COMPLAINT
1, The plaintiff, James E. Woodall, is an individual residing at P,O,
Box 13, Carlisle, Cumberland County, Pennsylvania,
2, The defendant, Scott J, Anderson, is an individual residing at 13
Cardinal Drive, Carlisle, Cumberland County, Pennsylvania,
3, On February 11, 1994, the plaintiff was the owner of a 1988 Pontiac
Grand Am,
4. At or about 9:30 A.M, on thl! aforesaid date, the plaintiff's said
Pontiac was parked on the west side of North West Street, near the intersection of
West Locust Street, in Carlisle, Cumberland County, Pennsylvania,
5, At the same time and place, the defendant was operating a
snowmobile in a western direction on West Locust Street,
6. The defendant drove into the intersection of North West Street, and
collided with a 1990 Ford pickup truck owned and operated by Brian Lee
Brunner, forcing the said pickup truck into the plaintiff's parked Pontiac.
7. The collision was caused by the negligence of the defendant in the
following respects:
(a) in failing to yield the right-of-way;
(b) in pulling into the said intersection when the Brunner
pickup truck was approaching, and
(c) in operating a snowmobile on a public street in violation of
the law.
8. As a result of the negligence of the defendant, the plaintiff
sustained $1,465,69 in damages to his said Pontiac, as is more fully set forth in
Exhibits "A" and "B".
WHEREFORE, the plaintiff claims of the defendant the sum of $1,465,69,
an amount requiring compulsory referral to arbitration under the local rules of
Court.
