STIPUlATION AND AGREEMENT
THIS ST/PULA TION AND AGREEMENT entered into this~day of M ~ Y
1995, by and between DENNIS EDWARD GERKIN (hereinafter referred to as "Father") and
KARYN TERESA GERKIN (hereinafter referred to as "Mother").
NOW THIS AGREEMENT WITNESSETH THAT:
WHEREAS, the Father and Mother are the natural parents of two (2) children, namely,
Jamie M. Gerkin. born 1/12/81 and Emily N, Gerkin born 12/31/8S; and
WHEREAS, the Mother aRd Father have separated and have instituted divorce
proceedings at the above term and Rumber; and
WHEREAS, the parties wish to enter into an agreement relative to the custody, partial
custody and support of their children,

NOW, THEREFORE, in consideration of the mutual covenants, promises and agreements
u hereinafter set forth and intending to be legally bound, the parties hereto agree u follows:
1. The parties shall have shared legal custody of the child.
2. The parties shall have sh4l"ed physical custody of the children with the father's
periods uf temporary physical custody as follows:
a. every week day from after school until mother returns from work;
b. on alternating weeks, the children shall remain at the father's home until
after the dinner meal, and shall afterwards relurn to the mother's home;
c. every-other weekend from Friday after school until Sunday evening.
3. The Thanksgiving and Christmas holidays shall alternate between the parties, with
the non-custodial parent to enjoy custody either the day before, or the day after, or as mutually
agreed upon between the parties.
4. The parties shall alternate the remaining holidays, including New Years, Easter,
Memorial Day, July 4TH. and Labor, however, shall consider the preference of the children when
scheduling said holidays,
S. Each party shall have a period of consecutive days with the children to
accommodate each party's vacation schedule; each party shall notii}' the other party of said

vacation time within a reasonable period of tlme, notlen than thirty (30) days.
6. Support of the minor children shall be as follows:
a. Father shall pay 10 mol her Three Hundred and nollOO (5300.00) Dollars
per month;
b. Uncovered medical expenses shall be shared equally between the panies;
c. Mother shall maintain health insurance coverage on the minor children;
d. All expenses associated with school activities, sporting activities or social
activities shall be shared equally between the panies.
7. The parties will keep each other advised immediately relative to any emergencies
conceming the children and shall further take any necessary steps to ensure that the health,
welfare and well being of the children is protected,
8. The parties shall do Rothing that may estrange the children from the other natural
development of the child's love or affection for the other party.
9. Both parties shall have reasonable telephone contact with the children during periods
when the other parent is exercising physical custody,
10, Any modification or waiver of any of Ihe provisions of this agreement shall be
effective only if made in writing and only if executed with the same fonnality of this agreement.

2. The defendant Is Karyn Teresa Gerkin, an adult individual residing at 1027 Hemlock
Lane, Enoll, Cumberland County. Pennsylvania 17025.
3. The plaintiff has been a resident of the Commonwealth of Pennsylvania at least sl"
months prior to the filing of this action in divorce.
4, The plaintiff and the defendant were married on March 5, 1977 In Baltimore,
Maryland.
5. Two children were born of this marriage: Jamie M. Gerkin, born 1/12/81 and
Emily N. Gerkin born 12131185.
6. Pursuant to the Divorce Code, Section 3301(c), the plaintiff avers as the grounds upon
which this action is based that the marriage between the parties is irretrievably broken.
7. The plaintiff avers that he has been advised of the availability of counseling and that
said party has the right to request that the court require the parties to participate in counseling.
