CUSTODY HEARING MEMORANDUM
The father, Raymond Thompson, requests that he be given primary
I
!custody of his daughter, Keosha S. McGraw, born December 2, 1989.
I
iKeosha was conceived when the mother was attending Carlisle High
School. The father was residing at a residence in Carlisle that had
Ibeen owned by his great-aunt. After the child's birth in December,
11989, the mother made arrangements to enter the military. Pursuant to
a request from the mother, the parties agreed that Keosha would be
placed in the custody of the maternal grandmother and grandfather.
The father was unsuccessful in keeping track of the mother and the
Ichild. The only way that he had to communicate with the mother as to
lithe whereabouts of the child was through the maternal grandparents.
jlwhen the father would call to find out the whereabouts, he would be
,!tOld by the maternal grandmother that she didn' t know where the mother

,was or alternatively, that she would get in contact with the mother
!I
land have her call the father. Finally, in late 1993 or early 1994,
I
[the father learned that the mother and child were residing in utah in
!connection with the mother's military service. The mother called the
I!
ifather and indicated that she could not manage the child and requested

:that he take custody of Keosha. The father made all of the necessary
arrangements to become primary care taker of the child, which included

Ilmaking ohild care arrangements, as well as leasing a larger residence
Ilfor he and his daughter. Within a couple of weeks, the mother changed
Ifher mind and utilized the then existing Court Order in order to retake
"custody of the child and return with her to utah.
i The mother has had three children out of wedlock, all to
Idifferent fathers. Keosha has a half-brother, Tyrel P. S. MCGraw, and

'Ia half-sister, Jamira R. Burse. At some point in time in 1994, the
,
,
imother left the military. The circumstances of the mother's
:!separation from the military are not clear to the father as he was
I!told that she was separated for hardship reasons or alternatively,
I,that she was discharged due to passing checks on an account without a
I
I
,SUfficient balance.

I At some point in time, the mother married a man by the name of
Fred W. Nash. Mr. Nash is to believed to have been in the military.
Mr. Nash and Miss McGraw took up residence at 50 Walnut street,
I
I
I,carlisle, at some point in 1994. Attached hereto, are portions from a
,
,
'Protection from Abuse Petition alleging the abuse between Mr. Nash and
I
ilthe mother and the children. At the same time that the Protective
Ilorder was filed, the father was requesting a conciliation conference
IlsO that he could establish contact and a Court Order in reference to
ihaVing custody of his daughter. The father was ~ resident of Oklahoma
rhere his wife, Zena G. Thompson, was stationed in the military. The
Ilfather came back for the hearing on October 27th and the parties
dreached an agreement whereby Keosha could spend time with the paternal
randmother, Alice Thompson. The father exercised the Christmas
isitation with his daughter. Thereafter, the father's present wife

lirequested a discharge from the Army to permit a return to pennsylvania

il At the present time, Zena Thompson is employed with the federal
iigovernment as a corrections officer at a facility in Minersville. She
,Icornmutes from the parties' home to her job. The father is employed as

!a mortgage broker. He and his wife have a stable home environment and

,iwish to have primary custody of Keosha to provide moral guidance and a
'!stable home for her to grow up in. The mother, over the years, has
:!demonstrated an inability to provide stability or a moral example tor
i!her daughter. She has had three children out of wedlock to three

the attached Custody Conciliation Report, it is ordered and
directed as followst
1. A Hearing is scheduled in Courtroom No.4 of the Cumberland

case. At this Hearing, the Father shall be deemed to be the
moving party and shall proceed initially with testimony.
Counsel for the parties shall file with the Court and opposing
Counsel a Memorandum setting forth the history of the custody
in this case to date, each party's position on custody at this
time, a list of witne~ses that will testify for each respective
party and a summary of the anticipated testimony of each
witness. This Memorandum shall be filed at least ten days
prior to the Hearing date.
2. Pending further Order of this Court, the Mother, Monique E.
McGraw and the Father, Raymond Roosevelt Thompson, IV, shall
enjoy shared legal custody of Keosha S. McGraw, born December
2, 1989. The Mother shall enjoy primary physical custody of
the minor child. The Father shall enjoy temporary physical
custody of the minor child on alternating weekends from
Friday at 6 P.M. until Sunday at 6 P.M. This alternating
weekend time frame shall begin on March 10, 1995. When
Father has custody of the minor child, Father shall insure
that the child attends her girl scout and other relevant
school or social activities, and Father shall also insure
that the minor child attends church on Sunday. The non-
custodial parent shall be afforded reasonable telephone
access with the minor child.

3. 'l'he parties were previously before the Conciliator in November
of 1994. At that time, the Father was residing in Oklahoma and
the Mother resided in Carlisle. A temporary Order was issued
to give the Father some period of temporary custody at that
time. Subsequent to the November Conciliation Conference,
Father has relocated to the Carlisle are~.
4. Father is now seeking primary physical custody of the minor
child. Although Father has not had a great deal of contact
with the child over the past few years, Father suggests that
Mother's current living arrangement is such that the child
would be better off living with Dad. Dad's lack of contact
with the child is, in Dad's opinion, the result of the
Mother's association with the military over the past few
years.
5. 'l'his is a difficult case. 'l'he Mother has three children, all
of whom are [rom different Fathers. She is not married to any
of the Fathers. She is currently unemployed. However, the
Mother has had primary physical custody of the minor child for

this custody at Mother's home in Maryland. In the
event Father desires to take the child to Oklahoma,
the time frames may need to be modified and the
parties should attempt to reach an agreement on any
necessary modified time frames.
B. For an extended period of time during the summer
months, the time to be agreed upon by the parties.
In the event the parties are unable to reach an
agreement for extended custody during the summer of
1995, either party may petition the Court to have the
case again scheduled for a conference with the Custody
Conciliator.
C. At such other times as the parties may agree and when
the Father is in the Pennsylvania or Maryland area and
the Father gives Mother adequate noti'cti',of request for

the present, she has resided at 138 East Liberty Avenue, carlisle,
Pennsylvania with her children Keosha, Tyrell MCGraw, age 3 1/2,
and Jamira Burse, age 2.
It was not until the fall of 1994 that Mr. Thompson became
interested in visiting with Keosha. For the first five years of
her life, Mr. Thompson, did not visit Keosha. Moreover, as of May
24, 1995, Mr. Thompson was over $7,000.00 in arrears with respect
to child support for Koosha. A copy of the computer printout from
the Cumberland County Domestic Relations Office verifying this is
attached hereto as Defendant's Exhibit No.1.
II. LBGAL PRINCIPLBS

A. primarv Care Giver in the Past
A parent's role as a child's primary caretaker may be
used as the determining factor by the court in determining custody.
Mumma v. Mumma, 380 Pa. Super. 18, 550 A.2d 1341 (1981). This
factor is used because courts recognize that children are strongly
attached to those who have tenderly cared for them. Commonwealth.
ex rel. Jordan, 302 Pa. Super 421, 448 A.2d 1113 (1982). !n this
particular case, Mr. Thompson has not rendered any primary care to

Keosha. Keo.ha'. emotional bond i. with Ms. McGraw, having lived
with her mother from December 1992 until the present. Mr. Thompson
has consistently demonstrated that he has either been unwilling or
unable to care for Keosha.
In R.A.R. v. T. M., 434 Pa. Super. 592, 644 A.2d 767
(1994), the superior Court noted that the primary consideration in
child custody cases is the best interests of the child. Part of
that analysis, the court held, was whether the parent was unwilling
or unable to care for the child. The record in R.A.R. v. T.M.,
reflected that the mother was unwilling or unable to care for the
child. In particular,
". . . from the end of August through January, 1993,
mother neither exercised her partial custody rights nor
contacted the child. . . Mother testified that she
suspended her exercise of partial custody because it was
too stressful for the child who feared that his grand-
mother would die when he was visiting his mother. . .The
trial court found and we agree, that mother could have
contacted the child during this period. II R. A. R. v.
1:J:L., suora., 644 A.2d 769.'
The court ultimately found that compelling circumstances
warranted the paternal grandfather to have custody of the child in
light of the mother's unwillingness and inability to care for the
child in his early years and the time spent in the grandfather's
custody. R.A.R. v. T.M., suora.

The facts of this case are analogous to R.A.R. V. T. M.,
In this instance, from the time Keosha was born in
December, 1989 until the fall of 1994, Mr. Thompson, did not
exercise his partial custody rights. For the first four and one-

half years of l<eosha's life, Mr. Thompson has consistently
demonstrated an unwillingness or inability to care for Keosha.
This Court should not take seriously Mr. Thompson's claim that he
now is willing and able to provide for l<eosha.
B. Custodv Arranqementa of siblings
Pennsylvania law is very clear thr.t absent clear and
convincing reasons to the contrary, siblings should be raised
together.
The Pennsylvania superior Court in Wiskoski v.
wiskoski, 427 Pa, super. 531, 629 A.2d 996 (1993) clearly conveyed
this law by stating:
"Absent compelling reasons to the contrary, it is
the policy of this Commonwealth that siblings should be
raised together whenever possib16. pilon V. Pilon, 342
Pa, Super. 52, 492 A.2d 59 (1985). 'The factor is not
diluted by the fact that the children involved are half
brothers and sisters.' In reo Davis, 502 Pa, 110, 124,
465 A.2d 614, 621 (1983). While this factor cannot be
elevated automatically above all other factors, it must
be waived in conjunction with the others. lsl. 'Good
reasons' are not necessarily "compelling" reasons for
disrupting the entirety of a family unit. pilon v.
Pilon, su\?ra. 'In defining the phrase "compelling
reasons" this court has said that the evidence must
indicate that it was "necessary" to separate the
children, and the evidence was "forceful" in this
regard.' Cyran v. Cvran, 389 Pa, Super. 128, 132, 566
A.2d 878, 880 (1989), citing Albriaht v. Commonwealth. ex
rel. Fetters, 491 Pa, 320, 421 A.2d 157 (1980). Absent
compelling reasons 'the children should be raised
together in one household, for this permits the
continuity and stability necessary for a young child's
development. Pilon v. Pilon, sUDra., 342 Pa, super. 56,
492 A.2d 60 (1985)." Wiskosti, sUDra, 629 A.2d 998.
If Mr. Thompson is granted primary residential custody of
l<eosha, it would disrupt a family until that has been well-
established.
Keosha currently lives with her brother, Tyrell

l<eosha currently lives with hor brother, Tyrell

McGraw/ born February 24/ 1992/ and her sister, Jamira Burse/ born
April 7/ 1993/ and has so lived with them since they were born.
Granting Mr. Thompson the reliet he seeks would certainly
cause the separation ot Keosha trom her two siblings. Mr. Thompson
has not raised compelling reasons why Keosha/s current household
should be split. As a result, this Court should deny Plaintit~'s
request tor primary physical custody of Keosha.
III. Conclusion
Because Ms. McGraw has been Keosha' s primary caregiver and
because Mr. Thompson has not presented any compelling reasons to
remove Keosha from her family unitt Defendant, Monique MCGraw,
respectfully requests this court to keep the primary residential
custody of Keosha with her.

3, The Plaintiff seeks custody of his minor child, Keosha
S. McGraw, age four yenrs, born December 2, 1989,
The child was born out of wedlock.
The child is presently in the custody of the Defendant
who resides at 50 Walnut Street, Carlisle, Cumberland County,
Pennsylvania.
During the pnst five years, or since the chlld's birth,
the child has resided with the Defendnnt,
The natural mother of the child Is Monlque E. McGraw-
Nash, the Defendunt, who currently resides at 50 Wnlnut Street,
Carlisle, Pennsylvania.
She Is married to Fred W, Nush.
The naturuJ. father of the child Is Rnymond Roosevelt
Thompson, IV, the Plnlntlff, who currently resides nt 908 S.W.
6th Street, Apartmeut '32, Lawton, Oklahoma.
He Is married to Zena G. Thompson.
4. The reLationship of the PLaLntlff to the child is that
of naturaL father. The PLaintLff currentLy resides with hLs
wife, Zena G. Thompson.
5. The relatLonshLp of the Defendant to the child is that
of naturaL mother. The Defendant currentLy resides with her
husband, Fred W. Nosh, nnd her three children; Keosha S. McGraw,
TyrelL P.S. McGraw and Jamirn R. Burse.
7. The Defendant has no information of a custody or
visitation proceed Lng concerning the chiLd pending in a Court
of this Commonwealth or of any other Court.
6. The Defendant, upon stipuLatLon by PlaintLff, has been
granted ,custody of the child, Keosha S. McGraw, by Order dated
March 13, L990 from the Court of Common Pleas of Cumberland
County, Pennsylvania to No. 970 Civil, 1990.
8. Th~ Defendant knows of no persons not a party td these
proceedings who claims to have custody or visitation rights
with respect to the child.
9. The best interest and permanent welfare of the child
will be served by granting the rellef requested because:

(a) Retaining the status quo will preserve the family
unit which currently exists thus providing a Buitable environ-
ment within which the child may continue to receive the
attention she needs.
(b) The child has thrived and developed well, both
physically and emotionally, under the custody of her primary

1) Petitioner, Raymond R. Thompson, IV, filed a canplaint for CUstody
on September 2, 1994. A Conciliation Conference was held on October 27, 1994.
2) At the time of the Conciliation Conference, Mr. Thompson and his
wife Zena G. Thompson were located in Lawton, Oklahorra. Mrs. Thompson, at that
I time, was on active duty with the military. Subsequent to that time, Mrs. ThalllOOn
has received an honorable discharge from the service allowing Mr. Thompson to locate
his residence to the Carlisle area.
3) It is anticipated that Mr. Thompson and his wife will have a
separate residence in the near future. At present, they are staying with his
relatives.
4) Mr. Thompson requests that consideration be given to granting him
pr.imary custody of his daughter, Keosha S. McCraw, due to his ability to provide a
stable and secure envirornnent for her upbringing. Attached hereto and incorporated
by reference is the original custody filing.

2. Defen:lant is Monique E. McGraw, an adult individual, currently
residirq at 210 Fern Avenue, carlisle, CUmberland County, Pennsylvania, 17013.
3. Plaintiff seeks custody of the following O1ild: Keosha S. McGraw,

Ilage 4 years, born 12/2/89.
! '!he child was born out of wedlock.
'!he child is presently in the custody of Defendant, who resides at 210
Fern Avenue, carlisle, CUmberland County, Pennsylvania.

of the att~chea-custody Conciliation Report, it i~ ordered and
directed as folloWSI
1. The Mother, Monique B. McGraw, and the Father, Raymond
Roosevelt Thompson, IV, shall enjoy shared legal custody
of Keosha S. McGraw born December 2, 1989.
2. 'l'he Mother shall enjoy primary physical custody of the
minor child.
3. The Father shall enjoy temporary physical custody of the
minor child as follows:
A. For at least one week over the Christmas holiday.
For the Christmas 1994 holiday, Father's time shall
be from December 26 at 9 A.M. until January 2 at
noon with the understanding that Father is exercising
this custody at Mother's home in Maryland. In the
event Father desires to take the child to Oklahoma,
the time frames may need to be modified and the
parties should attempt to reach an agreement on any
necessary modified time frames.
B. For an extended period of time during the summer
months, the time to be agreed upon by the parties.
In the event the partie. are unable to reach an
agreement for extended custody during the summer of
1995, either party may petition the Court to have the
case again sch~duled for a conference with the Cust~dy
Conciliator.
C. At such other times as the parties may agree and when
the Father is in the Pennsylvania or Maryland area and
the Father gives Mother adequate notice of request for
custody.
