COMPLAINT
AND NOW comes the Plaintiff, the Patriot News Company, by
the attorneys Caldwell << Kearns, and states the following:
COUNT I
1. The Plaintiff, The Patriot News Company, is a
Pennsylvania corporation with a principal place of business at
812 Market Street, Harrisburg, Dauphin County, Pennsylvania
17105.
2. Defendant, The Mattress Factory Direct, is a
Pennsylvania corporation with a principal place of business at
860 Wesley Drive, Mechanicsburg, Cumberland County, Pennsylvania
17055.
3. From April 14, 1994 through August 4, 1994, Defendant
entered into various agreements with representatives of the
Patriot News Company for advertising services within The Patriot
and Evening News. (A copy of records evidencing these agreements
is attached as Bxhibit "A" and incorporated herein by reference
thereto)
5. The various agreements were as a result of a contract
entered into between the Plaintiff and Defendant which is set
forth as Bxhibit liB" and incorporated herein by reference
thereto.
6. As a result of the various agreements, an invoice was
sent to the Defendant with a balance due in the amount of
$20,995.31. (A copy of said invoice is attached as Bxhibit "CO
and incorporated herein by reference thereto.)
7. The Defendant has not made any payments on this
obligation.
8. After repeated demands for payment, the bill still
remains unpaid.
9. The failure to pay the balance represents an unjust
enrichment on the part of the Defendant.
WHBREFORE, Plaintiff, requests judgment against Defendant in
the amount of $20,995.31 plus interest and costs.

9. The averments contained in paragraphs 1 through 9 of
Count I of Plaintiff's Complaint are incorporated herein by
reference thereto.
10. Plaintiff on various dates did submit to Defendant
various statements of the balance owed on said obligations and
Defendant did fail to object to such statements or respond in any
contrary manner. (A copy of said statements are attached as
Exhibit "CO and incorporated herein by reference thereto)
11. The account, therefore, became an account stated.
WHEREFORE, the Plaintiff, demands judgment against Defendant
in the amount of $20,995.31 plus interest and costs of suit.
