney General with complete and truthful information about his drug trafficking activities as it relates to the prosecution of Paul Perry, Rondell Wright and any other individual who will be prosecuted as a result of his or her involvement in this cocaine trafficking organization centered in Carlisle, Pennsylvania, In addition, Anderson Brooks will testify truthfully when requested by the Commonwealth at all court proceedings resulting from the arrest of Paul Perry, Rondell Wright and any other individuals involved in this cocaine traffIcking organization centered in Carlisle, Pennsylvania. 3, Anderson Brooks waives and agrees to waive any right to a speedy trial under the Constitutions of the United States and Pennsylvania and other rules of court and understands and agrees that sentencing may be delayed until the cooperation phase has been completed so that, at sentencing, the court will have the benefit of all relevant information, I " . 4. Nothing in this agreement will protect Anderson Brooks in any way from prosecution for any offense committed after the dote of this agreement including Perjury, in violation of 18 Pa.C.S. 54902, Folse Swearing, in violation of 10 Pa.C,S, 54903, and Obstructing Administration of Law or other Governmental Functions, in violation of 18 Pa.C.S. 55101, should Anderson Brooks commit any of these offenses during the cooperation phase of this agreement. Should Anderson Brooks be charged with any offense alleged to have occurred after the dote of this agreement, the information and documents disclosed to the Commonwealth during the course of the cooperation will be used against the Defendant in any such prosecution. 5. This document states the complete and only plea agreement between the Office of Attorney General and Anderson Brooks in this matter, and is binding only on the parties to the agreement, supersedes all prior understandings, if any, whether written or oral, and cannot be modified other than in writing that is signed by all parties, No other promises or inducements have been or will be made to the defendant in connection with this case, nor have any predictions or threats been made in connection with this plea. Anderson Brooks also understands and agrees that any sentencing recommendation contained in this document is a recommendation only and sentencing is at the sole discretion of the sentencing court. On October 15. 1993, the petitioner was arrested for violating ~ 780- 113(a)(30) of the Controlled Substance, Drug, Device and Cosmetic Act, 35 Pa.C.S,A. ~ 780-113(a)(30), (hereinafter Act). On March 29, 1994, the petitioner entered a plea of nolo contendere to his violations of the Act and, as a result of the no contest plea, on August 4, 1994, the Pennsylvania Department of Transportation suspended the petitioner's motor vehicle operating privileges, The notice of suspension provided: · As a result of your conviction on 7/19/1994 of violating Section 13A30 of the VehIcle Code, Delivery of CTRL SUB on 7/01/1992, your driving privilege Is being SUSPENDED for a period of six month(s) as mandated by Section 1532 C of the Vehicle Code.' (Notice of suspension at 1) (emphasis added). " 94-4641 CIVIL TERM This notice of suspension Inaccurately lists the statute which the petitioner had violated. Section 13A30 of the Vehicle Code does not exist, and the petitioner contends that the notice of suspension, listing a non-existent section of the Vehicle Code, was not sufficient to notify him of the grounds upon which his suspension was based. As there was no proper notification, the petitioner asserts that the suspension of his license occurred In violation of his due process rights. Furthermore, the petitioner contends that a plea of nolo contendere Is not a .convlctlon. under the Act which would permit the suspension of his driver's license. Dlscusslgn It must be noted Initially that a notice of suspension serves the function of a pleading In a license suspension proceeding. Pennsvlvanla Deoartment of TransDortatlon, Bureau of Driver L1censlna v, Balloch, 143 Pa. Commonwealth 637, 508 A,2d 110 (1991). As a general rule, where the proofs presented at trial vary from the allegations of the pleadings, the party with the burden of proof must amend Its pleadings to conform to the proof. .Qllil...Q.f Washlnaton v. Johns, 81 Pa, Commonwealth 601, 474 A.2d 1199 (1984). This rule holds true where the variance between proof and pleading Is material, but is not applied to require amendments to pleadings where the variance between proof and pleading Is 2 94-4641 CIVIL TERM Immaterial. la, at 604,474 A.2d at 1202, The Issue before this Court Is, therefore, whether the Incorrect citation of the Controlled Substance Act In the notice of suspension was a material error. In asserting that the error In the notice of suspension was material, the petitioner cites the opinion of the Pennsylvania Commonwealth Court In Sutton v. Commonwealth Deoartment otJranspor1atlon, _ Pa, Commonwealth _,641 A.2d 34 (1994). The Sutton case Involved a license suspension Imposed as a result of a refusal to submit to chemical testing. la, at _, 641 A,2d at 35. As in the Instant case, the Notice of Suspension In Sutton contained erroneous Infonnatlon. la. at -,641 A.2d at 36. More specifically, the notice of suspension In Sutton Incorrectly stated the date that Mr, Sutton had refused to submit to chemical testlng.1 Noting that each and every Instance of refusal [to submit to chemical testing] constitutes a separate and cognizable basis for suspension , . , [and that] the date alleged in the notice of suspension Is the ~ way In which PennDOT identifies the refusal for which It Is attempting to revoke a driver's license, the Court in Sutton concluded that a mistake with regard to the date of refusal was 'The Notice of Suspension Indicated that Sutton had refused to submit to testing on February 4, 1993, when the refusal had actually occurred on February 3. ~ at _, 641 A.2d at 36, 3 .' 94-4641 CIVIL TERM material. Sutton at _,641 A,2d at 37, (emphasis added.) The Instant case Is distinguishable. The notice of suspension In this case provided a specification of the violation, (DELIVERY OF CTRL SUB) and Indicated the date of conviction and the date of arrest. Viewing these facts together we conclude that the error contained In the notice of suspension was not material and that the notice was sufficient to apprise the petitioner of the charge underlying the suspension of his license. Accordingly we find that PennDOT's suspension of the petitioner's license did not violate due process notice requirements, ~ l:Iughes v, Pa, Board oLProbation and ~, 81 Pa, Commonwealth 87, 473 A,2d 225 (1984) holding that variance In the location of an alleged parole violation Is not material when the violation Is Identified not only by where It took place but also by the date of arrest, the date of conviction and a specification of the violation.) In addressing the petitioner's contention that a nolo contendere plea does not amount to a conviction for purposes of license suspension, we note that the suspension of a driver's license Is a direct criminal penalty resulting from a violation of the Controlled Substance, Drug, Device and Cosmetic Act, Commonweallh Deel. ofTranseort~tlon v. Cassld}'. 156 Pa. Commonwealth Ct. 11, 628 A,2d 1179 (1993), Additionally, we note that a plea of nolo contendere Is 4 94.4641 CIVIL TERM tantamount to a guilty plea with regard to its effect on a particular case, . 426 Pa. Superior Ct,. 626 A.2d 163 WJgQ. ~, _ Pa. _. 636 A,2d 633 (1993), As the petitioner has entered a plea of nolo contendere and as this plea has the effect of a guilty plea with regard to sentencing In this case, we find that Penn DOT's suspension of the petitioner's license was proper. For the foregoing reasons, the order suspending the petitioner's operating privileges is sustained, 5
