IN ACCORDANCE WITH CUMBERLAND COUNTY RULE OF CIVIL PROCEDURE
1915.3-8(b), the undersigned Custody Conciliator submits the
following report:
1. The pertinent information pertaining to the child who is
the subject of this litigation is as follows:
Bric Brandon Halter, born December 23, 1985.
2. A Conciliation Conference was held on September 22, 1994,
with the following individuals in attendance:
The Father, Rodney L. Halter, with his counsel, Sally J.
Winder, Esquire, and the Mother, Melinda G. Halter, with
her counsel, Lisa M. Coyne, Esquire.
3. The parties were before the Court for a Hearing on September
12, 1994. The parties had separated during the summer and
the Mother moved to Virginia Beach. The Hearing on September
12, 1994 was to address the custody situation as to where the
child would go to school. The Mother had taken the child
with her to Virginia Beach. When the Father received the child
for a period of vacation, the Father felt the child wanted to
stay in the Shippensburg area and go to school in Shippensburg.
At the September 12 Hearing, the Court ordered that the Father
shall enjoy custody of the child pending further Order of this
Court with the Mother to have custody on alternating weekends.
4. The parties are still at odds. The Mother is insistent that
she should be the primary custodia~ for the child. She
suggests that she left the marital home because of an
abusive situation. She also suggests that she has planned to
relocate to the Pennsylvania area.
5. Father's position is that the child wants to remain in
Shippensburg and that the Father would be able to provide a

On January 28, 1990, Defendant, alons with Erio and her
ohildren fro~ a prior marriase, left Plaintlff after years
of abu8e and Defendant filed a Complaint For Divoroe with
thi8 Court at No. 2723 Civil 1990. The partie8 attempted a
reoonoiliation subsequent to the filins for divoroe, but
that was unsuooessful beoause of Plaintiff's oontinued
abusive oonduot and hi8 exoe88ive drinkins. Con8equently
Defendant left the marital home and took Erio and Christine,
Erio's half-si8ter, and moved into Defendant'8 brother's
ho~e, While she and the ohild resided in the brother's
ho~e, Plaintiff continued his pattern of abuse and
harassment, Eventually Defendant moved briefly to Virsinia
Beaoh, Virsinia to set away from Plaintiff,
Durins the time Defendant and her ohildren re8ided in
Virsinia (approximately two months) she made weekly weekend
return trips to Shippenaburs in order for Father to have
weekend visitations with Eric, Durins one of those visits,
Plaintiff refused to return Eric to Defendant and instead
filed a Complaint For CU8tody.

The mother of the child is Melinda G. Halter, currently residin!:!ln Virginia Beach.
Vir!:!inia, She and the lather are still married although selJarated. The lather of the child is the
PlaintilfRodney L. Halter. currently residin!:! at 49 Richard Avenue, Shippensbur!:!. Pennsylvania,
He is married althou!:!h lhe parties arc separated.
4. The relationship of Plaintill' to the children is that ofnaturallalher. The Plaintill.
currently resides with no other persons,
5, The relationship of Dcfendant to the children is that of natural mother, The
Defendant currently resides with R boyfricnd and thc boyfriend's mother at an unspecilied address
in Vir!:!inia Beach, Vir!:!inia.
6. Plaintill' has not participated as a party or witness, or in another capacity. in other
Iiti!:!ation concernin!:!the custody of the child in this or another Court.
Plaintill' has no information of any other custody proceeding concernin!:! the
child tiled in a Court oflhis Commonwcalth.
Plaintill'does not know of a person not a party to thc procecding who has physical
custody of thc child or claims to have custody or visitation ri!:!hls with respect to the child,
7, The best inlerests and permanent welfare of the child, will be selVed by granting
the relief requested because the father is capable ofnurchering and carin!:! for the child. The child
has visited with the lather on various weekends since the separation. The child wishes to return
to Pennsylvania and live with his father. The father's family and the child's friends and contacts in
the community are all cenlered in Shippensburg and mother is not capable of providing a proper
nurturin!:! atmosphere and environment for the child.

AND NOW, this 12th day of September, 1994, at
12.15 p.m., after brief hearing, pending further order of court,
custody of the child, Eric Brandon Halter, born December 23,
1985, shall be in hi. father, Rodney L. Halter, subject to such
periods of partial custody in the mother as they can agree, and
if they cannot agree, every other weekend from Priday at 7.00

4. On or about June 1~, 1994 Petitioner separated
from Resp~ndent with Respondent's consent and she, alon.
with Eric, moved to Virginia Beach, Virginia.
5. Prior to separation and sinoe separation, Mother
has been primary oare giver for her son, Erio Halter.
6. Bince separating from Respondent, Mother has
encouraged Father's contact with Eric and Mother agreed for
Father to have visitation with son from August 27, 1994 to
September 3, 1994,
7. On or about September 1, 1994 Respondent informed
Mother that he refused to return Erio to Mother and that he
would retain oustody of Erio,
8. Sinoe September 1, 1994, Petitioner has tried
frantioally to have her son returned to her by negotiating
with Respondent, but that has been unsuooRssful,
9, On or about September 1, 1994, it is believed
Father filed a Petition For Custody with this Court and a
Conciliation Hearing reg~rdin8 same is scheduled for
September 22, 1994; however, Petitioner has not received any
written notification of same nor a oopy of. the believed
Petition For Custody,

Vir.inia. Denied that Plaintitt does not know or have
intormation other than oity and state ot Detendant's
residenoe. By way of turther answer, Detendant resides at
600 Wordsworth Lane, Virginia Beaoh, Vir.inia.
3, Admitted in part, Denied in part. Admitted that
Erio Brandon Halter was born of the marria8e of Plaintitt
and Detendant. Denied that ohild was born on Deoember 23,
1985, Rather, child was born December 23, 1986, Admitted
that since Detendant separated from Plaintitf Eric has
resided with Defendant and Defendant has been the primary
physioal custodian and caregiver of Eric, By way of further
answer Defendant and Erio moved to Virginia Beach, Virsinia
to distance themselves trom Plaintiff and his alcoholio
oonduct and behavior.
Prior to moving to Virginia Beach, Virlinia,
Defendant separated from Plaintiff on or about June 15, 1994
after years of abuse at the hand of Plaintiff and she lived
with her brother in Shippensburg, Pennsylvania until July
15, 1994 when Defendant and Eric, along with Defendant's
minor daulhter, Christine E, Miller, moved to Virginia
Beach, Vir8inia, It is admitted that only sinoe 1991 that

Iria has lived with both his parents and half-sister,
Christine, at 49 Riohard Avenue, Shippensburl, Pennsylvania
and that it i. believed the Plaintiff reBides at the same
address to date.
It ie admitted that the parties are ourrently
.eparated and it is further admitted that an aotion in
divoroe wae filed by the Defendant at No, 2723 Civil 1990 in
whioh Defendant alleles irretrievable breakdown,
Indilnltiee, and oruel and barbarous treatment,

that Plaintiff ie Brio's natural father, Defendant is
without information or knowledle suffioient to form a belief
ae to the truth of the averment that Plaintiff resides by
himself and the eame is therefore denied, with striot proof
beinl demanded, if relevant.

6. Oenied. After reasonable investigation, Oefendant
is without knowledge or information suffioient to form a
belief ae to the truth of the averments and the same are
denied, with striot proof beins demanded, if relevant.
7. Denied. The best interests and permanent welfare
of the ohild will not be served by sranting custody to
father. Further it is denied that father is "oapable of
nurcherins <sic)" and oaring for the child. By way of
further answer Plaintiff is inoapable of nurturins or oarin,
for the ohild due to his dependenoe on aloohol and alooholio
beverases. It is admitted that only throush the Defendant's
initiative that Erio has visited with his father for various
weekends sinoe the parties separated, It is denied that the
ohild wishe. to permanently return to Pennsylvania and live
exclusively with Plaintiff, It is denied that Defendant ie
inoapabl~ of providins a proper nurturins atmosphere and
environment for the child. Rather, Defendant has been the
primary oaresiver, parental fisure, and physioal oustodian
of Eric sinoe his birth and has been the only stable and
endurins nurturins parent in Eric's short life to date.
