a horizontal furnace.
6. On July 2, 1992, Defendant Installed the system In question.
7. Defendant's proposal provided certain warranties, specifically guaranteeing
that all equipment Installed to be of a proper size and type for the purpose for which It Is to be
used and further guaranteeing all materials and workmanship against defects for a period of one
year from the date of Installation.
8. In April of 1993, Plaintiff was Interested In remodeling her house, and took
up a rug In an area that had been rewired by Defendant In the process of Installing the heating
and air conditioning system.
9. Plaintiff became concerned bocause the wiring for the system was placed
In a shallow trench gouged in the floor under the rug, and appeared to be done In a shoddy and
unsafe manner.
10. Plaintiff consequently contacted her brother, a certified plumber, who
Inspected the system and Informed her that the heating and air conditioning system and the
accompanying wiring was Installed in an Illegal manner, and constituted a fire hazard.
11. Plaintiff promptly contacted Defendant, AERO OIL COMPANY and asked
that her concerns be addressed and the situation remedied. To date, Defendant has refused
to take appropriate action to remedy the Illegal and unsafe Installation of the heating and air
conditioning system. Plaintiff contacted Defendant and complained about the heating and air

conditioning system within one year of the date of Installation, and In the alternative, Plaintiff and
her representatives contacted Defendant and complained about the problems with the heating
and air conditioning system within one year after Plaintiff reasonably discovered the problems
with her heating and air conditioning system.
12. Plaintiff paid Defendant the sum of Three Thousand Two Hundred Seventy-
six ($3,276.00) Dollars, In full consideration for the purchase and Installation of the heating and
air conditioning system In question.
13. Defendant's sale and Installation of the system In question was In breach of
the warranty provisions In its contract In that the equipment provided was not of the proper size
and type for the purpose for which it was to be used, and further that the Installation was not
performed In a good and workmanlike manner, for the following specific reasons:
A. The electrical circuit that connects the electrical system to the furnace
Is not identified on the electrical panel, contrary to national electric code standards.
B. The romex wiring Installed to connect the furna.::e to the electric
service is Installed In an unsafe manner in that the floor has been channeled just deeply enough
that the wire lies flush with the floor, barely under the surface of the carpet, and such Installation
Is contrary to the standards of the national elactrlc code in that it constitutes a potential fire
hazard.

C. The romex cable Installed In the basement area closesllo the furnace
Is also not Installed In a good and workmanlike manner, but In a hazardous menner contrery to
the nallonal electric code.
D. The smoke pipe for the furnace Is Installed improperly In that It should
have a raise of not less than one-quarter Inch per fool on a horlz<;lnlal run.
E. The clearances of the furnace are Insufficlenl for general safety, end
are not consistent with Ihe factory Installed lags displayed on Ihe inside of the furnace casing
next 10 the 011 burner, specifically:
i. The clearance above the supply air plenum is two and a
quarter Inches, although Ihe factory Installed tags require a clearance of three Inches above the
supply air plenum.
II. The clearance required from the side of the of the supply air
plenum is one and one-quarter Inch on bolh sides, allhough Ihe factory Installed tags require a
clearance on bolh sides of the supply air plenum of two inches.
iii. There is no clearance at all from the horizontal warm air duct,
although the factory installed tags require a one inch clearance from the horizontal warm air
duct.
F. There is insufficient insulation for safety installed in the areas around
the furnace.

G. The furnace flue, which passes directly below flexible fiberglass ducts
which have vinyl covering, has Insufficient clearances for the purpose of safety, both vertically
and horizontally.
H. The furnace flue Is constructed with three elbow fittings and with a
two Inch trap built Into the flue, which trap will not permit gasses to escape through a natural
draft.
I. The style and size of the furnace is Inappropriate to the limited height
In the basement of the home and the height of the chimney, resulting In a hazardous condition.
J. Although Plaintiff specifically requested a horizontal furnace,
Dafendant, In fact, Installed a vertical furnace, dangerous In the environment In which It was
Installed, without advising Plaintiff, either before or after Installation, that they had sold her a
heating and air conditioning system completely different from that which she contracted for and
reasonably believed was being Installed.
K. The furnace and air condition system in question is hazardous In that
It falls to comply with the BOCA National Mechanical COde/1993 Section M-405.1, due to Its
faulty Installation, resulting In major safety problems.
WHEREFORE, Plaintiff demands Judgment against Defendant for Its breach of
contract In the amount of Three Thousand Two Hundred Seventy-six ($3,276.00) Dollars, plus
costs and Interest from July 2, 1992, the date of the breach of the contract.

14. Plaintiff Incorporates herein by reference paragraphs 1 through 13.
15. The actions of Defendant as set forth above, constitute unfair and deceptive
acts or practices under the Unfair Trade Practices and Consumer Protection Law In the following
particulars:
A. Defendant represented that the system In question had characteristics
which it did not have, specifically, that the system in question was appropriate to be Installed In
Plaintiff's house, when, in fact, such Installation created B safety hazard.;
B. Defendant represented that the system In question was of a particular
style, standard, quality or grade, which it was not, specifically that the system In question wu
appropriate to be Installed In Plaintiff's home, when, in fact, such Installation created a safety
hazard.
C. Defendant failed to comply with the terms of the written warranty given
to the buyer both prior to and after the Installation of the system In question, specifically, in that
Defendant installed the system which it knew or should have known was contrary to Plaintiff',
desires and was not of the proper size and type for the purpose for which it was to be used, and
Defendant has failed to remedy said breach of warranty, In spite of requests by Plaintiff that it
honor its warranty.

WHEREFORE, Plaintiff demands Judgment against Defendant In the amount of Nine
Thousand Eight Hundred Eighty-eight ($9,888.00) Dollars, three times the actual damages
sustained, plus Court costs and Plaintiff's attorneys fees, and such additional relief as the Court

proposa I to furnish and ins ta II automatic hea ting equipment in
your home at 450 Barnstable Road, Carlisle, PA,
We propose to furnish and install a Rheem 011 fired
combination heating and cooling Upflow type forced warm air
furnace with a flame retention head burner at the above
mentioned location. We will remove your exiGting Firewell
furnace-burner units and dispose of same. The proposed new unit
will be equipped \;ith new plenums, both hot air as well as
return air. New plenum adapters will be installed and connected
to your existing duct work and registers. We will install :. new
cartridge in your exl.sting oil filter. We wil1 run a new copper
oil supply line fr"[tI your existIng oil storage tank to p': .lposed
new unit locatio". All new smoke pipe and draft regulalrc will
also be J.nstalled. We will take care of the entire insl~.illation
including wiring.

Air Conditioninq Installationl
We propose to furnish and install a Rheem RAHE-025JAS SUI""
Hi-Efficiency two ton outdoor condensing unit, with a Rhc<!1I1
RCTB-A024 cooling "A" coil. The proposed outdoor condensing
unit will be set on one (1) 2'x2'x2" concrete slab. We will
furnish and install a 20 AMP two pole Crouse Hind breaker. We
will also furnish and install a Cutler Hammer 60 AMP
weatherproof disconnect box to be located at the condensing
unit. We will furnish and install a new T87F M.H. thermostat
with a Q539A M.H. heating and cooling subbase. We will also
install a new insulated hot air plenum. We will take care of
the entire installation including wiring.

8. Denied. After reasonable investigation defendant is
without knowledge or information sufficient to form a belief
as to the truth of the averment.
9. Denied. It is admitted that a portion of the wiring
directed to the air conditioner was placed in a small trench
of approximately six (6) inches in length. However, it is
denied that the wiring was done in a shoddy and unworkmanlike
manner. As to why plaintiff became concerned, defendant is
without knowledge or information sufficient to form a belief
as to the truth of the averment and proof is demanded.
10. Denied. It is denied that the either system or its
related wiring were installed in a "illegal" or unsafe manner.
As to whether or not plaintiff contacted her brother,
defendant is without knowledge or information sufficient to
form a belief as to the truth of the averment and proof is
demanded.
11. Denied. It is admitted that plaintiff has contacted
defendant. However, with out admitting and liability or
responsibility, and in an effort to satisfy the customer,
defendant offered to place the wiring in piping and run the
same outside plaintiff's house. Furthermore, it is denied
that plaintiff contacted the defendant within the applicable
warranty period.

13. Denied. It is denied that the installation of
either the heating and air conditioning system was in
violation of the warranty, or that the systems were installed
in a less than good and workmanlike manner; furthermore, it is
denied:
a. that the failure to identify the circuit in the
electrical panel violates national electric codes,
or that the same violates the warranty;
b. that the romex wiring is installed in an unsafe
manner or constitutes a fire hazard;
c. that the romex cable installed closest to the
furnace was installed in a hazardous manner;
d. that the smoke pipe was installed improperly;
e. that the clearances are insufficient;
f. that there is insufficient insulatlon;
g. that the furnace flue has insufficient
clearances;
h. that the flue is constructed in such a way as
to trap gasses;
i. that the style of the furnace is inappropriate;
j. that defendant sold plaintiff a system
different from that she had contracted for or
believed was being installed; or,

k. that the system fails to comply with the BOCA
code, or that the system was installed in a faulty
manner.
WHEREFORE, defendant demands judgment in its favor and
against plaintiff with all costs of suit taxed against
plaintiff.
14. Defendants answers to paragraphs 1 through 13 are
incQrporated herein by reference as though fully set forth at
length.
15. Denied. Paragraph 15 constitutes a legal conclusion
to which no response is necessary. However, to the extent
that paragraph 15 sets forth any allegations not previously
addressed they are expressly denied. Specifically, defendant
denies that the system constitutes a safety hazard, that the
system violates the terms of the warranty, that the system
installed was contrary to plaintiff's desires, or that
defendant failed to comply with or honor its warranty.
WHEREFORE, defendant demands judgment in its favor and
against defendant with all costs of suit taxed against
plaintiff.
NEW MATTER
16. The proposal prnvided by defendant to plaintiff
states that it is an upright system. Furthermore, prior to
providing plaintiff with the proposal, defendant provided
plaintiff with specifications and a photograph of the furnace

6, On July 2, 1992, Defendant Installed the system In question,
7. Defendant's proposal provided certain warranties, specifically guaranteeing
that all equipment Installed to be of a proper size and type for the purpose for which It is to be
used and further guaranteeing all materials and workmanship against defects for a period of one
year from the date of Installation.
8, In April of 1993, Plaintiff was Interested In remodeling her house, and took
up a rug In an area that had been rewired by Defendant In the process of installing the heating
and air conditioning system,
9. Plaintiff became concerned because the wiring for the system was placed
In a shallow trench gouged In the floor under the rug, and appeared to be done In a shoddy and
unsafe manner.
10, Plaintiff consequently contacted her brother, a certified plumber, who
inspected the system and informed her that the heating and air conditioning system and the
accompanying wiring was Installed In an Illegal manner, and constituted a fire hazard.
11, Plaintiff promptly contacted Uefendant, AERO OIL COMPANY and asked
that her concerns be addressed and the situation remedied. To date, Defendant has refused
to take appropriate action to remedy the Illegal and unsafe Installation of the heating and air
conditioning system, Plaintiff contacted Defendant and complained about the heating and air
conditioning system within one year of the date of installation, and In the alternative, Plaintiff and
her representatives contacted Defendant and complained about the problems with the heating

and air conditioning system within one year after Plaintiff reasonably discovered the problems
with her heating and air conditioning system.
12, Plaintiff paid Defendant the sum of Three Thousand Two Hundred Seventy-
six ($3,276,00) Dollars, In full consideration for the purchase and installation of the heating and
air conditioning system In question,
13, Defendant's sale and Installation of the system In question was In breach of
the warranty provisions In Its contract In that the equipment provided was not of the proper size
and type for the purpose for which It was to be used, and further that the Installation was not
performed In a good and workmanlike manner, for the following specific reasons:
A. The electrical circuit that connects the electrical system to the furnace
is not Identified on the electrical panel, contrary to national electric code standards.
B. The romex wiring Installed to connect the furnace to the electric
service Is Installed in an unsafe manner In that the floor has been channeled Just deeply enough
that the wire lies flush with the floor, barely under the surface of the carpet, and such installation
Is contrary to the standards of the national electric code in that It constitutes a potential fire
hazard.
C, The romex cable Installed In the basement area closest to the furnace
Is also not installed in a good and workmanlike manner, but in a hazardous manner contrary to
the national electric code;

0, The smoke plpll for the furnace is Installed Improperly In that it should
have a raise of not less than one-quarter Inch per foot on a horizontal run,
E, The clearances of the furnace are Insufficient for general safety, and
are not consistent with the factory Installed tags displayed on the inside of the furnace casino
next to the 011 burner, specifically:
I. The clearance above the supply air plenum Is two and a
quarter inches, although the factory Installed tags require a clearance of three inches above the
supply air plenum,
II. The clearance required from the side of the of the supply air
plenum Is one and one-quarter Inch on both sides, although the factory Installed tags require a
clearance on both sides of the supply air plenum of two inches,
iii, There Is no clearance at all from the horizontal warm air duct,
although the factory Installed tags require a one Inch clearance from the horizontal warm air
duct,
F. There Is Insufficient Insulation for safety Installed In the areas around
the furnace,
G, The furnace flue, which passes directly below flexible fiberglass ducts
which have vinyl covering, has Insufficient clearances for the purpose of safety, both vertically
and horizontally,

H. The furnace flue Is constructed with three elbow fittings and with a
two Inch trap built Into the flue, which trap will not permit gasses to escape through a natural
draft,
I. The style and size of the furnace is Inappropriate to the limited height
In the basement of the home and the height of the chimney, resulting In a hazardous condition.
J. Although Plaintiff specifically requested a horizontal furnace,
Defendant, In fact, installed a vertical furnace, dangerous In the environment In which It was
Installed, without advising Plaintiff, either before or after Installation, that they had sold her a
heating and air conditioning system completely different from that which she contracted for and
reasonably believed was being Installed.
K. The furnace and air condition system In question is hazardous in that
it falls to comply with the BOCA National Mechanical Code/1993 Section M-405.1, due to Its
faulty Installation, resulting In major safety problems.
WHEREFORE, Plaintiff demands Judgment against Defendant for its breach of
contract in the amount of Three Thousand Two Hundred Seventy-six ($3,276,00) DOllarc, plus
costs and interest from July 2, 1992, the date of the breach of the contract.

AND CQNSUMER PROTECTION LAW
14, Plaintiff Incorporates herein by reference paragraphs 1 through 13,
15, The actions of Defendant as set forth above, constitute unfair and deceptive
acts or practices under the Unfair Trade Practices and Consumer Protection Law In the following
particulars:
A. Defendant represonted that the system In question had characteristics
which It did not have, specifically, that the system In question was appropriate to be Installed In
Plaintiff's house, when, In fact, such Installation created a safety hazard,;
B, Defendant represented that the system In question was of a particular
style, standard, quality or grade, which It was not, specifically that the system In question was
appropriate to be Installed In Plaintiff's home, when, in fact, such Installation created a safety
hazard,
C, Defendant failed to comply with the terms of the written warranty given
to the buyer both prior to and after the Installation of the system In question, specifically, in that
Defendant installed the system which It knew or should have known was contrary to Plaintiff's
desires and was not of the proper size and type for the purpose for which It was to be used, and
Defendant has failed to remedy said breach of warranty, In spite of requests by Plaintiff that it
honor Its warranty.
