MARITAL SETTLEMENT AGREEMENT
This AGREEMENT made this _.:!JA_ day of

between Robert F. O'Bnen (Husband) and Margaret A. O'Bnen (Wife),
at Mechanicsburg, pennsylvania.
WITNESSETH:
Whereas, the parties hereto are Husband and wife, having been
married on January 23, 1980 in carlisle, pennsylvania.
whereas, difficulties have arisen between the parties and it is
their intention to live separate and apart, and the parties are
desirous of settling completely the economic and other rights and
obligations between each other includlng, without limitation: the
ownership and equitable distributlon of marltal property, the past,
present and future support, alimony, alimony pendente lite and/or
maintenance of either of them, payment of counsel fees and in
general, any and all claims and possible claims by one against the
other or against their respective estates and to accept the
provisions of this Agreement in lleu of and in full settlement and
satisfaction of all such rights and claims.
NOW, THEREFORE, Husband and wife, in consideration of the above
recitals and the following covenants and promised mutually made and
mutually to be kept, the parties heretofore, each intending to be
legally bound and to legally bind their heirs, successors and
assigns thereby covenant, promlse and agree as follows:

The terms of the Agreement shall be incorporated into any divorce
decree which may be entered with respect to the parties, but shall
not be merged into such decree. 'rhe Court of Common pi eas which
may enter such divorce decree shall re~ain contlnuing jurisdiction
over the parties and the subject matter of the Agreement for the
purpose of anforcement of any of the provislons thereof. 'rhis

be defined as the d<lte upon which it is executed by the partles if
they have each executed Agreement on the Bame date. ot,herwise. the
"date of execution" or "ellecutton date" of the Agreement shall be
defined as the date at ellecution by the part, last executing this
Agrftement.
5. UlarNlHUTlON OAT~:
Notwithstanding the date of execution ot this Agreement as
aforesaid and unless otherwise prOVided by a specific provision of
this Agreement. the transfer of property. funds and/or documents
provided for hereln shall only take place on the "distribution
date" which shall be defined as the tenth (lOth) day following the
entry of a final decree in dlvorce wlth respect to the parties.

Wife and Husband declare that each has had a full and fair
opportunity to obtain independent legal advice of counsel af their

Husband and wife shall not harass, disturb or malign each other or

Except as otherwise expressly provided by this Agreement:

forever discharges the other and the estate of the other from any
and all rights and obligations which either may have for past,
present or future support or maintenance, alimony pendente lite,

5, On September 16, 1994, the Honorable Kevin Hess signed an order directing Plaintiff
and Defendant to attend three marriage counseling sessions,
6, Defendant telephoned Plaintiff to discuss the marriage counseling issue and Plaintiff
was very resistant to the attendance of further marriage counseling.
7. Defendant contacted a marriage counselor, Rebecca Emerick of Another Perspective
Associates, who indicated that given the circumstances of this matter, further marriage
counseling would be futile.
