AND NOW, comes the PhuntilTs, Allstate InsurWlce Company and James Richard
Hossman, by and through their uttorneys, MARTSON, DEARDORFF, WILLIAMS & OTTO
and respectfully represents as follows:
1. Plain tilTs are adult Individuals residing at 970 Silverlake Road, Lewisberry,
Pennsylvania, 17339,
2, The DefendWlt, Thomas p, Sucic, is an adult individual residing at 131 Sunset
Drive, New Cumberland, Pennsylvunia, 17070,
3, The Defendant, J.W, Mumper Construction, Inc" IS a Pennsylvania Corporation
with its place of business at 181 Rich Valley Road, Mechanicsburg, Pennsylvania, 17055,
4, On or about November 15, 1993, a 1993 GMC Sierra owned by Defendant,
Mumper, and operated by Defendant Bueic, collided with a 1991 Nissan Maxima, owned by
the Plain tilTs and operated by Cynthia Hossman.
5. The collision occurred as the Plaintiff was traveling northbound on Route 83
at approximately 7:45 a,m,
6, The collision occurred as Plaintiff was traveling in the right. hand lane when
the Defendant, who had been in the left hand lane suddenly struck the left rear quarter
panel of the Plaintiffs vehicle,
7, The collision occurred solely us a result of the negligence, recklessness and
carelessness of the Defendants in that Defendant:
a, failed to yield the right of way to the Plaintiff;
b. failed to properly brnke his vehicle in time to avoid striking PlaintilTs
vehicle;

(b) Failed to properly brake his vehicle in time to
avoid striking Plaintiffs' vehicle;
(c) Failed to properly operate or control his vehicle at
a speed that he could stop within the assured clear distance ahead;
and
(d) operated his vehicle in a careless and reckless
manner.
B. Denied, The averments of paragraph 8 of Plaintiffs'
Complaint are conclusions of law to which no response is required,
If a response is deemed to be required, said averments are denied
and strict proof thereof is demanded at trial,
By way of further
following new matters:
9, Prior to the collision between Plaintiffs' vehicle and
NEW MATTIR
answer, the Defendants
interpose
the
Defendants' vehicles, a vehicle traveling north on Route 83 in the
right hand lane in front of Plaintiffs' vehicle, suddenly pulled
into the left hand lane directly in front of Defendants' vehicle
causing contact to be made with the right front portion of
Defendants' vehicle,
10, Contact by this unknown vehicle with Defendants' vehicle
caused Defendants' vehicle to impact with the concrete divider
located between the north and southbound lanes of Route 83, which

then caused the vehicle to travel in a northeasterly direction
causing the unit being towed by Defendants' vehicle to impact with
the left rear portion o~ Plaintiffs' vehicle,
11. The direct and proximate cause of damages to Plaintiffs'
vehicle was the negligence, carelessness and/or recklessness of the
driver of the vehicle which first contacted Defendants' vehicle and
which did not stop at the accident scene,
12. Plaintiffs' claims are p~ecluded in whole, or in part, by
the doctrine of comparative negligence and/or the Pennsylvania
Comparative Negligence Act,
13, The damages to Plaintiffs' vehicle occurred as a result
of the negligence, carelessness and/or recklessness of persons over
whom Defendants had l10 control,
WHEREFORE, Defendants, Thomas Prowell Sucic and J.W. Mumper
Construction, Inc., demand judgment in their favor and against
Plaintiffs,
