TO THE HONORABLE, THE JUDGES OF THE SAID COURT I
AND NOW comes the Plaintiff/Petitioner, Wasyl Kadenko, by and
through his counsel, Shumaker Williams, P.C., who respectfully
files this Petition for Rule to Ameud Complaint and in support
thereof avers as follows:
1. Wasyl Kadenko is the Petitioner in this matter and the
Plaintiff in the above-captioned case.
2.
Petitioner
filed
a
complaint
against
the
Defendant/Respondent, Morgan Hughes, before District Justice Ronald
Klair on or about July 28, 1994.
3. Al though the date and time of the hearing were served
upon the Respondent, Morgan Hughes, he did not appear at the civil
trial and thus, a judgment was entered on behalf of the Petitioner
in th~ amount of $3,333.
4. Respondent tiled a timely appeal from the District
Justice judgment and the Petitioner filed a timely Complaint on or
about October 31, 1994.
5. Petitl.oner's Complaint alleged among other things that he
had entered into an employment contract with the Respondent whereby
the Respondent would pay Petitioner $10 an hour for work performed
on a residenoe located at 44 Grange Avenue, Mechanicsburg,
Pennsylvania. petitioner's Complaint also alleged that the
Petitioner pertormed ninety-one (91) hours of worlt on 44 Grange
Avenue, Mechanicsburg, Pennsylvania for the Respondent and the
Respondent failed to compensate the Petitioner.
6. Respondent filed an Answer indicating that he never
entered into an employment contract or otherwise with the
Petitioner and moreover, that he did not have any ownership
interest on 44 Grange Avenue, Mechanicsburg, Pennsylvania, the
house upon which the Petitioner worked.
7. As a result of the Respondent's Answer, the Petitioner
sent Respondent Interrogatories inquiring as to who hired or
requested the Petitioner to work on the property located at 44
Grange Avenue, who supplied materials to the Petitioner to work on
the property at 44 Grange Avenue and furthermore, and who paid the
Petitioner for prior work done at 44 Grange Avenue.
8. Respondent's answers to these inquiries indicated that
Williams Grove, Inc. supplied materials to the Petitioner and owned
the property located at 44 Grange Avenue. Furthermore, the Answers
to Interrogatories indicated that the Respondent is the President
of Williams Grov3, Inc. and that Williams Grove, Inc. had paid
Petitioner for prior work done at 44 Grang~ Avenue. Copies of the

televant Answers to Interrogatories are attaohed hereto as
Petitioner's Exhibit No.1.
9. Patitioner wishes to amend his complaint to include
Williams Grove, Inc. as a party defendant and to allege the
following counts with respect to Williams Grove, Inc.l
(A) Count I - Breach of Employment Contract
(B) Count II - Violation of Title 43 P.S. 5261.1, ~
ug., Wage Payment and Collection Law, seeking liquidated
damages, attorneys' fees, costs and interest.
10. The statute of Limitations for these proposed claims has
not run with respect to Williams Grove, Inc..
11. The original party Respondent, Morgan Hughes, will not be
unfairly prejudiced by this Amendment of the pleading.
WHEREFORE, Petitioner respectfully requests this Court to
issue a Rule upon the Respondent to show cause why the Complaint
heretofore filed in the above-captioned case should not be amended
as set forth above.

2. The Defendant is MORGAN HUGHES, an adult individual with
an address of 1 Park Place Drive, Mechanicsburg, Cumberland County,
Pennsylvania 17055.

3. On or about June 24, 1993, Plaintiff and Defendant
entered into an oral employment contract whereby the Defendant
would pay the Plaintiff $10.00 an hour for work performed by
Plaintiff for Defendant.
4. On June 2, 1994, the Plaintiff and Defendant terminated
their employment relationship.
5. At the time of the termination of their employment
relationship, the Defendant owed the Plaintiff for ninety-one (91)
hours of work. The Plaintiff has requested payment for services
rendered and the Defendant has refused to render payment.
WHEREFORE, the Plaintiff resp.ctfully r.quests this Court to
enter jUdqm.nt in his favor of $910.00 plus interest and costs.

the D.f.ndant would only oharge the Plaintiff $250.00 per month for

9. Th. Plaintiff sp.nt $960.00 for a septic tank that was
inst.ll.d in the D.fendant's residence on December 29, 1993. The
D.fendant has not been compensat6ld by the Plaintiff for this
purch....
10. Moreover, the Plaintiff bought numerous electrical,
rootin9, plumbing and building materials totalling $961.44. TheBe
.ateri.ls w.r. us.d to repair the Defendant's property located at

6. On June 2, 1994, the Plaintiff and Defendant Hughes
terminated their employment relationship.
7. At the time of termination of their employment
relationship, Defendant Hughes owed the Plaintiff tor ninety-one
(91) hours of work. The Plaintiff has requested payment tor
services rendered and the Defendant has refused to render payment.
WHEREFORE, Plaintiff respect tully requests thie Honorable
Court to enter judgment in his favor in the amount of $910.00 plus
interest and costs.
Count II

8. Paragraphs 1 through 7 above are incorporated herein by

9. In November, 1993, Plaintiff and Defendant Hughes entered
into another oral contract whereby the Plaintiff would do work on
a house owned by Defendant Hughes located at 44 Grange Avenue,
Mechanicsburg, cumb$rland County, Pennsylvania 17055.
10. The agreement entered into between the Plaintitt and
DRfendant Hughes called for the Plaintiff to physically repair and
improve the house located at 44 Grange Avenue. The Defendant was
to buy all the materials. In exchange for the work done by the
Plaintiff, Defendant Hughes would only charge the Plaintiff $250.00
per month for rent.

11. The Plaintiff spent $960.00 for a septic tank that was
installed in Defendant Hughes' residence on December 29, 1993. The
Plaintiff has not been compensated by Defendant HUghes for this
purchase.
12. Moreover, the Plaintiff bought numerous electrical,
roofing, plumbing, and building materials totalling $961. 44. These
materials were used to repair Defendant Hughes' property located at
44 Grange Avenue. Plaintiff has not been reimbursed for monies he
spent on these supplies.
WHEREFORE, Plaintiff respectfully requests this Court to grant
judgment in its favor tor $1,921.^4 plus interest and costs.
Count III
Breach of Contract - Williams Grove. Inc.
13. On or about June 24, 1993, Plaintiff and Defendant
Williams Grove, Inc. entered into an oral employment contract
whereby the Defendant would pay the Plaintiff $10.00 an hour for
work performed by Plaintiff for Defendant Williams Grove, Inc.
14. On June 2, 1994, the Plaintiff and Defendant Williams
Grove, Inc. terminated their employment relationShip.
15. At the time of termination of their employment

employ of Defendant Williams Grove, Inc. constitute "wages" as
defined in the Pennsylvania Wage Payment and Collection Law.
23. Defendant Williams Grove, Inc. still has not made full
payment of all "wages" due and owing to Plaintiff Kadenko as
provided under 43 P.S. ~260.1, n ~.
24. Defendant Williams Grove, Inc. has violated and continues
to violate the provisions of the Wage Payment and Collection Law.
25. Plaintiff Kadenko is entitled to payment from Defendant
Williams Grove, Inc. for wages and benefits that remain owing as
well as liquidated damages and reasonable attorneys' fees "of any
nature" as provided for under 43 P.S. ~~260.9a and 260.10.
WHEREFORE, Plaintift Wasyl Kadenko respectfully requests this
Court to enter judgment against Defendant Williams Grove, Inc. and

Payment and Collection Law, 43 P.S. 5260.1, ~ ug.
29. The monies earned by Plaintitf Kadenko while in the
employ of either Hughes or Williams Grove, Inc. constitute "wages"
as detined in the Pennsylvania Wage Payment and Collection Law.
30. Defendant Morgan Hughes still has not made full payment
of all "wages" due and owing to Plaintiff Kadenko as provided under
43 P.S. ~260.1, n ug.
31. Defendant Morgan Hughes has violated and continues to
violate the provisions ot the Wage Payment and Collection Law.
32. Plaintiff Kadenko is entitled to payment from Detendant
Hughes for wages and benefits that remain owing as well as

1. On October 31, 1994, the Plaintiff filed a Complaint
against Defendant Morgan Hughes alleging two counts of breach of
contract.
2. On November 9, 1994, Defendant Morgan Hughes filed an
Answer to the Plaintiff's Complaint.
3. On June 6, 1995, the Plaintiff filed a Petition for Rule
to Amend Complaint.
4. On June 8, 1995, a Rule was issued upon the Defendant
Morgan Hughes to show cause why the Complaint filed should not be
amended to include williams Grove, Inc. as a party Defendant and

to allege the following counts against williams Grove, Inc.: (1)
Breach of Employment Contract; (2) Violation of Title 43 P.S.
Section 261.1, et seq.
5. On June 15, 1995, Defendant Morgan Hughes filed an
Answer and New Matter objecting to the Plaintiff's request to
amend his Complaint.
6. On September 12, 1995, the Plaintiff filed his Amended
Complaint in which he added Williams Grove, Inc. as a party
defendant alleging against it two Counts of Breach of Contract
and one Count of violation of Title 43 Y.S. Section 261.1, et
seq. as prayed for in his petition for Rule to Amend Complaint,
and in Count VI of which he added an additional Count against

AND NOW comes the plaintitt/Petitioner, Wasyl Kadenko, by and
through his counsel, Shumaker Williams, P.C., who respectfully
tiles this Petition to File a Second Amended Complaint and in
support thereot avers as follows:
1. Wasyl Kadenko is the Petitioner in this matter and the
Plaintitt in the above-captioned case.
2. Mor.gan Hughes is the Respondent in this matter and
Defendant in the above-captioned case.
3. Petitioner filed a Complaint against Respondent, Morgan
Hughes, before District Justice Ronald Klair on or about July 28,
1994.
4. Although the date and time of the hearing were served
upon the Respondent, Morgan Hughes did not appear at the civil
trial and thus, a judgment was entered on behalf of the Petitioner
in the amount of $3,333.
5. Respondent tiled a timely appeal trom the District
JUlltice judgment and t.he Petitioner tiled a timely Complaint
against Respondent, Morgan Hughes, on or about October 31, 1994.
6. petitioner's complaint alleged among other things that he
had entered into an employment contract with the Respondent whereby
the Respondent would pay Petitioner $10 an hour for work pertormed
on a residence located at 44 Grange Avenue, Mechanicsburg,
pennsylvania. Petitioner's Complaint also alleged that the
Petitioner performed ninety-one (91) hours of work on 44 Grange
Avenue, Mechanicsburg, pennsylvania for the Respondent and the
Respondent failed to compensate the Petitioner.
7. The Respondent filed an Answer to Petitioner's Complaint
denying all of Petitioner's claims against the Respondent.
8. As a result of the Respondent's pleadings and discovery
responses, the Plaintitf petitioned to file an Amended Complaint to
include williams Grove, Inc. as an Additional Defendant.
9. By Ordf'r ot Court dated August 22, 1995, this Court
dismissed the objections of Defendant, Morgan Hughes, and permitted
the Plaintiff to file an Amended Complaint adding williams Grove,
Inc. as an Additional Defendant.
10. On September 12, 1995, the Plaintiff filed an Amended
Complaint including williams Grove, Inc. as an Additional
Defendant.
11. Thia Amended complaint tiled on September 12, 1995 also
included an additional cause of action against

Defendant/Respondent, Morgan Hughes, alleging a violation of the
pennsylvania Wage payment and Collection Law, 43 P.S. 5260.1, .It

12. In response to this Second Amended Complaint, Respondent,
Morgan Hughes, filed preliminary Objections alleging plaintitf had
not obtained permission from this Court or trom Morgan Hughes to
include this additional cause of action against Morgan Hughes.
13. In response to these preliminary Objections, the
Plaintift now seeks leave of this Court to permit it to add an
additional cause ot action against Defendant, Morgan Hughes,
alleging violation ot the Wage payment and Collection Law, 43 P.S.
5260.1, n ug.
14. The statute of limitations for a claim under the
Pennsylvania Wage Payment and Collection Law is three years. ~
43 P.S. 5260.9a. (g).
15. This cause of action is based upon an employment
relationship between the Patitioner and Respondent, Morgan Hughes,
that commenced on or about June 24, 1993; thus, the statute of
limitations has not run with respect to Defendant, Morgan Hughes.
16. The Respondent, Morgan Hughes, will not be unfairly
prejudiced by the amendment of this pleading.

Williams Grove, by its attorneys, Fowler, Addams, shughart'
Rundle, makes the following Answer to Plaintitt's Amended

2. The averment is not directed to Williams Grove. No
answer is required.

4. Admitted, except that Williams Grove has no otficer
titled as Chief Executive Officer.
COUNT I
5-7. The averments are not directed to Williams Grove. No
answers are required.
COUNT II
8-12. The averments are not directed to Williama Grove. No
answers are required.
COUNT III
13. It is denied that the Williams Grove entered into an,
employment contract with Plaintitt. On the contrary, Plaintiff
was not an employee of WilliaMs Grove, but rather perforMed
services for Williams Grove as an independent contractor. It is
admitted that Williams Grove agrQed to pay Plaintiff $10.00 per
hour for services performed.
14. Denied as stated. WilliaMs Grove did not have an
employment relationship with Plaintift. Plaintiff was not an
employee of Williams Grove, but rather pertormed services for
Williams Grove as an independent contractor. It is admitted that
no .ervice. were pert~rmed by Plaintiff after June 2, 1994.
15. It is denied that Williams Grove had an employment
relationship with Plaintiff. After reasonable investigation,
Williams Grove is without knowledge or information sufficient to
form a belief as to the truth of the averment that Plaintiff is
owed for ninety-one (91) hours of work, and said averment is
denied and proof thereof demanded. It is admitted that 'laintiff
has demanded payment and that Williams Grove has refused to
render payment. Williams Grove believes and avers that it has
paid Plaintiff for all services performed.
WHEREFORE, Williams Grove respecttully requests that
Count III of Plaintitt's Amended Complaint be dismissed and that
judgment be entered in favor of Williams Grove.
COUNT IV
16. The answers to Paragraphs 1 through 4 and 13 through 15
are incorporated herein by reference thereto.
17. Denied as stated. Plaintiff volunteered to do work on
said property in return for the right to live there at a reduced
monthly rental of $250.00. Williams Grove agreed to this
arrangement.
18. Denied as stated. The answer to Paragraphs 17 is
incorporated herein by reference thereto. Williams Grove agreed
to, and did in fact, reimburse Plaintiff for building supplies
and materials he purchased and used on said house.
19. It is admitted that Williams Grove has not paid
Plaintiff $960.00 specifically for a septic tank. After
reasonable investigation, Williams Grove is without knowledge or
intormation sufficient to form a beliet as to the truth of the
remaining averments ot Paragraph 19, and said averments are
denied and proof thereof demanded.
20. After reasonable investigation, Williams Grove is
without knowledge or information sufficient to form a belief as
to the truth of the averments of Paragraph 20, and said averments
are denied and proof thereof demanded.
WHEREFORE, Williams Grove respectfully requests that
count IV of Plaintift's Amended complaint be dismissed and that
judgment be entered in favor of Williams Grove.

By way of further answer and defense, Williams Grove avers
the following New Matter:
33. The answers to Paragraphs 1 through 4 and 13 through 25
are incorporated herein by reference thereto.
34. Plaintiff agreed to purchase a septic tank for
installation at 44 Grange Avenue, Mechanicsburg, Pennsylvania, as
part of the parties' agreement to Plaintiff's right to live there
at a reduced monthly rental ot $250.00, for which purchase and
installation Plaintitt was to be reimbursed by Williams Grove.
35. Williams Grove, not Plaintiff, paid tor the purchase and
installation of said septic tank in the amount of $959.00, a copy
of which invoice is attached hereto as Exhibit "A".
36. Plaintiff resided at said property from November 1, 1993
to June 2, 1994, during which time he paid no rent to Williams
Gxoove.
WHEREFORE, williams Grove respectfully requests that
Plaintiff's Amended Complaint be dismissed and that judgment be
entered in favor ot Williams Grove.
COUNTIRCLAIM
Williams Grove makes the following Counterclaim against
Plaintiff:
37. The answers to Paragraphs 1 through 4 and 13 through 25
and Paragraphs 33 through 36 ot the above New Matter are
incorporated herein by reference thereto.
38. As part ot the parties' agreement, Plaintiff is indebted
to Williams Grove for the use and occupancy of 44 Grange Avenue,
Mechanicsburg, Pennsylvania, from November 1, 1993 to June 2,
1994, at a monthly rental of $250.00, in the total amount of
$1,750.00.
39. Without Williams Grove's prior knowledge or consent and
upon Plaintift's vacating said property, he removed theretrom the
felt from the roof, electric wires trom the walls without
replacing or repairing said walls, plumbing from the bathroom,
and, in general, substantially damaged and destroyed said
property; and, in addition, Plaintift took with him wall plates,
plumbing supplies, nails and roof cement, allot which were the
property of and paid tor by Williams Grove.
40. The estimated cost of th~ atoresaid items of property
removed and taken by Plaintiff and the resulting damages to said
44 Grange Avenue caused by him are estimated at $9,200.00.
WHEREFORE, Williams Grove respectfully requests judgment
against Plaintiff in the total amount of $10,950.00, together

AND NOW comes the Plaintiff, Wasyl Kadenko, by and through his
counsel, Shumaker WilliamsJ P,C" who respectfully respond to
Defendant Williams Grove, Inc.'s New Matter and Counterclaim as
followlil t
New Matter
33. Denied. Plaintiff's Complaint is incorporated herein by
reference thereto.
34. Admitted in part, denied in part. It is admitted that
the Plaintiff and Defendant Morgan Hughes had an agreement whereby
the Plaintiff was granted a right to live at 44 Grange Avenue,
Mechanicsburg, Pennsylvania for the rate of $250 per month. All
remaining aspects of this averment are denied, To the contrary,
Defendant Morgan Hughes and Plaintiff agreed that Hughes was to
order a septic tank to be installed at 44 Grange Avenue,
Mechanicsburg, Pennsylvania. The agreement between the Plaintiff
and Defendant Hughes was that the Plaintiff would pay the tank off
in monthly installments which the Plaintiff did.
35. Admitted in part, denied in part. It is admitted that
Morgan Hughes or Wi 11 iams Grove, Inc. originally paid for the
purchase and installation of a septic tank, All other averments in
this paragraph are denied. To the contrary, the Plaintiff made
payments every two weeks or once a month to the Defendant Hughes'
bookkeeper until said amount was paid off. The said amount was
paid off on or before March, 1993.
36. Denied, The Plaintiff resided at said pl:operty from
April, 1994 and lived there until the beginning of June, 1994 and
all rent due has been paid.
WHEREFORE, Plaintiff respectfully requests that jl;dgment be
entered in his favor.

37, Plaintiff's Complaint and Plaintiff's Response to

Plaintiff denies he was indebted to Williams
Grove, Inc. for the use and occupancy of 44 Grange Avenue from
November 1, 1992 until June 22, 1994 at a monthly rental of $250.
To the contrary, all amounts of money due for the rental of 44
Grange Avenue have been paid,
39. Denied, To the contrary, Plaintiff denies taking any of
Defendant Williams Grove, Inc,'s property alleged in this paragraph
or causing the damages claimed owed to Defendant Williams Grove,
Inc.
40. Denied.
After reasonable investigation, Plaintiff is
without sufficient knowledge or information sufficient to form a
belief as to the truth of this allegation,
