Frederick Leroy Hippensteel, Deputy Sheriff, who being duly sworn according to law, says that on September 28, 1994, at 7135 o'clock P.M., E.D.S.T., he served a true copy of the within Complaint in Mort.gage Foreclosure and Notice, in the above entitled action, upon the within named defendant, to Witl Kristi Frederick, by making known unto Kristi Frederick, at 30 Stephen Road, Camp Hill, Cumberland County, Pennsylvania, its contents and at the same time handing to her personally the said true and attested copy of the same. R. Thomas Kline, Sheriff, who being duly sworn according to law, says that he made diligent search and inquiry for the within named defendant, to Witl Kristi II. Frederick, but was unable to locate her in his bailiwick. He therefore deputized the Sheriff of Dauphin County, Pennsylvania, to serve the within Complaint in Mortgage Foreclosure and Notice according to law. DAUPHIN COUNTY RETURN: AND NOW: eptember 7th, 1994 at 9:20 A.M., served the within Complaint in Mortgage Foreclosure upon Mitchell G. Said no\:e initially called for the detendants to make monthly payments at $370.10, plus escrow tor taxes and insurance, which Bums were to be applied first to interest at the initial rate of nine and one-halt (9.5%) percent per annum, the balance to prin- cipal. 5. Concurrent with and in order to secure said not!!, the detendants executed a mortgage dated August 10, 1990, in favor ot plaintiff, to secure the sum of $44,100.00. Said mortgage is recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Mortgage Book 987, page 419. A true and correct copy of said mortgage is attached hereto as Exhibit A and incorporated herein by reference. 6. Pursuant to the terms of the adjustable rate note and the adjustable rate rider to the mortgage, the defendants are now obligated to make monthly payments of $289.53, plus escrow for taxes and insurance, which sums were to be applied first to interest at the rate of six and three-quarters (6.75%) percent per annum, the balance to the principal. 7. Pursuant to the terms of the adjustable rate note and the adjustable rate rider to the mortgage (Exhibit A), the defendants' scheduled payment is due to change on August 10, 1994, at which time their scheduled monthly payment will be $318.01, plus escrow tor taxes and insurance, which sums will be applied first to interest at the rate of seven and six hundred twenty five one thousandths (7.625') percent, th~ balance to principal. 8. Defendants are in default under said note in that they have failed to make the payment due october 1, 1993, and subse- quent payments thereafter. Pursuant to the terms of said note and mortgage upon said default the plaintiff is entitled to accelerate the entire remaining balance on said loan. As of the date hereof, the balance owed to the plaintiff is as follows: principal balance $43,098.75 accrued interest to 7/19/94 2,637.99 plus interest thereafter at the rate of $7.97 per day until September 1, 1994, at which time the daily accrual of interest will become $9.00 per day. In addition, plaintiff is entitled to reasonable attorney's fees which plaintiff has incurred. 9. Pursuant to the provisions of the Homeowners Emergency Mortgage Assistance Act of 1983, the plaintiff notified the defendants of their rights under said Act on March 21, 1994, by certified as well as regular mail. Copies of the notices as well as true and correct c<opies of the certificates of mailing, are attached hereto as Exhibit B and incorporated herein by reference. The defendants have failed to avail themselves of the assistance available under the act. 10.
