custody of ReSlXlIldent subsequent tll August 19lh, 1994, and agrccd tll sign a stipulation
confirming that agreement. However, she latcr rcneged on lhal oral agreement, after
Rcspondent's allorney had already prepared both the Agreement and a Pelition for a Conciliation
Conference in the York County Court of Common Pleas with the same Mastcr who had heard
this casc previously. That petition wa.~ filed in due course on August 22nd, 1994 and is
scheduled for a hearing on September 9th, 1994.

14. Denied, It is specifically denied that:
(a) Respondent routinely leaves thc children alone overnight without any adult
supcrvision,
(b) It is denied thaI Petitioner hBll provided Grace with a stable home
environment for the I'Bllt two years. On the contrary, the home hBll been
dysfunctional while lhe child in question hBll repeatedly heen suspended from
school and issued detentions.
(c) Respondent is without knowledge a.~ to the recommendation for
counseling, hut finds it entirely credihlc that such counseling has been
recommended. Indeed, during lhc pcriod lhat Respondenl has had Grace in his
custody since July 19th, Grace has heen enrolled in and has attended two
counseling sessions to deal with the ohvious trauma thaI she has suffered while
residing in the home of her mother.

(d) It Is denied that Oraee enjoys freedom or lack of discipline In
Respondent's eustlldy, On the contfllry, she has suffered from a laek of structure,
a lack of an appropriate environment frce of scxual dcmllnstflltion and innuendo,
and hIlS had scrlous dlfl'icultles al scholl culminating In her having failed the
academic ycar In school for this past year,
(c) Denied.
(0 Denied. The facts of record previously are clear In this case that
Respondent had good and sufficient reason and that u~supcrvlsed visitation
was only reslJmed after Petitioner Carol Kramer received a psychological
evaluation and followed through with regular counseling sessions to deal
with her mental illness.
WHEREFORE, Rcspondent respectfully requests the Court:
(a) to reverse its g ~ Order of August 30th, 1994, and to instcad order the child
returncd to the custody of Respondent pcnding a full hcaring on the issues raiscd in the instant
Petition, this Reply and in thc Petition for Conciliation which is still pending in York County;
(b) Pctilioner further requests that the Court find thaI Rcspondent is not in contempt
due to the exigencies of the circumstances and the fact that he actcd in order to protect the
mental and moral welfare of his child from further acts of inappropriate sexual antics by her
step-father.

1994, Grace contacted Respondent and requested that he pick het' up.
Grace has remained with Respondent since that incident.
8. A13 Respondent had not relinquished custody pursuant to the custody
Order by mid-August, Petitioner denlllnded by certified mail that
Respondent return Grace to Petitioner's custody on or before August 21,
1994 to avoid the necessity of enforcing the Custody Order through the
legal process. Although Respondent received the letter on August 17,
1994 as evidenced by his signature on the return receipt, he has not
relinquished custody of Grace. Respondent's willful violation of the
November 11, 1992 Court Order, demonstrates a total disrespect and
disregard for the law.
9. A certified copy of the Custody Order issued by the Honorable Penny L.
Blackwell, Court of Common Pleas of York County, is being currently
filed and entered into the records of the Prothonotary's Office for the
Cumberland County Court of Common Pleas.
10. This Court has jurisdiction under Pa. R.C.P. No. 1915.2 and Pa. C.S.
Section 5364(a) and (b) to enforce the November 11, 1992 Custody Order
because Grace has been living in Cumberland County for the past two
years and Cumberland County is the "home jurisdiction" of the child
pursuant to the Uniform Child Custody Jurisdiction Act, 23 Pa, C.S.
Section 5343. The period of temporary absence of Grace from
Petitioner's custody from July 19, 1994 to the present does not affect
the 6 months residence period (23 Pa, C.S. Section 5364(b))
particularly since Grace is being retained by a party claiming custody
(Pa. R.C.P. No. 19l5.2(a)(i)(ii)).
11. Grace has been enrolled in the Carlisle School District since 1992.
12. Respondent resides outside the Carlisle School District and has

1. That the parties to this action are adult individuals who were
divorced June 14, 1991.
2. That the parties have two (2) minor children, to wit: Matthew P.
Lindsey, born October 1, 1979, age 13, and Grace A. Lindsey, born May 14,
1981, age 11.
3. The parties previously entered into a stipulation to t.erms of
legal and physical custody with respect to their minor children which was
incorporated into an Order of Court on September 13, 1991 (See Stipulation
and Order of Court: attached).
4. The parties have now entered into a Revised Stipulation to Terms
of Custody with resnect to s,~id minor ch; ldren wt>ich is attached hereto and
incorporated herein.

6. That paragraph number 5 of the Stit1ulation contemplates that it

o. Each party shall have the right to two weeks of
partial custody with the other child during each
sUllll1er upon thirty (30) days notice to each
other. Sunmer vacation shall fall during
different two week segments so that the children
are together for four (4) weeks during the
8U111ner.
f. The parties shall alternate holidays so that the
children are t03ether on all holidays. Holiday
visits shall cOlllllence at 6:00 p.m. on the eve of
each specified holiday until 9:00 p.m. on the
holiday itself. Holidays shall include New
Year's Day, Easter, Memorial Day, July 4th, Labor
Ooy, Thanksgiving and Christmas.
3. The welfare and convenience of the children shall be the prime
consideration of the parties in any application of the foregoing provisions
of this agreement. Neither party shall alienate or attempt to alienate or
destroy the affection of the children for the other parent, but shall make
every rell80nable effort to foster a feeling of affection between the
children and both parents.
4. the parties furtner agree that they will split the income tax exemption
for the children, so that Carol A. Lindsey will be able to claim Grace A.
Lindsey as her exemption for income tax purposes, with James Lindsey
continuing to claim the exemptio~ for Matthew P. Lindsey.
5. 'the parties agree that the ten.~ of this Stipulation ~y be entered as
an Order of Court and that it shall be enforceable by the Court in the same
matter and with the same effect as if a decision had been entered after a

1994, Grace contacted Respondent and requested that he pick her up.
Grace has rernllino:d with RlIspondent since th,1t incident.
S. All Respondent had not relinquished custody pursuant to the Custody
Order by mid-August, petitioner demanded by certified mail that
Respondent return Grace to Petitioner's custody on or before August 21,
1994 to avoid the necessity of enforcing the Custody Order through the
legal process. Although Respondent received the letter on August 17,
1994 III!J evidenced by his signature on the return re<:eipt, he has not
relinquiahed custody of Grace. Respondent's willful violation of the
Noverrber 11, 1992 Court Order, demonstrates a total disrespect and
disregard for the law.
9. A certified copy of the Custody Order issued by the Honorable Penny L.
Slackwell, Court of Conrnon PIp-as of York County, is being currently
filed end entered into the records of the prothonotsry's Office for the
Cumberland County Court of Common Pleas.
10. This Court has jurisdiction under Pa. R.C.P. No. 1915.2 and Pa. C.S.
Section 5364(a) and (b) to enforce the November 11, 1992 Custody Order
because Grl!ce has been living in Cumberland County for the past two
years IInd Currberland County is the "home jurisdiction" of the child
pursullnt to the Uniform Child Custody Jurisdiction Act, 23 Pa. C.S.
Section 5343. The period. of temporary absence of Grace from
Petitioner's custody from July 19, 1994 to the present does not affect
the 6 months residence period (23 Pa. C.S. Section 5364(b))
particularly since Grace is being retained by a party claiming custody
(pa. R.C.P. No. 1915.2(II)(i)(ii)).
11. Grace hllll been enrolled in the Carlisle School District since 1992.
12. Respondent resides outside the Carlisle School District and has
att.mptecl to em"oll Grace in the Northern School District, furthor
indicating his intention to rotnln custody in violation of the Novcmber
11, 1992 Court Orddr.
13. The 1994-1995 school year in the Carlisle School District began on
Monday, August 29, 1994: however/ Grace WAS not in attenoance.
14. Grace's best interests and welfare will be served by enforcement of the
Hav.lItler 11 / 1992 custody Order 9ranting primary physical custody to
Petitioner for the following reasons I
a. It is Petitioner'l!! understanding that Rel!!pondent is
frequently abaent from home and rout inely leaves Grace
and Matthew alone overnight without any adult
supervision.
b. Petitioner il!! able to and has provided Grace with a
more stable home environment over the past two years.
c. Counseling has been recommended by Grace's school for
emotional problems Grace haa been experiencing.
Petitioner is more accessible and available than
Reepondent to encourage and asaist Grace in receiving
appropriate counseling.
d. Petitioner believes that while Grace may prefer the
additional freedOlllll and lack of discipline I!!he receivel!!
in Rel!!pondent's cUl!!tody/ this lack of structure and type
of environment does not serve Gracc's best interests at
thil!! time.
e. Petitioner is concerned that Grace has learned to
manipulate the parties with respect to custody and that
yet another change in custody in less than two years ia
not in Grace'l!! best interests.
f. In the past / when Respondent had primary physical
cUl!!tody of Grace/ Respondent failed to comply with
exil!!ting Court Orders granting Petitioner partial custody
righte.

COMES NOW the Plaintiff, James A, Lindsey, by and through his attorney,
Stephen D, Conversc, Esquire, of Anderson, Conversc and FennicK, p, C., and states as follows
in support of this petition:
1. Pelilioner, James A. Lindsey is an adult individual residing al 122 Nonh YorK
Road, DiIlsburg, Pennsylvania 17019.
2, Respondent, Carol A, Lindsey, is an adult individual residing al 217 Peach Glen
Road. Gardners, Pennsylvania 17324.
3, The parties are the nalural parents of Matthew P. Lindsey, date of binh October
1st, 1979, and Grace A. Lindsey, dale of birlh May 14th. 1981.
4, The last agreemenl between the panies concerning custody was dated November
Illh, 1992 and effectively split custody between lhe two panics, with the child Grace living with
her mother, Carol A. Lindsey, and Matthew living with his father, James A. Lindsey, the
Petitioner.

has sinclI refused to sign it.
7, Childrlln's SlIrvices in Cumberland Counly, where Respondent resides, were
notified of lhe event in question and an investigalion was made. The results of that investigation
are unclear, but in any event no charges have been broughl against IWspondent's husband.
However, it is not disputed by any of the panies lhatthe incidents occurred as described herein

1. Petitioner is Carol A. Kramer, formerly Carol A. Lindsey,
(hereinafter "Mother"), who currently resides at 217 Peach Glen
Road, GlIrdners, Cumberland CQunty, Pennsylvania.

3. The parties are the nIItural parents of two children, Grace A.
Lindsey, born May 14, 1981, age 13 and Matthew P. Lindsey, born
October 1, 1979, age 14.

4. The parties' rnarltlll residence was located In York county. Upon
lIeparation, Mother moved to Cumberland County and obtained a
Divorce Decree Issued by the Honorable George E. Hoffer of the
Cumberland County Court of Common Pleas on June 14, 1991.
5. Prior to entry of the Divorce Decree, Fether filed a Complslnt tor
Custody of the parties' minor children on March 1, 1991 In the York
County Court of Common Pleas, Docket No. 9l-SU-01097-03C.
6. On Septent>er 13, 1991, the Honorable Sheryl A. Dorney of York
County Court of Common Pleas, entered an Order incorporating the
parties' Stipulation to Terms of Legal Custody, under. which Father
had primary physical custody of Matthew and Grace subject to rights
ot partial custody in Mother.
7. At the time of the September 13, 1991 Custody Order both minor
children resided with Father in York County.
8. After entry of the September 13, 1991 Custody, var iOllS Pet I t Ions
regardil~ custody were filed In York County ultimately resulting in
continued primary physical custody of Matthew and Grace in Father
subject to rights of par:lal custody in Mother. Throughout this
time, the children continued to reside in Yr)rk County with Father.
9. On Novlllri:ler 11, 1992, the Honorable Penny L. Blackwell ot York
County Court of COlllllOn Pleas, entered an Order incorporating the
parties' Stipulation to Amend Terms of Legal Custody under which
Father waa to have primary physical custody of Matthew and Mother

wea to have primary physicsl custody of Grace, subject to rights of
partial custody in each 'of the porties, respectively. A copy of
Judge Blackwell's Order and the Petition and Stipulation which it
incorporates are attached hereto as EKhibit A.
10. At all times since the date of Judge Blackwell's Nove~r 11, 1992
Order and until July 17, 1994, Grace has resided in Cumberland
County with Mother and has attended school in the Carlisle School
Diatrict.
11. After an argument between Mother and Grace, on or about July 19,
1994, Grace contacted Father and requested that he pick her up.
Grace haa been living with Father since that incident.
12. Aa Father had not relinquished Custody pursusnt to the November 11,
1992 Custody Order by mid-August, Mother demanded by certified mail
that Father return Grace to Mother's custody on or before August
21, 1994 to svoid the necessity of enforcing the Custody Order
through the legsl process. Although Father received the letter on
August 17, 1994, as evidenced by his signature on the return
receipt, he has not relinquished custody of Grace.
13. On August 25, 1994, Mother received a copy of a Petition filed by
Father for Custody of Grace in the York County Court of Corrmon
Pleas on August 23, 1994. The notice states that a Conciliation
Conference has been scheduled with Glenn C. Vaughn, Esquire on
September 9, 1994.
14. Mother is currently fil:,ng or has filed a Petition for Civil
Contempt for violation of the November 11, 1992 Custody Order along
with a Certified Copy of the Order in the Cumberland County Court
of COmmon Pleas.
15. Jurisdiction of the Petition filed by Father in York County is
properly in Cumberland County under Pa. R.C.P. No. 1915.2 because
Grace resided with Mother in Currberland County from Noverrber 1992
through July 19, 1994. Specifically, Currberland County had been
Grace's home county within slK months of the filing of Father's
Petition and Grace is absent from Cumberland County at this time
because of her retention by a person claiming the child's custody.
Pa. R.C.P. No. 19l5.2(a)(i)(ii).
16. It is in Grace's best interest that the custody matter be decided
in Cumberland County because her significant contacts with school,
friends and family are in Cumberland County.
17. Juriediction of this custody action is properly in Cumberland
County according to 23 P~. C.S.A. Sections 5364 (0) and (b) under
which Grace's "home jurisdiction" (under 23 Pa. C.S.A. Section
5343) is Cumberland County. Grl.lce's "temporary absence" from
Mother'a custody shall not effect the SiK months period of
residence irrmediately preceding Father's Petition, 23 Pa. C.S.A.
Section 5364 (b).

2. A Conciliation Conference was held on (, October 1994 and the tollowing
individuals were present: the Plaintiff and his attorney, Stephen J. Converse,
Esquire; the Detendant and her attorney, Dawn Sunday, Esquire.
3. Items resolved by agreeMent: None
4. Issues yet to be resolved: Primary physical custody ot Graee Lindsey.
5. The Plaintiff's position on custody is as follows: The father teels that
Grace should COMe live with him for several reasons: (1) she is doing poorly in
. school while 11 v ing wi th the 1II0ther; (2) she has a strong preference to 11 ve wi th the
tather: and (3) the child is uncoMtortable with the Mother's new husband's sexual
behavior toward the mother Ithis will be addressed in more detail below).
6. The Detendant's position on custody is as follows: The Mother teels that
'Grace should continue to live with her. She denies that the problems exist as the

7. Need for separate counsel to represent child: the conciliator sees no need

sees no speeiflc need for independent counseling and neitber party requested it.
9. Other matters and COMMents:
Both children lived witb tbe father until sometiMe in 1992. At tbat tima, by
i agreeMent of tbe parties, Grace went to live with the Mother. At the end of the SUMMer

. in 1994, the father kept Graee and declined to return her to the MOther's custody,
claiming that tbe child wanted to live witb bi~. The Motber filed a petition for
'eonteMpt, an order was entered, and the ehild was returned to tbe motber.
The Motber wants the court to impose sanctions on the father in the form of her
attorney's fees, wbicb she claiMS exceed $1,000.00. Tbe order entered by the court in
I response to the MOther's conteMpt citation appears to award attorney's fees, but did
not set an amount. If the parties are not able to resolve these differences, the court
will have to address that iSBue.
In the meantime, the father wants Grace to come live with hi~ for several reasons.
He claiMs that the child is doing poorly in school, pri~arily as a result of the
motber's failure as a parent, and tbat Grace has a strong preference to live with biM.
He also COMplains that the Mother's new husband, who openly de~onstrates his affection
to tbe ~tber in tbe presence of Grace, and wbo makes indirect references to sexual
matters between the mother and biMself, embarrasses and upsets Grace. There is no

PETITION TO INCORPORATE CUSTODY/VISITATION AGREEMENT
AND NOW, comes the Petitioner, JAMES A. LINDSEY, by his attorney, Stephen
D. Converse, Esquire:, and respectfully represents as follows:
I. That the: panies to this action are adult individuals who divorced on June 14th,
1991.
2. That the panies have two minor children, to wit: Matthew p, Lindsey, born
October 1st, 1979, and Grace A. Lindsey, born May 14th, 1981.
3, The panies have entered into an Amended Custody/Visitation Agreement with
respect to their minor children, a copy of which is attached hereto and marked as Exhibit
"A" and incorporated herein.
4, This Coun has jurisdiction to incorporate the Amended Custody/Visitation
Agreement signed by the panies into an Order of Coun, in that jurisdiction over Grace A.
Lindsey was transferred to Cumberland County by Coun Order dated September 1st, 1994
and Cumberland County is at present the "home jurisdiction" of the child, Grace A. Lindsey.
pursuant to the Unifornl Child Custody Jurisdiction Act.

d) Mother shall have the right to two weeks of partial custody with the
children during each Summer upon thirty (30) days notice to Father,
Summer vacation shall fall during different two-week segments so that the
children are together for four (4) weeks during the Summer.
e) Mother shall have the right to alternate holidays so that the children are
together 011 all holidays. Holiday visits shall commence at 6:00 p,m. on
the eve of each specified holiday until 9:00 p,m. on the holiday itself.
Holidays shall include New Year's Day, Easter, Memorial Day, July 4th,
Labor Day, Thanksgiving and Christmas, This schedule shall commencc
with New Year'3 Day 1995,
3. The welfare and convenience of the children shall be the prime consideration of
the parties in any application of the foregoing provisions of this Agreement. Neither party shall
alienate or allempt to alienate or destroy the affection of the children for the other parent, but
shall make every reasonable effort to foster a feeling of affection between the ehildren and both
parents.
4. The parties agree that [he terms of this Stipulation may be entered as an Order
of Court and that it shall be enforceable by the Court in the same manner and with the same
effect as if a decision had been entered after a full hearing on the maller,
5, Father hereby agrees to waive all claims for child support as to either of the
children.
