COMPLAINT
AND NOW COMES Plaintiff, George R, Moffitt, Jr" M.D" by
his attorneys, steven J. Schiffman, Esquire and Gary L.
Rothschild, Esquire, and the law firm of Serratelli, Schiffman
and Brown, P.C, who file this Complaint and aver as follows:
1, Plaintiff, George R, Moffitt, Jr., M,D" is an adult
individual with a current address of 598 Moores Mountain Road,
Mechanicsburg, Cumberland County, Pennsylvania 17055,
2, Defendant, Darren J, Footitt, is an adult individual
with a current address of 30 White Dogwood Drive, Etters,
Cumberland County, Pennsylvania 17319,
3. On or about July 3, 1993, Plaintiff and Defendant
entered into an oral agreement whereby Defendant borrowed
$17,063,00 from Plaintiff to enable Defendant to purchase a 1991
Toyota automobile,
4, Defendant purchased a 1991 Toyota automobile, Title
Number 43342088803 FO, Vehicle Identification Number
JT2SW22N6M0011255, using the $17,063,00 loan from Plaintiff to
accomplish the purchase. (A copy of Plaintiff's check number
145, in the amount of $17,063,00 is attached as Exhibit "A".)
5. Under the terms ot the oral agreement between Plaintitt
and Detendant, Detendant agreed to make torty-eight (48) monthly
payment., in the amount ot $402,81 per month, commencing Augu.t
1, 1993.
6, Interest to be accrued on the loan was agreed to be at
the rate ot eight percent (8') per annum,
7. On August 9, 1993 Detendant made a payment in the amount
of $402,81. Defendant made a payment of $900,00 in October,
1993, a $300,00 payment in November, 1993 and a payment ot
$400,00 on or about June 1, 1994 toward the unpaid balance,
Defendant ha. made no other payments,
8, On September 1, 1994 there was a balance due and owing
to the Plaintiff by the Detendant in the amount ot $15,948,58
including interest as ot that date,
9, Atter numerous requests to pay the outstanding balance,
the Defendant has tailed to pay the Plaintiff the balance ot the
amount due, in the amount of $15,948,58 tor the loan and intere.t
~utstanding,
WHEREFORE, Plaintiff demands judgment against Defendant in
the amount of $15,948,58, plus interest at 8' until the date ot
judgment and costs ot this action, said amount being within the
juri.dictional limit tor compulsory arbitration,

10, The averments of paragraphs one through nine af
plaintiff'S Complaint are hereby incorporated by reference as if
fully set forth herein,
11, On or about october 23, 1993 Defendant entered into a
contract with Town sound of York, Pennaylvania, to purchase an
audio sound system for a total sale price of $2,398,85, (A copy
of the Security Agreement is attached as Exhibit "B"), An
initial cash payment of $198,65 is reflected on the agreement
leaving a balance due of $2,200.20,
12, Defendant has possession of the audio sound system,
13, The agreement listed Plaintiff as well as Defendant as
a Buyer of the sound system,
14, The agreement, evidencing Defendant's purchase of the
audio sound syatem, contained a signature allegedly that of
Plaintiff,
15, plaintiff did not sign the agreement referred to in
Paragraph 14 and the signature, appearing as plaintiff'S, was
signed without plaintiff's knowledge and consent,
16, The monthly payments required by the agreement became
delinquent.
17, Due to Defendant's failure to make the required monthly
payments, Plaintiff has paid numerous monthly installments due
under the agreement,
