PETITION POR WRIT OP POSSESSION
1. Plaintiff Robert M. Newbury, is an adult individual
residing at 305 South 32nd Street, Camp Hill, Cumberland County,
I.mnsylvania, 17011.
2. Defendants, Edward and Melissa Hinton, a/k/a Hindon,
currently reside at property located at 2100 Cedar Run Drive, Unit
204, Camp Hill, Cumberland County, Pennsylvania, 17011.
3. On May 10, 1990, Plaintiff leased the premises at 2100
Cedar Run Drive, Unit 204, Camp Hill, Cumbrland County,
Pennsylvania, to Defendant under a residential lease agreement, a
copy of which is attached hereto as Exhibit "A".
4. The lease between parties had been renewed, pursuant to
the agreement, for the last four calendar years.
5. The lease provided for a term of one year, at a monthly
rental obligation of $500.00 dollars payable in advance on the
first day of every month.
6. Due to the failure of the Defendants to make rental
payments according to the agreement, Plaintiff was forced to bring
proceedings against her at District Justice Clement's office on
June 14, 1994.
Such proceedings resulted in a judgment for
to
possession in favor of the Plaintiff, a copy of which is attached
hereto as Exhibit "B".
7 . On August 18, 1994, Defendants appealed from District
Judgment Clement's Judgment. A copy of the notice of appeal and
rule to file complaint served on Plaintiff is attached hereto,
marked as Exhibit "C", and incorporated herein by reference.
8. Pursuant to Pa.R.C.P.J.P. 1008(B), as implemented by
Cumberland County Local Rule No. 357, Defendants were required to
either post bond or file an application with this Court for leave
to deposit rent into escrow pending the outcome of the appeal.
9. As of the date of filing this petition, no bond has been
posted and no application for leave to deposit rent into escrow has
been made.
10. As Defendant is in violation of Pa.R.C.P.J.P 1008(b), as
implemented by Cumberland County Local Rule No. 357, requiring the
posting of a bond or payments into escrow, Defendants are no longer
entitled to possession.
WHEREF.ORE, the Plaintiff respectfully requests that a Writ of
Possession be ordered authorizing the Sheriff to deliver actual
possession of the property located at 2100 Cedar Run Drive, Unit
204, Camp Hill, to the Plaintiff by evicting the Defendants and any
other occupants.

ADDENDUM CONTAINING ADDITIONAL TERMS ANO CONDITIONS
FOR lEASE OF APARTf1ENT 204. 2100 CEDAR RUN DRIVE
Notwithstanding anything to the contrary contained In the basic lease to
which this Addendum Is attached, the parties to said Apartment lease Agreement
do hereby acknowledge and agree that the following terms and conditions shall form
a part of said Apartment lease:
I. Tenant shall deposit with Lessor upon the signing of this Agreement a
security deposit of $495.00. Said security deposit shall be refunded to tenant
at the expiration of the lease If all financial obligations of the Lease are then
satisfied in full and If said security deposit Is not otherwise needed for the
purpose of enabling Lessor to repair any damages which have occurred to the
leased premises, which damages have not been the result of negligence or misconduct
by Lessor, during the term of the exclusive occupancy of the leased premises by
Tenant. In addition, all rugs having been cleaned prior to the apartment being
leased, must be cleaned before Tenant leaves at the end of said lease or such costs
to do so shall be taken from the Security Deposit.
2. In the event that Tenant desires to terminate the Lease during the
original term or any renewal, Tenant shall be required to give notice of intended
termination to Lessor at least two months prior to the selected date of termination'
so that Lessor will have adequate time within which to seek replacement Tenants.
Nothing herein shall be construed to relieve Tenant of the obligation to continue
to comply with the terms and conditions of this Lease or to continue to pay rent
through the end of the month of termination of the Lease.
3. Notwithstanding the renewal provisions contained In the basic Lease, If
either party desires that this Lease not be renewed at the end of the original
term, or any renewal thereof, the party desiring not to renew the Lease for an
additional term shall give written notice of such intention to the other party of
such intention at least two calendar months prior to the termination date of the
lease, or any renewal termination date.
4. Rental payments hereunder are due on the first day of each month during
the term. A grace period of three days shall apply but, failure to pay rental by
the end of the third day of the month when rental is due shall result in the
imposition of a late charge, retroactive back to the first day of said month, at
the rate of $5.00 per day for each day beyond the date when the rental payment was
due.

5. Lessor shall have the right to enter the leased prcmis1S at any timc
during the term of this Lease for the purpose of making an inspection of the
leased premises; however, Lessor shall not enter the premises at a time when
Tenant Is not present, shall give the Tenant at least 48 hours advance notice
of his Inspection visit, and shall not make such Inspection visit after the
hours of 10:00 p.m. or prior to 7:00 a.m. on any day.
6. Tenant shall make no alterations or additions to the lease premises,
shall change no fixtures or appliances, and shall engage In no painting of the
leased premises without the prior written consent of Lessor. If any repairs shall
be required to the leased premises, Tenant shall give prompt notice of such need
for repairs to Lessor in writing.
The parties hereby agree that the aforegoing Addendum shall constitute an
Integral part of the attached Apartment Lease.

COMPLAINT
1. Plaintiff, Robert M. Newbury, is an adult individual
residing at 305 South 32nd Street, Camp Hill, Cumberland County,
Pennsylvania, 17011.
2. Defendants, Edward and Melissa Hinton, a/k/a Hindon,
currently reside at property located at 2100 Cedar Run Drive, Unit
204, Camp Hill, Cumberland County, Pennsylvania, 17011.
3. Plaintiff is the equitable owner of property located at
2100 Cedar Run Drive, Unit 204, Camp Hill, Pennsylvania pursuant to
an Installment Sales Agreement entered into on March 14, 1984. A
copy of the Articles of Agreement are attached hereto, marked as
Exhibit "A", and incorporated herein by reference.
4. On May 10, 1990, Plaintiff leased the premises at 2100
Cedar Run Drive, Unit 204, Camp Hill, Pennsylvania, to Defendants
pursuant to a Residential Lease Agreement.
The leased premises
are more specifically described on Exhibit "B", which is attached
hereto and incorporated herein by references.
5. The Lease between parties had a starting date of May 17,
1990 and a termination date of May 16, 1991. A true and correct
copy of this Lease is attached hereto, marked as Exhibit "CO, and
incorporated herein by reference.
6 . Paragraph nine (9) of the agreement between parties
provides for automatic renewal of the lease on a year to year basis
in the absence of notice to surrender.
7. The Lease has been renewed pursuant to this renewal
clause for the last three calendar years. Prior to the end of the
last lease term, the landlord gave notice to terminate, which has
been ignored by the defendants in this action.
8. The monthly rental payments owing over the last renewed
term of the Lease were $500.00 dollars, plus a $5.00 dollar late
fee for every day this payment is late following a three day grace
period.
9. Defendants are in default under the terms of the Lease, by
reason of failing to pay the agreed upon monthly rental payments
and late charges since March of this year.
10. Defendants are in default under the terms of the Lease, by
reason of failing to vacate the leased premises following notice by
landlord as required by Paragraph nine (9) of the Lease.
11. Plaintiff successfully obtained a judgment against the
defendants for both money damages and possession before District
Justice Charles Clement. Following appeal to this honorable court,
defendants have faile" to either post bond or file an application
with this court for leave to deposit rent into escrow as required
by Pa. R.C.P.D.J. No. 1008(B) as implemented by Cumberland County
Local Rule No. 357.
.cOUNT I - EJECTMENT
12. Paragraphs 1 through 11 are hereby incorporated as though
set forth in full.
13. Plaintiff has made numerous demands on Defendants to cure
default under the Lease or vacate the premises.
14. The Defendants have wilfully refused to vacate the
premises and return possession to Plaintiff's after proper notice
and continue to occupy the same.
15. Plaintiff is entitled to actual possession of the leased
premises.
16. Paragraph 14. B. of the Lease authorizes Plaintiff to
confess judgment against Defendants for possession of the leased
premises. Pursuant to this authority, Plaintiff is entitled to
immediate confession of judgment in ejectment for possession of the
leased property.
17. Plaintiff has not previously confessed judgment against
Defendant under the Lease in any jurisdiction.
WHEREFORE, Plaintiff demands judgment against Defendants in
ejectment. Plaintiff requests this honorable Court issue a writ of
possession and instruct to the Sheriff to deliver actual possession
to the Plaintiff by evicting Defendants and any others currently
occupying the premises.

Count II - Monetarv Damaqes
18. Paragraphs 1 through 17 are hereby incorporated as though
set forth in full.
19. Plaintiff has made numerous demands on Defendants to cure
default under the Lease by paying all back rents and delinquent
charges.
20. The Defendants have wilfully refused to make rental
payments owing as agreed by the parties despite numerous demands
and notice to do so.
21. The last partial payment made by defendants was on June
10, 1994 in an amount of $175.00 dollars. Specifically, the
following rents, excluding late charges, are grossly delinquent:
(a) March/1994 - Rent $500; Rent paid $400; Due.......$100.00
(b) April/1994 - Rent $500; Rent paid -0-; Due... .... .$500.00
(c) May/1994 - Rent $500; Rent paid $200; Due.... .... .$300.00
(d) June/1994 - Rent $500; Rent paid $175.00; Due.....$325.00
(e) July/1994 - Rent $500; Rent paid -0-; Due.........$500.00
(f) August/1994 - Rent $500; Rent paid -0-; Due.. .....$500.00
(g) September/1994 - Rent $500; Rent paid -0-; Due... .S500.00
Total Due $2,725.00
22. The addendum to the Residential Lease Agreement, which is
part of and attached to Exhibit "A", provides for the imposition of
a late charge in the amount of $5.00 dollars per day for late rent.

23. The total unpaid late charges owing Plaintiffs from
delinquent payments beginning in August of 1991 through to
September 5, 1994, are in an amount of $4,335.00 dollars.
24. paragraph 14. B. of the Lease authorizes Plaintiff to
confess judgment against Defendants for money damages and back rent
owing under the terms of the lease. Pursuant to this authority,
Plaintiff is entitled to immediate confession of judgment in
ejectment for all monetary relief sought.
25. Plaintiff has not previously confessed judgment against
Defendant under the Lease in any jurisdiction.
WHEREFORE, Plaintiff demands judgment against the Defendants
in a total amount of $6,565.00 dollars, which represents the
delinquent back rents of $2,725.00, late charges of $4,335.00,
minus the security deposit $495.00, plus interest and costs of this
suit.

Buyer shall pay taxes levied by Lower Allen Township,
Cumberland County, and I~est Shore School District on the property herein
sold from and after the date hereof. Payment shall be made to Seller as
trustee for Buyer during such time as Seller remains obligated to main-
tain an escrow account for such taxes '~ith Cumberland Valley Savings and
Loan Asscciation. Seller shall furnish receipts to Buyer. Payment of
such taxes by Buyer shall be made in all cases prior to the imposition
of penalty.
5. INSURANCE. Buyer's interest in the structure shall be insured
by the policies of fire and other insurance carried by the Unit Owners'
Association on the property. Buyer shall receive a certificate of such
insurance.
6. ASSESSMENTS. Buyer shall as a condition of this Agreement, pay
the required monthly assessment to the Unit Owners' Association. Such
assessment shall be in the amount of $55.06 until changed by the Unit
Owners' Association. Sellers will receive and hold the first month's
assessment paid on the date hereof, and any future monthly assessment
prior to completion of the organization of the Unit Owners' Association,
as trustee for Buyer and the Association.

7. POSSESSION. Possession shall be delivered to Buyer on the date
hereof.
9. TITLE. On payment of the purchase price, Sellers shall convey
to Buyer marketable fee simple title to the premises by deed bearing
their general warranty, subject only to existing restrictions and utility
easements and any encumbrance arising after the date hereof for which
Buyer is responsible.

be paid one-half by Buyer and and one-half by Sellers.
ll. COVENANT TO MAINTAIN. So long as any part of the purchase price
remains unpaid, Buyer shall maintain the premises in as good condition as
at present, normal wear and tear excepted, and shall permit Sellers or
their authorized representative to inspect the premises at reasonable
times and on reasonable notice to observe Buyer's compliance with this

Buyer shall comply with all tho rules and regulations of
the Owners' Association and shall do nothing in the premises which shall
violate state or municipal law or ordinance or constitute legal nuisance.

14. DEFAULT. In the event of Buyer's failure to pay any installment
of principal and interest within ten (10) days of the date when due, or
Buyer's failure to pay any tax or agreed payment on account of tax prior
to the penalty period, or to pay the monthly assessment to the Unit
Owners' Association, or to allow to remain uncured any other breach hereo

as amended, but not more often than required by said Law.
l6. CONFESSIONS OF JUDGfoIENT. After default, remaining uncured
after notice as aforesaid, Buyer authorizes any attorney of a court of
record in Pennsylvania, or the Prothonotary, to appear for Buyer and
confess judgment against Buyer for the whole of the principal sum due
hereunder remaining unpaid, together with any taxes, assessments or
interest due by Buyer, with five percent (5%) attorney's commission or
fees, with all costs, waiving error and appeal, and authorizes the imme-
diate issuance of a writ of execution thereon in accordance with the
Pennsylvania Rules of Civil Procedure. Or the Sellers may, at their
election, in such event, proceed by action in ejectment for possessionl

ADDENDUM CONTWllUG ADDITIONAL TERMS AND CONDITIONS
FOR LEASE OF APARTHENT 204, 2100 CEDAR RUN DRIVE
Notwithstanding anything to the contrary contained in the basic lease to
which thIs Addendum is attached, the parties to said Apartment Lease Agreement
do hereby acknowledge and agree that the following terms and conditions shall form
a part of said Apartment Lease:
I. Tenant shall deposit with Lessor upon the signing of this Agreement a
security deposit of $495.00. Said security deposit shall be refunded to tenant
at the expiration of the Lease if all financial obligations of the Lease are then
satisfied in full and if said security deposit is not otherwise needed for the
purpose of enabling Lessor to repair any damages which have occurred to the
leased premises, which damages have not been the result of negligence or misconduct
by Lessor, during the term of the exclusive occupancy of the leased premises by
Tenant. In addition, all rugs having been cleaned prior to the apartment being
leased, must be cleaned before Tenant leaves at the end of said lease or such costs
to do so shall be taken from the Security Deposit.
2. In the event that Tenant desires to terminate the Lease during the
original term or any renewal. Tenant shall be required to give notice of intended
termination to Lessor at least two months prior to the selected date of termination
so that Lessor will have adequate time within which to seek replacement Tenants.
Nothing herein shall be construed to relieve Tenant of the obligation to continue
to comply with the terms and conditions of this Lease or to continue to pay rent
through the end of the month of termination of the Lease.
3. Notwithstanding the renewal provisions contained in the basic Lease. if
either party desires that this Lease not be renewed at the end of the original
term, or any renewal thereof, the party desiring not to renew the Lease for an
additional term shall give written notice of such intention to the other party of
such intention at least two calendar months prior to the termination date of the
lease, or any renewal termination date.
4. Rental payments hereunder are due on the first day of each month during
the term. A grace period of three days shall apply but, failure to pay rental by
the end of the third day of the month when rental is due shall result in the
imposition of a late charge, retroactive ~ack to the first day of said month, at
the rate of $5.00 per day for each day beyond :he date when the rental payment was
due.
5. Lessor shall have the right; to enter the lea5ed premis~s at any time
during the term of thl s Lease felt' thr rurpo~e of making an inspection of the
leased premises; however, Lessor shall not enter the premises at a time when
Tenant is not present, shall give the Tenant at least 48 hours advance notice
of his inspection visit, and shall not make such inspection visit after the
hours of 10:00 p.m. or prior to 7:00 a.m. on any day.
6. Tenant shall make no alterations or additions to the lease premises,
shall change no fixtures or appliances, and shall engage in no painting of the
leased premises without the prior written consent of Lessor. If any repairs shall
be required to the leased premises, Tenant shall give prompt notice of such need
for repairs to Lessor in writing.
The parties hereby agree that thE aforegoing Addendum shall constitute an
integral part of the attached Apartment Lease.

AND NOW, comes Robert M. Newbury, Plaintiff in the within
matter, by his attorney, Carl G. Wass, Esquire, Caldwell & Kearns,
P.C., who respectfully prays Your Honorable Court to terminate the
supersedeas heretofore entered by the Prothonotary in the within
case, and, in support thereof, sets forth the following:
1. Pursuant to the filing of a Landlord/Tenant Complaint
before District Justice Charles A. Clement, Jr., and following
hearing thereon, judgment was rendered by the aforesaid District
Justice in favor of the Plaintiff and against the Defendants for:
(1) money judgment in the sum of $4,036.00, and (2) the granting of
possession of the leased premises to Plaintiff at 2100 Cedar Run
Drive, Unit 204, Camp Hill, Pennsylvania.
judgment was entered on July 20, 1994.
2. On August 18, 1994, the Defendants filed with the

Prothonotary of Cumberland County a "Notice of Appeal From District
Justice JUdgment."
3. On or about August 18, 1994, the Defendants, pursuant to
CUmberland County Rule of Civil Procedure No. 357, paid to the
Prothonotary of CUmberland County the sum of $500.00 for the rent
for August, 1994, and secured, thereby, a supersedeas as to the
judgment for possession of the leased premises.
4. On September 7, 1994, Plaintiff filed his Complaint in the
within case and caused a copy of the same to be served upon Keith
B. DeArmond, Esquire, attorney for the Defendants. At the same
time, notification was provided to counsel for the Defendants that
the September rental for the leased premises had not been deposited
with the Prothonotary as required by Cumberland County R.C.P. 357
and that, unless the required rental payment was paid to the
prothonotary by September 21, 1994, the within application to
terminate supersedeas would be filed. A copy of the aforementioned
notification, dated September 14, 1994, is attached hereto,
identified as Exhibit A, and incorporated herein by reference.
5. The required monthly rental payment for the leased
premises, in the sum of $495.00 per month is required to be paid on
or before the first day of each month in accordance with the lease
agreement, Exhibit C of Plaintiff's Complaint.
6. Upon the date of the filing of the within Application, the
required rental payment for the month of September, 1994, has not
been paid.

WHEREFORE, Plaintiff prays, pursuant to Cumberland County Rule
of Civil Procedure No. 357(3) that Your Honorable Court terminate
the supersedeas heretofore entered in the within case.

Dear Mr. DeArmond:
On behalf of our client, Robert M. Newbury, we have filed a
Complaint at Cumberland County Civil Action No, 94-4653. A true
copy of tl1at Complaint is enclosed with this letter and hereby
served upon you.
I also draw to your attention the fact that, at the request of my
client, I will be presenting a petition to have the automatic
supersedeas terminated for failure to comply with Cumberland County
Rule of Civil Procedure No. 357. The initial rental payment for
August was deposited with the Prothonotary. However, under the
terms of the Lease Addendum dated May 10, 1990 (Exhibit C of
Complaint), the rental payments are due on the first day of each
month, and the rental payment due for September has not been
deposited with the Cumberland County Prothonotary. Under the Lease
Addendum, the rental of $495 per month must be paid by the third
day of each month, otherwise, a penalty of $5 per day shall be
applied retroactive to the first day of that month. As I draft
this letter, it is September 14. The total sum required to be
deposited with the Prothonotary today is $565. Until this figure
is paid to the Prothonotary, your client will have to add $5 per
day, from September 14, until the sum of money is in the hands of
the Prothonotary. Then, of course, October 1 is fast approaching
and another payment of rental into escrow to the Prothonotary must
occur.
I want you to know that my client is most insistent that your
clients remove themselves from the property. My client has
instructed me to check regularly with the Prothonotary to make sure
that the escrow payments are being made and are up to date at all

times. I will check the dockets on September 21 and, if the
September rental payment has not been made, I will file my petition
to terminate the supersedeas. You may also inform your clients
that, if they do make the September payment, they will have to
continue to make each monthly payment thereafter, timely, since, on
or about the third day of each month, we will be checking the
Prothonotary's docket (because of our client's insistence in this
matter) .

Dear Mr. DeArmond:
As indicated to you in my prior letter of September 14, 1994, my
client is persistent in his insistence that your clients must
maintain their financial responsibility, even though an appeal from
the District Justice judgment has been taken to Cumberland County
Court of Common Pleas. The September rent was not paid as of the
date of my letter to you of September 14. We checked the docket on
September 22 and discovered that the September payment had not been
made. Consequently, we did file our Application To Terminate
Supersedeas. Judge Bayley has issued a Rule To Show Cause,
returnable five days after service, upon our Application To
Terminate. Enclosed herewith is a copy of our Application, and a
copy of Judge Bayley's Order of September 22, 1994.
Since I suspect you may be out of the country when this letter
reaches your office, I have taken the liberty of forwarding a copy
of the Application and Order directly to your clients so that they
are certain to know that the issue of depositing the rental
