STIPULATION AGAINST LIENS

THIS AGREEMENT made the \I.kl. day of August, 1994, by and between H, EDWIN
BERKHEIMER, heroinafter referred to as Contractor, and MICHAEL L, JUMPER and SONORA
L JUMPER, husband and wife, hereinafter referred to as Owner, whereby the former undertakes
and agrees to erect and construct a single family dwelling on:
ALL THAT CERTAIN piece or parcel of land situated in the Township of South
Middleton, in the County of Cumberland, Commonwealth of Pennsylvania, more particularly
bounded and described as follows:
BEGINNING at a point on the southern legal right.of.way line of North Pin Oak Drive
at the dividing line between Lots Nos. 64 and 65 as shown on the hereinafter mentioned Plan of
Lots; thence along said dividing line between Lots Nos. 63 and 64 on said Plan, South 3 degrees
13 minutes 35 seconds West, a distance of 150.78 feet to a point at the dividing line between Lots
Nos. 64 and 100 as shown on said Plan; thence along the line dividing Lot No. 64 from Lots Nos.
99 and 100, North 79 degrees 37 minutes 2 seconds West, a distance of 120.60 feet to a point;
thence along the dividing line between Lots Nos. 64 and 99, South 80 degrees 12 minutes 14
seconds West, a distance of 31.13 feet to a point at the dividing line between Lots Nos. 63 and 64,
as shown on said Plan; thence along said dividing line between Lots Nos. 63 and 64, North 3
degrees 13 minutes 35 seconds East, a distance of 142.77 feet to a point on the southern legal
right-of.way line of North Pin Oak Drive; thence along said southern legal right.of-way line of North
Pin Oak Drive, South 86 degrees 46 minutes 25 seconds East, a distance of 150 feet to a point on
the same at the dividing line between Lots Nos. 64 and 65, as shown on the hereinafter mentioned
Plan of Lots, the Place of BEGINNING.
BEING Lot No. 64 as shown on a certain Subdivision Plan of Lots entitled "Final Plan
of Phase Four for THE OAKS", as recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, In Plan Book 66, Page 65.
BEING the same property which Max E. Stoner and Lawrence C. Zimmerman, Co-
Partners, trading and doing business as Stoner & Zimmerman Enterprises, a Pennsylvania General
Partnership, by their Deed dated June 30, 1994, and recorded in the Office of the Recorder of
Deeds in and for Cumberland County, in Deed Book 107, Page 932, granted and conveyed unto
Michael L. Jumper and Sandra L. Jumper, husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of One ($1.00) Dollar to him in hand paid by Owner, the receipt whereof
is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting through or under them, covenant and

agree that no mechanic's liens or claims thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, In, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this Instrument, waiving the right of lien, shall be an independent covenant.
