On or about May 2, 1994 at 11:05 a.m. Lower Allen Township Police entered the apartment at 2200-8 Cedar Run Drive Extsnded, in order to serve a parole warrant on a Guist Waller, who is not a signatory to this lease, and who was, at the time living with defendant without authorization from plaintiff. 6. In the apartment, the police found another person, Robert Smith, a fugitive from justice who was hiding at the said apartment from police, he being wanted by the Harrisburg Police Department on a warrant for homicide. 7. While in the said apartment, the police discovered a safe, in which they found illegal drugs, to wit: cocaine, and from elsewhere in the apartment, the police found and confiscated marijuana, a pistol, crossbow, cellular telephone and a pager. S. The possession of any or all of the items listed in paragraph 7 infra, is either illegal or they are normally used in illegal drug activity. 9. Paragraph l3( a) of the aforementioned lease agreement provides that, .tenant shall use and occupy the premises exclusively as a private dwelling for tenant and family and for no other purpose, and only during such time as tenant may be eligible. . ,tenant shall not... give accolnmodation to boarders or lodgers, whether paying or not, without written consent of landlord.... 10. By harboring Guist Waller and Robart Smith, both fugitives from justice, defendant violated the express terms of her lease agreement, 11. Paragraph 13( c) of the said lease agreement provides that "Notwi thstanding any other provision of this lease, the Tenant, members of Tenant's household, gueats of Tenant and other persons under Tenant I s control shall not engage in unlawful activity, including drug related criminal activity, in the tenant's unit or on the project premises.,." 12. The unlawful possession of cocaine, marijuana on the premises ia in fact, drug related illegal criminal activity, which ia prohibited by the lease agreement. 13, Paragraph 23 of the said lease permits Landlord to evict Tenant for any material non-compliance with the terms thereof, and for tenant; s failure to carry out obligations under any state Landlord and Tenant Act. 14. Accordingly, by Notice dated May 18, 1994 plaintiff gave notice to tenant that tenant must quit and vacate the apartment unit at 2200-S Cedar Run Drive Extended on or before June 18, 1994. A copy of said notice is attached hereto, incorporated herein by reference and marked Exhibit "S", 15. Defendant has failed or refused to vacate the premises pursuant to said notice.
