COMPLAM
1. The plaintiff, Cathy L. Zellem, Is an Individual residing at 149
South York Road, Dillsburg, York County, Pennsylvania,
2. The defendant, Abram Hess Brubaker, Is an individual residing at
501 Pine Meadow Drive, Mechanlcsburg, Cumberland County, Pennsylvania.
3, At or about 9:30 A,M, on October 5, 1993, the plaintiff was
operating a 1988 Oldsmobile, and was in a stopped position, waiting to turn left,
on Pa, Route 114 in Upper Allen TOWll5hip, Cum1>erland County, Pennsylvania,
near the Book-of-the-Month Club,
4, At or about the same time, the defendant was operating a 1988
Subaru behind the said 1988 Oldsmobile,
5. The defendant rearended the said 1988 Oldsmobile, with such force
that the driver's seat was broken off, and the car was totally destroyed,
6. The collision was caused by the negligence of the defendant in the
following respects:
(a) in following too closely, and
(b) in failing to have his 1988 Subaru under control.
7. As a result of the negligence of the defendant, the plaintiff
sustained a cervical injury, commonly known as a whiplash injury, myofascitis,
and muscle con\raction headaches.
8. As a result of the aforesaid injuries, the plaintiff was unable to
return to her place of employment at National RX, a pharmacy in
Mechanicsburg, Pa.
9. The plaintiff returned to her aforesaid position at National RX, and
worked In pain, but has since had to cease working, due to the extreme pain,
10, As a result of the aforesaid injuries, the plaintiff has undergone
pain and suffering, and will undergo pain and suffering In the future,
11. As a result of the aforesaid injuries, the plaintiff has sustained a loss
of income, and an impairment of her earning capacity.
