EDWARD HINTON a/k/a HINCON, and MELISSA HINTON, a/k/a HINCON, husband and wife, Defendants APPEAL FROM D.J. JUDGMENT PETITION POR WRIT OP POSSESSION 1. Plaintiff Robert M. Newbury, is an adult individual residing at 305 South 32nd Street, Camp Hill, Cumberland County, I.mnsylvania, 17011. 2. Defendants, Edward and Melissa Hinton, a/k/a Hindon, currently reside at property located at 2100 Cedar Run Drive, Unit 204, Camp Hill, Cumberland County, Pennsylvania, 17011. 3. On May 10, 1990, Plaintiff leased the premises at 2100 Cedar Run Drive, Unit 204, Camp Hill, Cumbrland County, Pennsylvania, to Defendant under a residential lease agreement, a copy of which is attached hereto as Exhibit "A". 4. The lease between parties had been renewed, pursuant to the agreement, for the last four calendar years. 5. The lease provided for a term of one year, at a monthly rental obligation of $500.00 dollars payable in advance on the first day of every month. 6. Due to the failure of the Defendants to make rental payments according to the agreement, Plaintiff was forced to bring proceedings against her at District Justice Clement's office on June 14, 1994. Such proceedings resulted in a judgment for to possession in favor of the Plaintiff, a copy of which is attached hereto as Exhibit "B". 7 . On August 18, 1994, Defendants appealed from District Judgment Clement's Judgment. A copy of the notice of appeal and rule to file complaint served on Plaintiff is attached hereto, marked as Exhibit "C", and incorporated herein by reference. 8. Pursuant to Pa.R.C.P.J.P. 1008(B), as implemented by Cumberland County Local Rule No. 357, Defendants were required to either post bond or file an application with this Court for leave to deposit rent into escrow pending the outcome of the appeal. 9. As of the date of filing this petition, no bond has been posted and no application for leave to deposit rent into escrow has been made. 10. As Defendant is in violation of Pa.R.C.P.J.P 1008(b), as implemented by Cumberland County Local Rule No. 357, requiring the posting of a bond or payments into escrow, Defendants are no longer entitled to possession. WHEREF.ORE, the Plaintiff respectfully requests that a Writ of Possession be ordered authorizing the Sheriff to deliver actual possession of the property located at 2100 Cedar Run Drive, Unit 204, Camp Hill, to the Plaintiff by evicting the Defendants and any other occupants. '--- ADDENDUM CONTAINING ADDITIONAL TERMS ANO CONDITIONS FOR lEASE OF APARTf1ENT 204. 2100 CEDAR RUN DRIVE Notwithstanding anything to the contrary contained In the basic lease to which this Addendum Is attached, the parties to said Apartment lease Agreement do hereby acknowledge and agree that the following terms and conditions shall form a part of said Apartment lease: I. Tenant shall deposit with Lessor upon the signing of this Agreement a security deposit of $495.00. Said security deposit shall be refunded to tenant at the expiration of the lease If all financial obligations of the Lease are then satisfied in full and If said security deposit Is not otherwise needed for the purpose of enabling Lessor to repair any damages which have occurred to the leased premises, which damages have not been the result of negligence or misconduct by Lessor, during the term of the exclusive occupancy of the leased premises by Tenant. In addition, all rugs having been cleaned prior to the apartment being leased, must be cleaned before Tenant leaves at the end of said lease or such costs to do so shall be taken from the Security Deposit. 2. In the event that Tenant desires to terminate the Lease during the original term or any renewal, Tenant shall be required to give notice of intended termination to Lessor at least two months prior to the selected date of termination' so that Lessor will have adequate time within which to seek replacement Tenants. Nothing herein shall be construed to relieve Tenant of the obligation to continue to comply with the terms and conditions of this Lease or to continue to pay rent through the end of the month of termination of the Lease. 3. Notwithstanding the renewal provisions contained In the basic Lease, If either party desires that this Lease not be renewed at the end of the original term, or any renewal thereof, the party desiring not to renew the Lease for an additional term shall give written notice of such intention to the other party of such intention at least two calendar months prior to the termination date of the lease, or any renewal termination date. 4. Rental payments hereunder are due on the first day of each month during the term. A grace period of three days shall apply but, failure to pay rental by the end of the third day of the month when rental is due shall result in the imposition of a late charge, retroactive back to the first day of said month, at the rate of $5.00 per day for each day beyond the date when the rental payment was due. .- 5. Lessor shall have the right to enter the leased prcmis1S at any timc during the term of this Lease for the purpose of making an inspection of the leased premises; however, Lessor shall not enter the premises at a time when Tenant Is not present, shall give the Tenant at least 48 hours advance notice of his Inspection visit, and shall not make such Inspection visit after the hours of 10:00 p.m. or prior to 7:00 a.m. on any day. 6. Tenant shall make no alterations or additions to the lease premises, shall change no fixtures or appliances, and shall engage In no painting of the leased premises without the prior written consent of Lessor. If any repairs shall be required to the leased premises, Tenant shall give prompt notice of such need for repairs to Lessor in writing. The parties hereby agree that the aforegoing Addendum shall constitute an Integral part of the attached Apartment Lease. NEWBURY, Plaintiff . . EDWARD HINTON, a/k/a HINDON, and MELISSA HINTON, a/k/a HINDON, husband and wife, Defendants CIVIL ACTION - LAW COMPLAINT 1. Plaintiff, Robert M. Newbury, is an adult individual residing at 305 South 32nd Street, Camp Hill, Cumberland County, Pennsylvania, 17011. 2. Defendants, Edward and Melissa Hinton, a/k/a Hindon, currently reside at property located at 2100 Cedar Run Drive, Unit 204, Camp Hill, Cumberland County, Pennsylvania, 17011. 3. Plaintiff is the equitable owner of property located at 2100 Cedar Run Drive, Unit 204, Camp Hill, Pennsylvania pursuant to an Installment Sales Agreement entered into on March 14, 1984. A copy of the Articles of Agreement are attached hereto, marked as Exhibit "A", and incorporated herein by reference. 4. On May 10, 1990, Plaintiff leased the premises at 2100 Cedar Run Drive, Unit 204, Camp Hill, Pennsylvania, to Defendants pursuant to a Residential Lease Agreement. The leased premises are more specifically described on Exhibit "B", which is attached hereto and incorporated herein by references. 5. The Lease between parties had a starting date of May 17, 1990 and a termination date of May 16, 1991. A true and correct copy of this Lease is attached hereto, marked as Exhibit "CO, and incorporated herein by reference. 6 . Paragraph nine (9) of the agreement between parties provides for automatic renewal of the lease on a year to year basis in the absence of notice to surrender. 7. The Lease has been renewed pursuant to this renewal clause for the last three calendar years. Prior to the end of the last lease term, the landlord gave notice to terminate, which has been ignored by the defendants in this action. 8. The monthly rental payments owing over the last renewed term of the Lease were $500.00 dollars, plus a $5.00 dollar late fee for every day this payment is late following a three day grace period. 9. Defendants are in default under the terms of the Lease, by reason of failing to pay the agreed upon monthly rental payments and late charges since March of this year. 10. Defendants are in default under the terms of the Lease, by reason of failing to vacate the leased premises following notice by landlord as required by Paragraph nine (9) of the Lease. 11. Plaintiff successfully obtained a judgment against the defendants for both money damages and possession before District Justice Charles Clement. Following appeal to this honorable court, defendants have faile" to either post bond or file an application with this court for leave to deposit rent into escrow as required by Pa. R.C.P.D.J. No. 1008(B) as implemented by Cumberland County Local Rule No. 357. .cOUNT I - EJECTMENT 12. Paragraphs 1 through 11 are hereby incorporated as though set forth in full. 13. Plaintiff has made numerous demands on Defendants to cure default under the Lease or vacate the premises. 14. The Defendants have wilfully refused to vacate the premises and return possession to Plaintiff's after proper notice and continue to occupy the same. 15. Plaintiff is entitled to actual possession of the leased premises. 16. Paragraph 14. B. of the Lease authorizes Plaintiff to confess judgment against Defendants for possession of the leased premises. Pursuant to this authority, Plaintiff is entitled to immediate confession of judgment in ejectment for possession of the leased property. 17. Plaintiff has not previously confessed judgment against Defendant under the Lease in any jurisdiction. WHEREFORE, Plaintiff demands judgment against Defendants in ejectment. Plaintiff requests this honorable Court issue a writ of possession and instruct to the Sheriff to deliver actual possession to the Plaintiff by evicting Defendants and any others currently occupying the premises. Plaintiff has made numerous demands on Defendants to cure default under the Lease by paying all back rents and delinquent charges. 20. The Defendants have wilfully refused to make rental payments owing as agreed by the parties despite numerous demands and notice to do so. 21. The last partial payment made by defendants was on June 10, 1994 in an amount of $175.00 dollars. The addendum to the Residential Lease Agreement, which is part of and attached to Exhibit "A", provides for the imposition of a late charge in the amount of $5.00 dollars per day for late rent. {, 23. The total unpaid late charges owing Plaintiffs from delinquent payments beginning in August of 1991 through to September 5, 1994, are in an amount of $4,335.00 dollars. 24. paragraph 14. B. of the Lease authorizes Plaintiff to confess judgment against Defendants for money damages and back rent owing under the terms of the lease. Pursuant to this authority, Plaintiff is entitled to immediate confession of judgment in ejectment for all monetary relief sought. 25. Tenant shall deposit with Lessor upon the signing of this Agreement a security deposit of $495.00. Said security deposit shall be refunded to tenant at the expiration of the Lease if all financial obligations of the Lease are then satisfied in full and if said security deposit is not otherwise needed for the purpose of enabling Lessor to repair any damages which have occurred to the leased premises, which damages have not been the result of negligence or misconduct by Lessor, during the term of the exclusive occupancy of the leased premises by Tenant. In addition, all rugs having been cleaned prior to the apartment being leased, must be cleaned before Tenant leaves at the end of said lease or such costs to do so shall be taken from the Security Deposit. 2. In the event that Tenant desires to terminate the Lease during the original term or any renewal. Tenant shall be required to give notice of intended termination to Lessor at least two months prior to the selected date of termination so that Lessor will have adequate time within which to seek replacement Tenants. Nothing herein shall be construed to relieve Tenant of the obligation to continue to comply with the terms and conditions of this Lease or to continue to pay rent through the end of the month of termination of the Lease. 3. Notwithstanding the renewal provisions contained in the basic Lease. if either party desires that this Lease not be renewed at the end of the original term, or any renewal thereof, the party desiring not to renew the Lease for an additional term shall give written notice of such intention to the other party of such intention at least two calendar months prior to the termination date of the lease, or any renewal termination date. 4. Rental payments hereunder are due on the first day of each month during the term. A grace period of three days shall apply but, failure to pay rental by the end of the third day of the month when rental is due shall result in the imposition of a late charge, retroactive ~ack to the first day of said month, at the rate of $5.00 per day for each day beyond :he date when the rental payment was due. 5.
