Paul Werner, Claimant's insurance agent, testified credibly, and it is found, that the Employer was not insured for purposes of workers' compensation on October 11, 1993. 2. Correspondence from the Pennsylvania Compensation Rating Bureau corroborates Mr. Werner's testimony that the Employer was not insured for purposes of wor.kers' compensation on October 11, 1993. 3. The Claimant testified that she injured her lower back on October II, 1993 when she tripped and fell while working for the Defendant/Employer. 4. The Claimant testified that Rose Daugherty, a fellow employee, witnessed her fall and asked if she wanted her (Rose Daugherty) to piCk her up (N.T. 06/08/94, pp. 11-12). 5. The Claimant left the restaurant at about 9:00 that morning and ~Ient home; she took a number of Tylenol. Her Bon took her to Seidle Hospi tal. She was then sent to the POlyclinic Medical Center. She testified that she was seen by Robert R. Dahmus, M.D. 6. Richard John Lawyer, the Claimant's son, testified that he gave a history to the admitting clerk at the POlyclinic Medical Center (N.T. 08/01/94, f,. 19). He denied that he advised the admitting clerk that his mother had fallen over a bag of potatoes at home or that she had fallen over a bag of potatoes at all (rd. p. 20). On cross-examination, Mr. Lawyer admitted that he may have told the clerk that his mother had fallen over a bag of potatoes and that he signed the admitting history (Id. p. 21). 7. 1'he Defendant produced Rose Daugherty, the Claimant's co- employee. Ms. Daugherty testified that she got to work at 6:30 a.m. on October 11, 1993 and the Claimant got there about 10 minutes after that. The Claimant told her at that time that she fell at home a couple of days before (N.T. 11/01/94, pp. 5-6). 8. Rose Daugherty testified that the Claimant went into the store room, and Ms. Daugherty followed her. The Claimant appeared to be in pain because of the way she was holding her back. She then turned around, sat down and began to cry. She asked Ms. Dau'}herty to tell anyone who asks that she fell (Id. pp. 7-8). The Claimant continued to work until about 10:45 ()-1/2 hours) and acknowledged that she fell at home and must have hurt her back. She told Ms. Daugherty that she did not go to the doctor because she did not have the money or the insurance (Id. P. 8). 9. Athanasios ('rom) Sakkas, co.owner of the Lemoyne Family Restaurant with GUll Drakoll at the time of the alleged injury, testified that on sunday, the day before the alleged injury, the Claimant left the restaurant early because she had back pain, and had difficulty walking (N.1'. 08/01/94, p. 41). 11. Upo~ review of all of the testimony, the testimony of Rose Dautherty and Athanasios Sakkas, the Defendant's witnesses, is found to be credible as to the events of October 11, 1993. 12. upon review of the testimony of the Claimant and Richard John Lawyer, her son, their testimony which contradicts that of Ms. Daugherty or Mr. Sakkas, is found to be unworthy of belief and, therefore, is rejected. 13. The Claimant did not present any medical testimony. 14. The Claimant did not Euffer an j I1jU1:'Y in the course of her employment and related thereto on October 11, 1993. CONCLUSIONS OF ~ 1. The parties are bo~nd by the provisions of the Pennsylvania Workers' Compensation Act, as amended. 2. In a Claim Petition for workers' compensation benefits, the claimant has the burden of establishing all of the elements necessary to support an award throughout the pendency of the proceedings. Inqlis House v. W.C.A.B., 535 Pa, 135. 634 A.2d 592 (1993). The Claimant must prove that he suffered a work-related injury and that this injury caused his disability. Ruhl v. !:I.C.A.B. (Mac-It'parts, Inc.), 148 Pa. Corrunonwealth 294, 611 A.2d 327 (1992). The causal relationship between the alleged disability and work injury must be established through unequivocal medical testimony where that relationship is not clearly obvious. Housinq Authority of Pittsburqh v. W.C.A.B., ___ Pa. Corrunonwealth Ct. ___, 646 A.2d 686 (1994). 3. The Claimant has failed to sustain her burden of proof. She has not provided unequivocal medical testimony which is required in order for her to establish her claim. See, Fotta v. Workmen's Compensation Appeal Board (U.S. Steel/U:S:-X. COI'poration Maple Creek Mine) ,.534 Pa, 191, 626 A.2d 1144 (1993); Cardyn V. Workmen's Compensation Appeal Board (Heppenstall), 517 Pa, 98, 534 A.2d 1389 (1987) .
