Counsel for appellant is directed to inform the Commonwealth
of Pennsylvania, Department of Transportation, of the time and
place of said hearing at least thirty (30) days in advance thereof.
Pursuant to S1550(b) of the Motor Vehicle Code, said petition
operates as a supersedeas and no suspension shall be imposed
against John F. Pierce until a final determi-
matter.

TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW, John F. Pierce, Appellant, by his attorneys, Metzger,
Wickersham, RnaUSB & Erb, and represents the fOllowing:
1. The appell~nt, John F. Pierce, is an adult individual
residing at 657 Shippensburg Road, Newville, Cumberland County,
Pennsylvania 17241.
2. That said appellant has received a notice of intention to
suspend his operator's privileges, effective September 20, 1994,
for nonpayment of a judgment arising out of the Court of Common
Pleas of Philadelphia County to Number 4307, May term, 1993. A
copy of said notice is attached hereto as Exhibit "A".
3. Appellant at no time was aware of the pendency of the
underlying lawsuit in this action, and was not served with process.
From the docket entries, attached hereto as Exhibit "B", it appears
that a general appearance was entered for the appellant by one,
Norman F. Caplan, Esquire.
said appearance was without the
knowl~dge or authorization of the appellant. Finally, appellant
received no notice of the entry of judgment pursuant to
Pa.R.C.P. 236.
4. At the time of the accident which was the subject of the
underlying lawsuit, appellant was acting within the course and
scope ot his employment with A-1 Trucking, Inc., and was operating
a 1988 Hino truck, Pennsylvania registration number YK57936 which
was lea.ed trom Tell Motors, Inc.
5. since said accident, appellant has learned that a cigna
Insurance Card presented by his employer was invalid, the pOlicy
having been cancelled March 29, 1991, for nonpayment ot premium.
6. Appellant believes, and therefore avers, that Tell
Motors, Inc., as the registrant of the leased vehicle, would have
carried insurance as required by the Act of February 12, 1989,
P.L. 26, No. 11, 53 et seq. (75 Pa,C.S.A. 51781 et seq.).
7. At the time of said motor vehicle accident, appellant was
under not obligation to provide a policy of liability insurance as
he was neither the owner nor registrant of any vehicle.
For the above and other good reasons, appellant believes and
there tore avers that said suspension is illegal, unwarranted,
unjust and improper, and prays relief from the Notice of
suspension.
