RODADEK, Plaintiff IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NO. 4735 CIVIL TERM VS. MARGARET MITCHELL, Dsfendant COMPLAINT AND NOW, Frank Kodadek, by and through his attorney, Fred H. Hait, Esquire, makes the following complaint and avers as folloWSl STATEMENT OF FACTS 1. Plaintiff, Frank Kodadek, is an adult individual whose address is Box 35, Quicksburg, Virginia 22847. 2. Defendant, Margaret Mitchell, is an adult individual residing at 554 First street, CarliSle, Pennsylvania 17013. 3. On or about September 28, 1993, Plaintiff and Defendant entered into a written Agreement of Sale for property located at 570 Opossum Lake Road and an adjoining lot located in Carlisle, Cumberland County, Pennsylvania (A true and cox'rect copy of the Agreement of Sale is attached as Exhibit "A"). 4. In consideration for the Sales Agreement, Plaintiff paid to Defendant a down payment of One Thousand Dollars ($1,000.00). 5. The above-referenced Agreement of Sale was subject to a mortgage addendum which specified the terms of the mortgage required by the buyer. (A true and correct copy of the mortgage addendum attached as Exhibit "B"). The Sales Agreement was contingent upon Plaintiff being able to obtain such a mortgage. 6. Plaintiff complied with the terms of the mortgag_ addendum and made a completed written mortgage application to a mort~ag. lending institution through the sub-agent of the seller, ERA Garman Realty. 7. The mortgage application was made to Banc Plus Mortgage Corp., a lending institution with a business office located at 3 Crossgates Drive, Second Floor, Mechanicsburg, PA 17055. 8. Banc Plus Mortgage Corp. rejected Mr. Kod~dek's mortgage application. (A true and correct copy of the Adverse Action notification from Banc Plus is attached as Exhibit "C"). Thus resulting in failure of the mortgage contingency provision of the Agreement for Sale. 9. The parties did not settle on or before November 30, 1993, the date specified on the Sales Agreement because of the mortgage rejection. 10. Plaintiff has demanded a written termination of the Sales Agreement and a refund of his deposit money. 11. Defendant has refused to execute a written termination of the Sales Agreement and likewise refuses to return Plaintiff's deposit money. COUNT I BREACH or CONTRACT 12. Plaintiff hereby incorporates Paragraphs 1 - 11 as if fully set forth herein. 13. Plaintiff has performed his promise and made a good faith mortgage application with the assistance of seller's sub- agent. 14. In Pennsylvania, a buyer need only make one mortgage application where the mortgage contingency clause requires the buyer to make ". completed mortgage application." Ormond v. Kinni., 341 Pa. Super. 101, 491 A.2d 169 (1985) (emphasis added). 17. Plaintiff has complied with all of his contractual and legal duties with regard to his attempt to purchase the property at 570 Opossum Lake Road, CarliSle, Pennsylvania. 18. Defendant has breached the Sales Agreement by failing to act in good faith and execute a written termination of the Sales Agreement within a reasonable amount of time after the rejection of Plaintiff's loan application by Banc Plus. (See Exhibit "B", Paragraph 3). DEMAND FOR RELIEF 19.
