2. A Conciliation Conference was held on March 1. 2002, with Ihe tilllowing individuals in
attendance;
The Father, Chris A. Smith, and the Mother, Tammy J, Fry. Neither party appeared with
legal counsel.
3. This is Father's petition to modify the existing custody order. The existing order from
August 2000 provided for Father having primary custody of Joshua with Mother having
primary custody of Joel and Curvey. However, in April 2001 ,Joshua moved hack in with
Mother and Mother has had primary custody of Joshua since that time. Father now
suggests that Joel has expressed to him a desire to live with his Father, and Mother
contirmed in the conciliation that Joel has expressed those desires, However, Mother has
serious concerns with respect to whether it would he appropriate for Joel to live with the
Father and Mother is not in agreement with Father's request. A hearing is necessary,

DEFENDANT'S BRIEF IN OPPOSITION TO
PLAINTIEF'S EXCEPTIONS TO SUPPORT MASTER'S INTERIM ORDER OF COURT
I. STATEMENT OF FACT AND PROCEDURE
On December 3, 2001, Emily E, Martin ("Wife"), in the above-captioned cases, filed for spousal and
child support with Curnberland County Dom~stic Relations. At that time, the parties' minor child, Wesley D,
Martin, was residing with Wife at 1250 Oyster Mill Road, Camp Hili, Pennsylvania. On January 24,2002, the
minor child began residing with Husband at 3201 N. Second Street, Harrisburg, Pennsylvania. Husband has
had primary physical custody of the minor child since that date and continues to have custody, On January
24, 2002, Husband filed a pelition for child support with Cumberland County Domestic Relations, Following
a support conferance with Domestic Relations, a Master's hearing was scheduled for Monday, March 25,
2002, before Michael R Rundle, Support Masler. The Master issued Findings of Fact and Recommendation
on April 3, 2002. An Interim Order of Court was then entered by your Honor on April 4, 2002, Husband filed
timely exceptions to the Order of Court on April 12, 2002. As a resuit, this Honorable Court issued an Order
directing the parties to file briefs on the exceptions within fifteen (15) days for the moving party, and thirty
(30) days for the responding party, This Brief is In response to this directive and In preparation for argument
scheduled June 6, 2002.
(b) Heallh Insurance Premiums, (1) A party's payment of a premium to provide health
Insurance coverage on behalf of the other party or the children shall be allocated between the
parties In proportion to their net Incomes, Including the portion of the premium
attributable to the Plrty who II paying It, If the obligor Is paying the premium, then the
obligee's share Is deducted from the obligor's basic support obligation, If the obllgell Is
paying the premium, then obligor's share Is added to his or her basic support obligation,
Pa.RC.P, 1910.16-6(b)(1) (emphasis added), Counsel for Husband Is relying on Pa,R.C,P, 1910,16-6(b)(2),
which refers to parties who are not subject to the support action, The example following that particular Rule
Illustrates that parties who are not subject to a support action would be additional children from a previous
marriage, Both Wife, Husband, and the minor child In this case are subject to this support sctlon and
therefore this subsection Is Inapplicable,
The calculation set forth by the Master Is In accord with Pa.RC,P, 1910.16-6(b)(1), supra, The first
calculation set forth as Exhibit A to the Support Master's Report and Recommendation allocates $149,20 as
additional support to the Defendant Husband In the matter docketed to No, 1017-5-2001, This Is the mailer
flied by Wife for the support of herself and the minor child prior to the minor child's residing with Husband on
January 25, 2002,
The levels of Income are not subject to any exceptions and therefore the percentages allocated to
the Defendant Husband In that matter and the Plaintiff Wife are acceptable, According to Rule 1910,16-
6(b)(1), Wife Is paying $50.74 per week for the Insurance coverage of herself, her husband, and the minor
child. That figure, multiplied by 52 and then divided by 12 equals $219.87 per month. The allocation to
Husband In that matter would be $67.86%, or $149.20, as correctly calculated by the Support Master,
In the matter docketed to No, 70-5-2002, wherein the Plaintiff Husband Is seeking child support from
Defendant Wife, the obligee's (Husband's) share is deducted from the obligor's (Wife's) basic support
obligation. The Income percent allocation In Exhibit B to the Support Master's Report and Recommendation
Is 70.25% to Plaintiff Husband, and therefore the Master correctly deducted $154.46 from the Defendant
Wife's (obligor's) basic support obligation. Therefore, the Master did not err in calculating the proper
allocations according to Pa,RC.P. 1910, 16-6(b)(1).
B. The Mllter did not err In cllculltlng credit due to HUlblnd for the period from
December 3, 2001, until Jsnulry 24, 2002,
Counsel for Husband next contends that the Master erred In calculallng the credit due to Husband
from December 3, 2001, until January 24, 2002, During that period of time, the minor child was In the
custody of Wife and the Master entered an Order of $664,00 per month for child support, Furthermore, the
Master found a spousal obligation In the amount of $210,00 per month, Husband's counsel, In her Brief, Is
requesting a $350,00 credit on arrears from December 3, 2001, until January 3, 2002, and an additional
credit of $262,50 for the period from January 3, 2002, until January 24, 2002, for a total credit of $612.50, In
counsel's argument, she concludes that one-half of the mortgage payment, or $350,00, Is "the responsibility
of Wife," Even If that assumption was true, the credit which Husband's counsel has requested has already
been given to the extent of $210.00 per month, as the spousal support obligation was negated by virtue of
Husband making the mortgage payment during this time frame, If there Is any credit due, It should be offset
by the $210,00 per month spousal support obligation which was forgiven In exchange for Husband's
payment of the mortgage.
The argument set forth by Husband's counsel In this subsection B Is based on the presupposition
that Wife Is responsible for one-half of the mortgage, or $350.00, The Support Master In his discretion
Indicated that during this time period, the child support of $664,00 is due and owing from Husband to Wife,
He also offset Husband's spousal support obligation of $210.00 against the $700.00 per month mortgage
payment, as permitted by Pa.R.C.P. 1910,16-5, permitting certain deviations considering all relevant factors,
In conslderatlor. of the Incomes and all of the additional expenses set forth In the record, the Master's
Inclusion and decision to offset the spousal support by $210.00 per month (which is more proportionate to
the Incomes in this case, rather than on a fifty-fifty basis) was within the Master's sound discretion and In fact
Is proper in this case,
Therefore, should the Court opt to calculate the spousal support obligation and the child support
obligation offset by Rule 1910,16-4(e), the obligation would be hlghl;lr from Husband 10 Wife than whatlhe
Master calculated, and the child support obligation would be nullified,

unrelmbursed medlcll expenles Incurred by the minor child,
Unrelmbursed medical expenses of the obligee or the children shall be allocated between the parties
In proportion to their respective net Incomes, and obligor's share added to his or her basic support
obligation. Pa,RC.P, 1910.16-6(c), The Support Master found that on and after Janusry 24, 2002,
Husband had a monthly net Income of $2,671.74. Wife from dnd after that same period had a monthly net
Income calculated by the Master of $1,131.45, This provides a ratio of 70,25% for Husbsnd, and 29,75% for
Wife. This was a correct and accurate calculation by the Support Master. Counsel for Husband 15
attempting to use the argument In paragraph C, and adjust the net Incomes under Rule 1910,16,4(e) to
deviate and adjust the percentage ratios of Income between the parties, There is nothing In Rule 1910,16-
6(c) pertaining to unreimbursed medical expenses which provides for any deviations from the monthly net
Income calculated for both parties, Therefore, this argument Is erroneous and the Master was correct In
calculating the ratios of Income for unrelmbursed medical expenses,
IV. CONCLUSION
Counsel for Wife, as outlined by argument set forth herein, would request this Honorable Court to
dismiss Husband's exceptions and enter an Order based upon the Support Master's Report and
Recommendation.

legal custody of the three children; Joshua, Joel, and
Curvey, C-u-r-v-e-y, Father shall have primary physical
custody of Joshua, Mother shall have primary physical
custody of Joel and Curvey,
The children shall have periods of weekend
visitation from Friday to Sunday together with each parent
at least two weekends a month, depending on the parties'
work schedules, And, lastly, at all other times as agreed
by the parties, and transportation will be shared as agreed
by the parties,

February J I, 1998, attached hereto as Exhibit "A" and made part hereof

file a petition to get custody of Joshua, However, Mother has not filed a fonnal request for

1. The Mother, Tammy J. Smith, and the Father, Chris A. Smith,
shall enjoy shared legal custody of Joshua D. Smith born

2. Physical custody shall be awarded temporarily to the Father
as tho primary physical custodian. The Mother shall enjoy
temporary physical custody as follows,
A. On alternating weekends from Friday at 5 P.M. until
Sunday at 7 P.M.
B. Two days each week from 4,30 P.M. until 7:30 P.M.,
with the Mother to advise the Father by the prior
Saturday morning each week as to when she will
exercise those two evenings.
C. At such ather times as agreed upon by the parties.
3. For Thanksgiving 1994, the Mother shall have the children
from 3 P.M. on Thanksgiving Day until 5 P.M. the following
Friday.
4.
For Christmas 1994, the Mother shall have temporary custody
from Christmas Bve at 6 P.M. until Christmas Day at 2 P.M.
The Mother shall also enjoy other periods of temporary
custody with the children over the Christmas holiday to
coincide with the times the children are off from school
and the Mother is not working.

AND NOW, comes Petitioner, Chris A. smith, by and through
his counsel of record, Bradley L. Griffie, Esquire, and petitions
the Court as follows:
l. Your Petitioner is the above named Plaintiff, Chris A.
Smith, an adult individual currently residing at 1362 Grandview
Court, Carlisle, Cumberland County, Pennsylvania.
2. Your Respondent. is the above named Dafendant, Tammy .1.
Smith, an adult individual whose last known address was 1362
Grandview Court, Carlisle, Cumberland County, Pennsylvania, but
whose present whereabouts are unknown to the Petitioner.
3. The parties are the natural parents of Joshua D. Smith,
born August 20, 1985, Joel A. Smith, born May 3, 1987, and Curvey
E. smith, born september 10, 1989.
4. The Petitioner herein has filed a Complaint for Custody
relative to the above three children contemporaneously with the
filing of this Petition for Special Relief.
5. On September 2, 1994, the Respondent vacated the former
marital residence without providing the Petitioner with any
notification of her intention to do so.
6. Since the Respondent vacated the marital residence on
Friday, September 2, 1994, she has had telephone contact with the
parti..' ohildren on two occasions, that being sunday, Septemb6r
4, 1994, and Wednesday, September 7, 1994, at which times she did
not disclose to the children or Petitioner her present
whereabouts.
7. At no time since the Respondent left the marital
residence has she been willing to advise Petitioner of her
whereabouts.
B. Respondent has engaged in the use of illicit drugs,
which causes the Petitioner great concern relative to any contact
Respondent may have with the children.
9. Since the Respondent vacated the marital residence, it
is the Petitioner's understanding that she is temporarily
residing with or spending large amounts of her time with an
individual by the name of Matthew Pitkin, who has been physically
abusive to the parties' children and who is a professed Satan
worshiper.
10. On Monday, September 5, 1994, Petitioner provided
Respondent with notification that he would vacate the former
marital residence if the Respondent wished to come back to retain
her residency with the parties' children, this proposal being
made in an attempt to secure contact with the Respondent and to
provide an ongoing relationship between the children and the
Respondent.
ll. Despite Petitioner's willingness to vacate the marital
residence in order to allow the Respondent to have contact with
her children, she made no contact with them on Monday, September
5, 1994.
l2. Respondent has previously advised Petitioner that she
had an abusive childhood, which included her being raped by a
relative and otherwise being physically, verbally and mentally
abused.
l3. The Respondent has not been able to maintain employment
and the parties and their children have been financially
dependent upon the Petitioner's employment.
l4. Due to the present situation with the Respondent in her
problems recited above, the problems associated with the
individual with whom she apparently is residing, as well as the
emotional and mental instability associated with this situation,
it is required that the Petitioner be provided with primary
physical and legal custody of the children at least pending
further Order of Court in this matter.
l5. The instant Order is needed to avoid the situation of
the Respondent securing physical custody of the children from
their schooling or from the baby-sitter who watches the children
for brief periops before and after their schooling on weekdays.
WHEREFORE, Petitioner requests your Honorable Court to enter
an Order providing him with primary physical and legal custody of
the children pending further Order of Court and to also provide

January 27, 1995 confirms the Order of November 10, 1994 as a
temporary order.
6. The Order of November 10, 1994 should be modified for the
following reasons:
a. Father voluntarily gave primary physical custody of Joshua
and Joel on August 1, 1997 to Mother. On August 13, 1997
Joshua returned to the custody of Father and Father gave
primary physical custody of Curvey to Mother.
b, Father began residing with his grandmother on July 31,
1997. Grandmother I s residence is a two bedroom trailer
which does not have adequate room or beds for the three
children. Father has sent the children to other relatives
to stay prior to turning the children over to Mother.
c. Father does not provide adequate care and supervision of
the children. Prior to moving in with his grandmother,
Father left the children unattended while he worked. The
police were called to the residence on at least one
occasion when a neighbor saw Joshua point a rifle out of
the window.
d. Father uses inappropriate language in front of the
children.
e. Due to the unstable residence of the Father, Mother has
enrolled two of the children in Shippensburg schools. She
wishes to enroll all children in Shippensburg schools.
f. Mother can provide adequate housing and a loving, caring,
stable environment for the children.
7. The best interests of the children will be served if
primary physical custody of all of the children is awarded to

WHEREFORE, Petitioner, Tammy J. Smith, respectfully requests
this Honorable Court award primary physical custody of the children
to Petitioner.

I.' A heuring is scheduled in Courtroom No.4 of the Cumberland County Courthouse

L.M. at which time testimony will be taken in the above Cll5e. At this hearing. the
Father, Chris A. Smith. shall be the moving party and shall proceed initially with
testimony. Both parties, or their attorneys in the event either party retains Wl
attorney, shall tile with the Court and the opposing party a memorandum setting
forth the history of custody in this case, the issues currently before the Court, a
summary of ellch parties position on those issues, a list of witnesses who will be
called to testify und a summary of the anticipated testimony of ellch witness. This
memorandum shall be tiled at least 5 days prior to the mentioned hearing dute. The
issues at the hearing will be Father's request to have Joel and Curvey to come live
with him and Mother's request to have Joshua come live with her which, constitutes,
essentially, a modification ofthc existing order as it relates to all three children.
2. Pending further order of this Court. the existing custody schedule as provided in the
October 26.1999 Order and February II, 1998 Order of Court shall remain in effect.

To Whom It May Concern:
r have been asked to write a letter regarding my
observations of Joel and Beth Smith' and I am happy to oblige.
Joel (Joey) and Beth have been active and are members for
the past two years of our church - Ridge Church of the Brethren.
They both participate tully in the life of the church, inclUding
Youth Group and Sunday morning Sunday School and worship (when
they are with their mother) .
Both Joey and Beth have wonderful attitudes. They are
outgoing, helpful to those who have needs and appear to be well
dressed. They are mannerly, and take well the title of
Christian. As r read the local newspapers, I often find Joey's
and Beth's name among those who have made the school honor roll
and are sometimes pictured with school achievement projects.
These two yo~ng people are just about as perfect, in my
eyes, as you could ever want.

You may develop a red, tender streak up your ann. This is due to irritation of the vein from
medication which you received prior to the procedure, This is not serious. Please apply wunn,
moist heat for several hours u day to help resolve this problem more quickly.
If you have had a biopsy or had polyps removed, you are cautioncd NOT to use aspirin, arthritis
pills or cold medication containing aspirin for the next 3 weeks, unless told to do so by your
physiciun.

lives ond we, ure grah:ful Jocl and Beth is still with us. During Ihe verdicl, oller talking
with my 3 children, you did very well on reading und understunding them. When you
were suying: Joel felt the need to stay with his dud bl:cause his dad takes a lot of
medications everyday, lie was talking ubout his step-dud Wesley not his luther. Wesley
has a heart condition, high blood pressure, along with severul other illness and he. hus
been under treallnent tlJr. In which cose. Wesley tukcs a lot of mcdications. Aller. thc
hearing WIIS over on the way home, Jocl told me, he was talking about Wesley. Joel is
very tlllld of Wesley.
Because Wesley. has taken a lot of time out. IlJr Joel. to teuch him,. Joel has absorbed
a lot of wonderful knowledge from Wesley. Jocl now knows how to tear apart a bike and
put it back together. Wesley has taken Joel out of Pennslyvannnia for his first time.
Also took him fishing for his first time. (Dad things) Just to name u fewexwnples. Which
has helped Joclgain sell~confidence.lle needed desperately. But most of all Wesley has
helped Joel and Heth realize and understund, how important a good education is needed
in life. And we provide the help thut is needed for them to be able to leel the goodness of
being on the honor roll, Wesley. and I. have worked very hard to get where we are today.
We met in 1995 we bought a 2 bedroom mobile home, remodeled it. sold it-I 998-bought
a 3 bedroom mobile home, remodeled it, in 1999 we purchased 2 acres of land. We tore
down Wl old house. disposed of it. udded sand mound, well system, electrical systems.
We now have our home on our land. This was my grandparent's home. My parents live
ucross the road. This surroundings has been my home since 1971.Wesley and I didn't go
throagh all the hard work and all the obstacles just lor Qur own future. We did all of it for
our childn:n's future also. I want my children to be able to lecl the sense of security,
where home is! I would like to talk about some of the obstacles these post couple of
years. If you could look through our court documents, as to how many times we have
been to court because of Chris Smith. I rdly leel he is using the court system to hal'llss
us.
Elich and every time Smith got on the stund to testify, he swore under oath. he purged
himself. My son Joel has been subpoenaed his lather, Joel had to sit through testimonies,
just to sit and watch his father lie under oath. .loci was so amazed as to what his father is
capable of doing! My Thought: Dear Lord, What is this teaching my son'! During Smith's
testimony he stated he had a PFA aguinst Wesley, because of the incident, that happened
. on September 10,1999. On March 20.2001 the day uller the custody heuring. Smith and
his girlfriend pulled up into my driveway, parked outside. Smith then starts to approach
our door. Joel sees him first. Joel runs out (stocking-lcet} yells at his lather," Dad get in
your car and get down oIl' of this hill. Now. you have a No trespass on you. You arc not
allowed to be on this propelty! Smith then went down to the road, without confrontation
.On August 11,2000 I wrote a Deliant Trespass letter to Smith also I have a signed by
Smith certified card. proof he received the letter.(Enclosed) This was the whole purpose
of the last court order ,to make translers at Sheetz. to avoid any type of eonlrontatlon.
Smith also stated that he came up to Joel and Beth'~ gwne. they were standing at the
. phone booth, calling us to come pick them up. Game wus canceled, due to rain. Wesley
and I, declcded we would take Joel and Belh to their functions and ..trop Ihem on: give
them money to call home when they were I1nished. Because of Smith causing scenes,
yelling prolimity at us. It was very embarrassing for the children, Wesley, and I paid the
money tor Joel alld Deth's extra curricular activities, hut we aren'lahle 10 enjoy s~'Cing
them perfonn. lor fear of more embarrassment to them. Your Honor you ohviously saw
the hatred between Smith and myseU: he hus done 010101' hateful things to me. and my
loved ones. I. have been taught if you dislike someone, you stay away from them. The
point I'm trying to emphasized Is that Smith really needs to stay away lrom us. and stop
causing havoc in our lives. Smith has harassed me lor 7 years, I beg of you to help It stop.
If you need more proof on this matter I will gladly share it with you. Joel has admitted to
me, when he goes with his father tor the weekend. he smokes cigarettes, with Joshua.
Joel, Joshua and Iheir father's niece got caught lor slealirlg at Sheetz slore in Mt. Holly
Springs at 12:30 am. The cliildren have no supervision when they are wilh their father.
they, are lell alone to do as they please. They have no guidance in their father's custody.
On the hand, while In our custody, my children have consequences for their wrong
doings.
And now with all I hove explained to you, these ore jusla few reasons why [ leelthe need
to hove my children with us, and not with the children's lather. [,know when with us,
they will be well taken care 01: we revolve our entire lives around our children. Joel, and
Beth have come along way in the past 3 years. They have become a nne young man, and
o fine young lady. [n the near future we will be adding additions onto our mobile home,
just In case Joshua would change his mind and come home. Which. Joshua may do.
because Smith's girlfriend mode 0 comment, .. She doesn't warn the responsibility of,
Joshua. Joel, and Beth." It is his girlfriend that is approved for the $ 90,000.00 dollar
loan. Smith has no credit.
[ have enclosed more report cards for you to rcview, whcn the children were in Smith's
custody those 3 years.

I. This court's order of February II. 1998 is ratilied subject to the modilications as set

2. Exchange of custody with the children shall take place at the Sheetz in
Shippcnsburg. The pnrties may modify this point of exchange by mutual agreement.
3. The weel\cnds shall be from Friday at 5:00 p.m. until Sunday at 7:00 p.m. The
parties shull ensure thlltthey are on time and no more than twenty (20) minutes late.
The parties shull udvise the other parent in advance if there needs to be any
modilicution on the scheduled time,
4. Reasonable telephone contact shall ~ ufliJrded to the children on a condition that
parents may only call once per night.
S. The Mother's boyliiend shall not ~ present during exchange of custody.
6. The weekend schedule will ~ such that Futher has two weekends and Mother has
two weekends pursuant to the schedule in existence utthe time of this order.
7. For the holidays. Mother shllll have the children on Thanksgiving and Christmas
Day from the evening ~liJre the holiduy through 3:()0 p.m. on the holiday. Father
