COMPLAINT
1. Plaintiff Antonio L. McClenton, is an adult individual
residing at 408A Essex Streot, Bressler, Dauphin County,
Pennsylvania 17113.
2. The Defendant Giant Foods Stores, Inc. is a Pennsylvania
Corporation with a current address of Route 11 and Shady Lane,
Carlisle, Pennsylvania 17013.
3. The facts and occurrences hereinafter related took place
on or about September 6, 1992 at the premises owned and/or operated
by the Defendant Giant Food Stores, Inc. located at 3025 Market
Street, Camp Hill, Camp Hill Borough, Cumberland County,
Pennsylvania.
4. At all times material to this Complaint that Plaintiff,
Antonio L. McClenton was employed by Coca-Cola Enterprises, Inc.
and in that capacity he was a merchandiser.
5. At the aforesaid time and place, Plaintiff, Antonio L.
McClenton was a business invitee of Defendant, Giant Food Store~,
Inc.
6. On the date in queBtion Plaintiff, Antonio L. McClenton
was servicing the Giant Food Store, located at 3025 Market Street,
Camp Hill, Pennsylvania, and the merchandhin9 inventory consisting
of a display of bottles of Cooa-Cola, when the bottleB and crates
of Coca-Cola fell on top of him causing him to be knocked down and
therefore, causing the following injurieBI
a) Torn ligamentB in the right h~ndl and
b) Fractured boneB in the right handl
causing him serious disfigurement and permanent impairment as far
as lifting, pushing, and pulling goeB,
7. As a direct an proximate result of the aforementioned
defective and/or dangerous condition of the display at the
Defendant's property Plaintiff was injured and fell onto the floor
of said food store.
8. At all times material hereto Plaintiff, Antonio L.
McClenton acted in a careful, cautious, reasonable and prudent
manner and was free from any comparative negligence.
9. At all times material hereto, Plaintiffr Antonio L.
McClenton was free from any comparative negligence and did not in
any manner assume the risk of injury and/or accident.
10. The aforementioned incident and resulting injuri as and/or
damagos were due in no part whatsoever to any act or failure to act
on the part of Plaintiff.
11. The aforementioned incident and the resulting injuries
and/or damages sustained by Plaintiffr Antonio L. McClenton

direotly and proximately resulted from the neqliqence,
careleasness, recklessness and/or unlawfulness of Defendants whioh
allowed or oaused to allow the display to bo construoted and
maintained as follows I
(a) Failure to have displays properly maintained and
secured;
(b) Failure to design the display in the Defendants
place of business to prevent creating a hazardous
and/or dangerous condition;
(e) Displaying merchandise in such a manner that it
would injure a business invitee;
(d) Failure to inspect, maintain and clean the area of
the aforementioned accident in a reasonable and
prudent manner;
(e) Permitted and allowing business invitees to walk in
and about the area of the aforementioned accident
when said Defendants knew or should have known of
the dangerous condition which then exieted;
( f) Failed to post adequate warning signs, barriere
and/or barricades in an effort to alert business
invitees of the dangerous condition which exieted;
(g) Failed to issue any warning, verbal, written,
actual and/or constructive to business inviteee of
the dangerous condition which existed in or around

the display or floor area of the Plaintiff'.

(h) Pailed to regard the rights, safety and position of
the Plaintiff in and about the area of the
aforementioned accident,
(i) Allowed to have displays on or about the floor
where the Defendants knew or should have known that
business invitees would be shopping or ambulating,
(j) Otherwise were negligent, careless, reckless and/or
unlawful under the circumstances; and
(k) Allowed its employees and agents etc to access the
display racks and to remove bottles in such a way
to cause a dangerous condition; and
( 1) Failed to train its employees and agents in the
proper maintenance of said merchandise.
12. The Defendant's negligence, carelessness, recklessness
and/or unlawfulness also consist of, but was not limited to, the
followingl
(a)
(b)
Hired, employed and/or promoted the various agents,
seI'Vants, workmen and/or employees who had the
responsibility and obligation to properly inspect,
maintain and safeguard the area of the
aforementioned accident,
Permitted the various agents, servants, wormen
and/or employees who had the responsibility and
obligation to inspect, maintain and/or safeguard

the area of the aforementioned acoidentr to
continue to work as agents, servants, workmen
and/or employees r when said corporate Defendant
knew and/or should have known that said agents,
servants, workmen and/or employees were unable to
and/or incapable of properly performing the
requirements of their respective employments,
(cl Failed to establish procedures and programs to
determine whether employees and/or potential
employees were and/or are fit and capable of
properly performing the requirements of their
respective employment, and
(d) Otherwise were negligent, careless, reckless and/or
unlawful under the circumstances in the hiring,
employing and/or promoting the various agents,
servants, workmen and/or employees who were
responsible and obligated to properly inspect,
maintain and safeguard the area of the
aforementioned accident.
13. As a result of his injuries, Plaintiff Antonio L.
MoClenton has undergone in the past and will in the future continue
to undergo great pain, suffering and disfigurement.
14. As a result of his injuries, Plaintiff Antonio L.
McClenton has suffered a permanent disability, loss of wages, and
a permanent impairment of his earning power and capacity.

15. AI a rosult of hil injuries, Plaintiff Antonio L.
McClenton hal sustained a permanent diminution in the ability to
enjoy life and life's pleasures.
16. As a result of hls injuries Plaintiff Antonio L.
McClenton has sustained permanent scaring and disfigurement and
humiliation.
17. As a result of his injuries the Plaintiff Antonio L.
McClenton has incurred medical expenses and will continue to need
supplies in the future and a claim is made therefore.
WHEREFORE, Plaintiff Antonio L. McClenton demands judgment of
the Defendant Giant L. McClenton in an amount 1n excess of Twenty
Thousand and 00/100 ($20rOOO) Dollars and in excess of the amount

requiring compulsory arbitration.

COMPLAINT
1. plaintiff Antonio L. McClenton, is an adult individual
residing at 408A Essex Street, Bressler, Dauphin County,
Pennsylvania 17113,
2, The Defendant Giant Foods Stores, Inc. is a Pennsylvania
Corporation with a current address of Route 11 and Shady Lane,
Carlisle, Pennsylvania 17013.
3. The facts and occurrences hereinafter related took place
on or about September 6, 1992 at the premises owned and/or operated
by the Defendant Giant Food Stores, Inc. located at 3025 Market
Street, Camp Hill, Camp lIill Borough, Cumberland County,
Pennsylvania.
4, At all times material to this Complaint that Plaintiffr
Antonio L. McClenton was employed by Coca-Cola Enterprises, Inc,
and in that capacity he was a merchandiRer,
5. At the aforesaid time and place, Plaintiff, Antonio L,
McClenton was a business invitee of Defendant, Giant Food Stores,
Inc.
6, On the date in question Plaintiff, Antonio L. McClenton
was servicing the Giant Food Store, located at 3025 Market Street,
ClIJJ\p Hill, Pennsylvania, and the merchandising inventory consisting
of a display of bottles of Coca-Cola, when the bottles and crates
of Coca-Cola fell on top of him causing him to be knocked down and
therefore, causing the following injuries I
a) Torn l.igaments in the right hand, and
b) Fractured bones in the right hand,
causing him serious disfigurement and permanent impairment as far
as lifting, pushing, and pulling goes.
7, As a direct an proximate result of the aforementioned
defective and/or dangerous condition of the display at the
Defendant's property Plaintiff was injured and fell onto the floor
of said food store.
S. At all times material hereto Plaintiff, Antonio L.
McClenton acted in a careful, cautious, reasonable and prudent
manner and was free from any comparative negligence.
9. At all times material hereto, Plaintiff, Antonio L.
McClenton was free from any compa,rative negligence and did not in
any manner assume the risk of injury and/or accident.
10. The aforementioned incident and resulting injuries and/or
damages were due in no part whatsoever to any act or failure to act
on the part of Plaintiff,
11. The aforementioned incident and the resulting injuries
and/or damages sustained by Plaintiff, Antonio L. McClenton

directly and proximately resulted from the neqliqence,
carelessness, recklessness and/or unlawfulness of Defendants whioh
allowed or caused to allow the display to be constructed and
maintained as follows I
(a) Failure to have displaytl properly maintained and
secured;
(b) Failure to design the display in the Defendants
place of business to prevent creating a hazardous
and/or dangerous condition;
(c) Displaying merchandise in such a manner that it
would injure a business invitee;
(d) Failure to inspect, maintain and clean the area of
the aforementioned accident in a reasonable and
prudont manner;
(e) Permitted and allowing business invitees to walk in
and about the area of the aforementioned accident
when said Defendants knew or should have known of
the dangerous condition which then existed;
(f) Failed to post adequate warning signs r barriers
and/or barricades in an effort to alert business
invitees of the dangerous condition which existed;
(g) Failed to issue any warning, verbal, written,
actual and/or constructive to business invitees of
the dangerous condition which existed in or around

the display or floor area of the Plaintiff's
aforementioned accident,
(h) Failed to regard tho rights, safety and position of
the Plaintiff in and about the area of the
aforementioned accident,
(i) Allowed to have displays on or about the floor
where the Defendants knew or should have known that
business invitees would be shopping or ambulating;
(j) Otherwise were negligent, careless, reckless and/or
unlawful under the circumstances, and
(k) Allowed its employees and agents etc to access the
display racks and to remove bottles in such a way
to cause a dangerous condition; and
(1) Failed to train its employees and agents in the
proper maintenance of said merchandise.
12. The Defendant's negligence, carelessness, recklessness
and/or unlawfulness also consist of, but was not limited to, the
following I
(a)
(b)
Hired, employed and/or promoted the various agents,
servants, workmen and/or employees who had the
responsibility and obligation to properly inspect,
maintain and safeguard the area of the
aforementioned accident;
Permitted the various agents, servants, workmen
and/or employees who had the responsibility and
obligation to inspect, maintain and/or safeguard

the area of the aforementioned accident, to
continue to work as agents, ser.vants, workmen
and/or employees, when said corporate Defendant
knew and/or should have known that said agents,
servants, workmen and/or employees were unable to
and/or incapable of properly performing the
requirements of their respective employments;
(c) Failed to establish procedures and programs to
determine whether employees and/or potential
employees were and/or are fit and capable of
properly performing the requirements of their
respective employment; and
(d) Qtherwise were negligent, careless, reckless and/or
unlawful under the circumstances in the hiring,
employing and/or promoting the various agents,
servants, workmen and/or employees who were
responsible and obligated to properly inspect,
maintain and safeguard the area of the
aforementioned accident.
13. As a result of his injuries, ~laintiff Antonio L.
McClenton has undergone in the past and will in the future continue
to undergo great pain, suffering and disfigurement.
14, As a result of his injuries, Plaintiff Antonio L.
McClenton has suffered a permanent disability, loss of wages, and
a permanent impairment of his earning power and capacity,

DEFENDANT'S MOTION TO COMPEL DISCOVERY
I. Plaintilrtiled his Complaint on or about March 27. 1995 whereby he alleged that he
was injured in the Defendant's grocery store on September 6. 1992.
2. Plaintitl' contends that while in the scope of his employment delivering Coca-Cola.
a display of bottles of Coca-Cola fell on him causing personal injuries. including a lractured right
hand
3. On or about April II. 1995, the Defendant served Plaintitl. with interrogatories
designed to determine the nature of Plaintil}" s claims.
4. By letter dated April 20, 1995, defense counsel advised PlaintilT that the answers to
interrogatories were needed prior to the date of the deposition of Plaintilr (See letter of April 20,
1995 attached as Exhibit "A".) The Defendant also requested that the deposition be promptly
scheduled,
5, Delendant's counsel again wrote to Plaintill's counsel on May 24. 1995 again
requesting the answers to interrogatories.
6. By letter of June 9. 1995 and with prior agreement of Plaintilrs counsel, the
deposition of PlaintilT was set lor August 8, 1995 beginning at 2:00 p.m. At the time of sending that
deposition notice. defense counsel again reminded Plaintitl's counsel regarding the answers to
interrogatories. (A copy of that June 9, 1995 letter to Plaintill's counsel is hereby attached as
Exhibit "B".)
7. Defense counsel again called Plaintill's counsel ollice on July 18, 1995. but
Plaintitl's counsel was not available. In speaking with Plaintill"s counsel's paralegal, delense
counsel was advised that she could not provide any time lrame or guarantee that the answers to
interrogatories would be provided prior to the deposition scheduled for Tuesday. August 9, 1995.
