6. On or about May 24. 1994. Wenger telephoned Plaintiff and
indicated Ihal he was willing to purchase Ihe 1986 Audl 5000 fur $2.350.00 and
that he would pick up the cur that evening, At approximately 9:30 p,m,
Wenger met with Plaintiffs and agreed 10 purchase the car for $2.350,00
7, At that time, Wenger delivered to Plaintiff check number 219
drllwn on the Grant Motor Cumpany special accuunt lit Harris Savings Bank.
in the IImount of $2.350,00. In consideration for the receipt of the purchase
price, Plaintiffs delivered the title to the automobile to Wenger, A copy of the
Wenger's check is attached hereto as Exhibit "A",
8, Plaintiffs asked Wenger where they should sign over the title to
the aulomoblle und Wenger indicated that since be was in the automobile sales
business it would not be necessary to sign the title and that he would take care
of it when he transferred the car to his purchaser, Plaintiffs reasonably
relied upon Wenger as he indicated that this was 11 customary practice in his
business of automobile sales,
9, At all times prior to tbe purchase of the automobile, Plaintiff
asked Wenger if he desired to inspect the car or to take it to a mechanic for
inspection and Wenger indicated that would not be necessary, After receipt of
the check and delivery of the automobile title to Wenger. Wenger was given
the keys. look possession of the automobile and left Plaintiffs residence in the
automobile,
10, On or about May 25. 1994, Plaintiffs depo~ited the check in the
amount of $2,350,00 into Plaintiffs savings account.
II. On or about May 27. 1994 at approximately 9:30 p,m, a person
identifying herself as Mark L, Wenger's girlfriend, Cheryl White, telephoned
Plaintiffs and told Plaintiffs that the car had broken down on the Harrisburg
Pike. that Wenger left the car at Hanisun's Aoto Parts, Carlisle, PA. unlocked
