NO. 94-4824 KENNETH KRAMER, CIVIL ACTION - LAW Defendant JURY TRIAL DEMANDED COMPLAIII'l' AND NOW, this 13th day of December, 1994, come plaintiffs, Gene and Georgia Lucas, by and through their attorneys, Hancke, Wagner, Hershey' Tully, who respectfully represent: 1. Gene Lucas is an adult individual residing at 6 Oak Lane, Hechanicsburg, Cumberland County, Pennsylvania, 17055. 2. Georgia Lucas is an adult individual and the wife of Gene Lucas, who also resides at 6 Oak Lane, Hechanicsburg, Cumberland County, Pennsylvania, 17055. 3. The facts and occurrences hereinafter relatl!d occurred on or about September 7, 1992, on Sample Bridge Road in Silver spring Township, Cumberland county, Pennsylvania. 4. At the aforesaid time and place, defendant Kenneth Eugene Kramer was operating a motor vehicle north on sample Bridge Road while plaintiff Gene Lucas was operating a vehicle southbound on Sample Bridge Road. 5. At the aforesaid time and place, the vehicle driven by the defendant crossed into the plaintiff's lane of travel, causing the accident. 6. The afore8aid accident was the direct and proximate re8ult of the negligence of the defendant in: a. failing to have hi8 vehicle under proper control; b. failing to operate his vehicle in the proper lane of tlavel; c. cro8sing the center line, causing the accident; d. failing to apply his brakes to avoid the accident; e. failing to be highly vigilant; f. failing to maintain his travel in the proper lane of travel; g. failing to operate his vehicle at a safe speed; 7. As a result of the aforesaid accident, plaintiff Gene Lucas sustained serious and permanent injuries, which include the following: Scaphoid fracture of right wrist Chipped fracture of the trapezium Arterial damage to right wrist Inflammation of right thumb eMC joint Bone fragments remaining in the wrist Aggravation of pre-existing asymptomatic arthritic condition in the right wrist and hand about the carpal metacarpal joints Hypothyroidism Loss of 8ensory feeling in toes of right foot C4-5 disc space cervical spondylosis C5-6 disc herniation with elevation of the posterior longitudinal ligament Extensor tendon fibroma Post traumatic arthritis Cervical 8train Lumbar strain Myofascial pain syndrome Anxiety and stress Reflex sympathy dystrophy in the right hand Cru.h injury to right knee with subsequent numbnee. to right leg and toes Bony encroachment of the right lateral aspect of the ventral portion or the phecal sac, C6-7 disc Degenerative disc disease of the C4-5, C5-6 and C6-7 innerspaces Hypertension Exacerbation of stomach disorder Aggravation of prostate gland resulting in bleeding from the penis contusions and abrasions Severe shock to nerves and nervous system 8. As a result of the aforesaid accident, plaintiff has in the past, and will in the future, incur medical expenses, pain and suffering, loss of life's pleasures, inconvenience, lost wages and lost earning capacity. 9. As a result of the aforesaid accident, plaintiff has sustained and in the future will sustain, medical expenses which are not covered by payments made under the Financial Responsibility Act. WHEREFORE, plaintiffs demand judgment against the defendant in an amount in excess of Twenty Thousand ($20,000) Dollars, plus interest, costs and delay damages. COUNT II aeorai. Luo.. v.
