AND NOW, th s _. day of August, 1994, upon
presentation and consideration of the within Petition, and upon
finding that the plaintiff, Lois Marie stoner, now residing at
820 Torway Road, Gardners, Cumberland County, Pennsylvania, is in
immediate and present danger of abuse from the defendant, Donald
L. Miller, Jr., the following Temporary Order is entered.
The defendant, Donald L. Miller, Jr., now residing to the
best of plaintiff's knowledge at Fourth street, Biglerville,
Adams County, Pennsylvania, is hereby enjoined from physically
abusing the plaintiff, Lois Marie stoner, or placing her in fear
of abuse and is ordered to stay away from the residence located
at 820 Torway Road, Gardners, Cumberland County, Pennsylvania, a
residence leased solely by the plaintiff. The defendant is
hereby notified that if he resides in the plaintiff's domicile
contrary to this Order, he may be in indirect criminal contempt
which is punishable by a fine not to exceed $1,000.00 and/or by a
sentence of up to six months in jail and any other appropriate
punishment. Resumption of co-residence on the part of the
plaintiff and the defendant shall not nullify the provisions of
the court order directing the defendant to refrain from abusing
the plaintiff.
The defendant is ordered to refrain from having any contact
with the plaintiff including, but not limited to, restraining the
defendant from stalking the plaintiff, or from harassing the
plaintiff, her relatives or minor children.
The defendant is ordered to refrain from damaging or
destroying any property owned by the plaintiff or any property
owned jointly by the parties.
This Order shall remain in effect until a final order. is
entered in this case. A hearing shall be held on this matter on

in Courtroom NO._~, Cumberland county cour~house, Carlisle,
Pennsylvania.
The plaintiff may proceed in forma DauDeris pending a
further order after the hearing.
The cumberland county Sheriff's office shall attempt to make
service at the plaintiff's request, but service may be
accomplished under any applicable rule of civil Procedure.
The Pennsylvania State Police Department will be provided
with a copy of this Order by attorneys for plaintiff. This Order
shall be enforced by any law enforcement agency when a violation
occurs by arrest for indirect criminal contempt. The arrest may
be without warrant upon probable cause that this Order has been
violated, whether or not the violation is committed in the
presence of the police officer. In the event that an arrest is
made under this section, the defendant shall be taken without
unnecessary delay before the court that issued the Order. When
that court i. unavailable, the defendant shall be arraigned
betore the appropriate district justice, (23 Pa,C.S.A. section
6113).

RELIEF UNDER THE PROTECTION FROM ABUSE
ACT. 23 Pa, C.S.A. Section 6101 et. seq.
A, ADUSI
1. The plaintiff is an adult individual whose permanent
address is 820 Torway Road, Gardners, Cumberland county,
Pennsylvania, l7324.
2. The defendant is an adult individual residing at Box
402, Biglerville, Adams County, Pennsylvania, 17307.
3. The defendant has had an intimate relationship with the
plaintiff.
4. Since approximately June 1994, the defendant has
attempted to cause and has intentionally, knowingly, or
recklessly caused bodily injury to the plaintiff and by physical
menace has placed the plaintiff in fear of imminent serious
bodily injury. This has included but is not limited to the
following specific instances of abuse:
a. On or about August 23, 1994, the defendant came
uninvited into the plaintiff's residence and screamed obscenities
at her causing her to fear for her safety. When the plaintiff
picked up her telephone to call for help, the defendant grabbed
her by the neck, pushed her to the floor, and took her cordless
phone breaking it. The plaintiff again tried to call for help,
but the defendant unplugged the phone, grabbed her by the hair,
pulled her backwards, grabbed her by the upper arms, and pushed
her into a wall causing the plaintiff to lose her contact lens.
When the plaintiff tried to leave the residence with her two
children, the defendant continued to push her around the house in
an effort to block her escape causing the plaintiff's two-year-
old son to suffer a cigarette burn to his arm. The plaintiff and
her children were finally able to leave the residence and call.

b. In or about July 1994, the defendant came to the window
of the plaintiff's residence and yelled at her causing her to
fear for her safety. When the plaintiff attempted to call for
help, the defendant removed her bedroom screen, pushed out a fan,
and entered the bedroom. When the plaintiff ran outside, the
defendant came up behind her and pushed her to the ground.
c. On or about June 12, 1994, the defendant kicked
plaintiff's door in called her vile names, pushed her into a
chair, and pulled his fist back as if to hit her. When a friend
of the plaintiff's entered the room and intervened, the defendant
left the residence.
d. On or about June 11, 1994, while the plaintiff and the
defendant were inside the plaintiff's car, the defendant twisted
the plaintiff's wrist and arm, repeatedly poked her in the ribs
with his elbow, and slapped her in the face twice. The defendant
repeatedly pounded on her windshield with his fist breaking the
windshield, When the defendant got out of the car, the plaintiff
tried to leave, but he stuck his upper body into the window
behind her and pinning her against the steering wheel. Later,
that evening the defendant went to the plaintiff's residence and
kicked in her door causing her to tear tor her safety and call
the police. The police took the defendant to the police station
where he spent the night.
5. The plaintiff believes and therefore avers that she will
be in immediate and present danger of abuse and that she is in
need of protection from such abuse.
6. The plaintiff desires that tho defendant be ordered to
refrain from having any contact with her inclUding, but not
limited to, stalking the plaintiff, and from harassing the
plaintiff, har relatives or her minor children.
7. The plaintiff desires that the defendant be ordered to
refrain from damaging or destroying any property owned by the
plaintiff or any property owned jointly by the parties.
8. The plaintiff desires that the defendant be ordered to
stay away from the plaintiff'S residence located at 820 Torway
Road, Gardners, Pennsylvania, which is rented solely in the name
of the plaintiff.
8, LOSSIS AND ATTORHIY fIlS
9. The plaintiff has suffered losses as a result of the
abuse by the defendant. The losses are listed on Exhibit A
attached.
10. The plaintiff asks that the defendant be ordered to pay
reasonable attorney fees and the costs of filing and service of
this lawsuit pursuant to the Protection from Abuse Act.

11. The defendant is unemployed but may be receiving
unemployment compensation.
12. The plaintiff is currently receiving publio assistanoe
in the amount of $402.00.
13. The plaintiff does not have funds available to pay the
fees for filing and service.
WHEREFORE, pursuant to the provisions of the "Protection
from Abuse Act" of october 7, 1976, 23 Pa.C,S.A. section 6101 IS.
~., as amended, the plaintiff prays this Honorable Court to
grant the following relief:
A. Grant a Temporary Order pursuant to the "Protection from
Abuse Act":
1. Requiring the defendant to refrain from abusing the
plaintiff or placing her in fear of abuse.
2. Requiring the defendant to refrain from having any
contact with the plaintiff including, but not limited to,
restraining the defendant from stalking the plaintiff, and
from harassing the plaintiff, her relatives or her minor
children.
3. Ordering the defendant to stay away from the
residence located at 820 Torway Road, Gardners,
Pennsylvania.
4. Ordering the defendant to stay away from any
residence the plaintiff may in the future establish for
herself .
5, ordering the defendant to refrain from damaging or
destroying any property owned by the plaintiff or any
property owned jointly by the parties.
B. Schedule a hearing in accordance with the provisions ot
the "protection from Abuse Act," and, after such hearing, enter
an order to be in effect for a period of one year:
1. Requiring the defendant to refrain from abusing the
plaintiff or placing her in fear of abuse.
2. Requiring the defendant to refrain from having any
contact with the plaintiff including, but not limited to,
restraining the defendant from stalking the plaintiff, and
from harassing the plaintiff, her relatives or her minor
children.
3. ordering the defendant to stay away from the
residence located at 820 Torway Road, Gardners,
Pennsylvania.
4. ordering the defendant to stay away from any
residence the plaintiff may in the future establish for
herself.
5. Ordering the defendant to refrain from damaging or
destroying any property owned by the plaintiff or any
property owned jointly by the parties.
6. ordering the defendant to reimburse the plaintiff's
out-of-pocket losses suffered as a result of the abuse
including but not limited to the losses listed on the
attached sheet marked Exhibit A.

Donald L. Miller, Jr. The plaintiff is represented by Legal
services, Inc.; the defendant is unrepresented but is aware of
