COMPLAINT
1. 'l'he Plaintiff is HARRIS SAVINGS BANK, which formerly was
Harris Savings Association and formerly thereto The Harris Savings
Association, a corporation organized and existing under the laws
of the State of Pennsylvania and having its principal place of
business at Second and Pine Streets, Harrisburg, Pennsylvania,
17101.
2. The Defendant is DENNIS A. SEALOVER, an adult individual,
residing at 3937 Drookridge Drive, Mechanicsburg, Pennsylvania,
17055.
3. Defendant, on November 5, 1990, entered into a mortgage
loan indenture with The ,Harris Savings Association, now HARRIS
SAVINGS BANK, in the principal amount of THIR'fY-SEVEN THOUSAND
nOLLARS and 00/100 ($37,000.00), the terms of which loan are more
specifically evidenced and set forth in the mortgage indenture
dated November 5, 1990, and recorded on November 8, 1990, in the
Cumberland County Recorder's Office in Mortgage Book I 31, Page
1012, a copy of which is attached hereto, marked Exhibit "A", and
made a part hereof by reference, which mortgage contains and is a
lien upon the property situate at 3937 Brookridge Drive,
Mechanicsburg, Hampden Township, Cumberland County, Pennsylvania,
17055, being improved upon with a dwelling.
4. tiaid loan was further evidenced and secured by a note
which accompanied said mortgage dated November 5, 1990, a copy of
which is attached hereto, marked Exhibit "B", and made a part
hereof by reference.
5. 'I'he lIarris Savings Association, now BarriE Savings Bank,
in consideration of the said mortgage and accompanying note,
advanced to Dennis A. Sealover the sum of THIRTY-SIX THOUSAND FIVE
HUNDRED DOLLARS and 00/100 ($36,500.00).
6. 'I'he premises subject to said mortgage is more
specifically set forth in Exhibit "A", attached hereto and made a
part hereof by reference.
7. Dennis A. Sealover is the sole owner of the said premises
contained in said mortgage.
8. Said mortgage and note have not been assigned in whole
or in part by the Plaintiff herein.
9. Dennis A. Sealover is the record owner in fee simple of
said premises by virtue of a Deed dated June 6, 1985 and recorded
in the Cumberland County Recorder's Office in Deed Book 1-31, Page
1012.
10, No judgment has previously been entered on said mortgage
or note in any Jurisdiction, and said instruments are less than
twenty (20) years old.
11. The said mortgage is in default because Defendant herein
has failed to pay the monthly payment of $256.00 that was due and
owing for the month of February, 1994, $224.00 that was due and
owing for the month of March, 1994, $248.00 that was due and owing
for the month of April, 1994, $224.00 tl~t waa due and owing for
the month of May, 1994, $271.50 that was due and owing for the
month of June, 1994, $262.50 that was due and owing for the month
of July, 1994.
12. The Plaintiff has given to the Defendant written notice
of intention to foreclose on said mortgage as required by law under
Act 6, dated May 31, 1994, a copy of which is marked Exhibit "Cn,
and attached hereto and made a part hereof by reference.
13. 'l'he Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983, dated
May 31, 1994, a copy of which is marked Exhibit "0", and attached
hereto and made a part hereof by reference.
14. The entire principal amount of THIRTY-6IX THOUSAND FIVE
HUNDRED DOLLARS and 00/100 ($36,500.00) has become due and payable,
together with interest at the present rate of 9.25% per annum which
adjusts, reasonable legal fees for collection of said sum in
accordance with the terms of said mortgage less such sums as have
been paid on account of principal of the said mortgage and costs.
15. The Plaintiff believes and therefore avers that
reasonable legal fees for collection is $1,825.00.
16. The Defendant is liable to the Plaintiff for interest at
the present rate of 9.25% per annum which adjusts until paid, late
charges, property taxes and expenses as provided in and collectible
under the mortgage documents that will accrue until distribution
by the Sheriff of Cumberland County, Pennsylvania, to be computed
at the time of judgment in these proceedings in addition to the
current loan balance.
17. The Defendant is liable to the Plaintiff for the
following on said mortgage loanl
A. Principal amount and interest
due through 8/31/941 ~ 38,411. 50
n. Interest at the present rate of
9.25% from 9/1/94 to 4/7/951 ~ 2,025.75
C. Late Charges 1 ~ 135.70
D. Attorney's Collection Feel ~ 1,825.00
TOTAL 1 ~ 42,397.95
18. 'l'he Plaintiff believes and avers that neither of the
Defendants are members of the armed forces or are in the military
service of the United States of America.
WHEREFORE, the Plaintiff prays the Court to enter Judgment
against the Defendant, DENNIS A, SEALOVER, of Mortgage Foreclosure
against and sale of the mortgaged property, with damages in the
amount of FORTY TWO THOUSAND 'l'HREE HUNDRED NINETY SEVEN DOLLf'RS and
95/100 (~42,397.95), together with additional interest thereon,
costs and all other amounts advanced by Plaintiff.
