RONALD M. MIXELL and JUDY Ie MIXELL, Defendants CIvn TERM 'I II 4 fql n (-(}..~L COMPLAINT AND NOW, comes Farmers Trust company, through its attorney, William A. Duncan, Esquire, and files this Complaint in Mortgage Foreclosure, of which the following is a statement: 1. Plaintiff is Farmers Trust company, a corporation organized and existing under the laws of the Commonwealth of pennsylvania with its main office and principal place of business located at 1 West High street, Carlisle, Cumberland County, Pennsylvania 17013. 2. Defendant, Ronald M. Mixell, an adult individual, and Defendant, Judy K. Mixell, an adult individual, are husband and wife, and reside 120 Hoy Road, Carlisle, cumberland county, Pennsylvania 17013. 3. On or about March 22, 1990, Defendants made, executed and delivered to Plaintiff a note and security agreement and a real estate mortgage financing One Hundred Forty Thousand Dollars and 00/100 ($140,000.00), a copy of said note and security agreement and said real estate mortgage being attached hereto as Exhibits "A" and "B", respectively, and are r....) incorporated herein by reference as though fully set fortll;; (... I... '-- (...J..) .LC- 4. Said note and security agreement and said real estate mortgage have not been assigned. 5. Ronald M. Mixell and Judy K. Mixell are the sole record owners in fee simple of said premises subject to said mortgage, by virtue of a Deed dated and recorded on March 22, 1990, and recorded in the Cumberland County Recorder's Office in Deed Book "L", Volume 34, Page 986, more specifically set forth in Exhibit "C", attached hereto and made a part hereof by reference. 6. Said note and security agreement and said real estate mortgage are in default because Defendants herein have failed to pay the payments that were due and owing for the months of July 1994 and August 1994. 7. The Plaintiff has given to the Defendants written notice of intention to foreclose on said mortgage as required by law under Act 6, dated July 25, 1994, a copy of which is marked Exhibits "D" and "E", and attached hereto and made a part hereof by reference. 8. By reason of the aforesaid default, the entire prinoipal balance of One Hundred Twenty-four Thousand Three Hundred Sixty-two Dollars and 44/100 ($124,362.44), with interest thereon at the rate of 9.81\ percent per annum computed from August 30, 1994, accruing insurance premium~, attorney's fees in the amount of six Thousand Two Hundred Eighteen Dollars and 12/100 ($6,218.12) are now due and payable. 9. The Defendants are liable to the Plaintiff for the following on said mortgage loan: A. Principal amount and interest due through August 30, 1994: B. Interest at 9.61\ from 6/30/94 to 09/01/94: TOTAL: $124,362.44 $ 99.33 $ 908.50 $ 6,218.12 $ 131,568.39 C. Late Charges: D. Attorney's Collection fee: WHEREFORE, Plaintiff prays the Court to enter jUdgment in favor of Plaintiff and to order the foreclosure and sale of the morgaged property and for the amount of One Hundred Thirty-One Thousand Five Hundred Eighty-eight Dollars and 39/100 ($131,588.39) Dollars together with interest thereon, costs and all other amounts advanced by Plaintiff. \J/~(Jij lLwA (~ William A.
