effort will be made to resolve the issues in dispute; or if this
cannot be accomplished, to define and narrow the issues to be

AND NOW comes the Plaintiff, DONALD W. CHESBRO/ by
his attorneys/ Andes, Vaughn & Bangs, and makes the folluwing
Complaint for custody:
1. The Plaintiff is Donald W. Chesbro, an adult individual
who resides at 16 North second street, wormleysburg, Cumberland
county, Pennsylvania.
2. The Defendant is Tina C. Donnelly, an adult individual
who resides at 617 MMS/RGLMT, PSC 10/ Box 3205/ APO AE 09130,
Germany.
3. The plaintiff and Defendant were formerly husband and
wife, having been divorced on 18 March 1987.
4. The Plaintiff and Defendant are the natural parents of
three children: Dana Jean Chesbro, d.o.b. 2 April 1982; David
William Chesbro, d.o.b. 29 July 1983; and Devin William Chesbro,
d.o.b. 6 January 1985. The said minor children reside with
Defendant herein.
5. Plaintiff seeKS periods of visitation with the minor
children, Dana Jean Chesbro, David william Chesbro and Devin
William Chesbro.

6. The children were not born out of wedlock and are
presently in the custody of the Defendant.
7, To the best of Plaintiff's knowledge, during the past
five years, the minor children have resided with the following
persons at the fOllowing addresses:

8. The mother of the children is the Defendant who resides
at the address set out above.
9. The father of the children is the Plaintiff who resides
at the address set out above.
10. The Defendant is the natural mother of the children.
Defendant currently resides with the following person(s): the
children of this custody action, her current husband and their
three children.
11. The Plaintiff is the natural father of the children.
Plaintiff currently resides with the following person(s):
himself and his girlfriend.
12. The Plaintiff has not participated as a party or in any
other way in any litigation concerning the custody of the
children in this or any other court.

The plaintiff has no information of a custody proceeding
concerning the children pending in a court of this or any other
jurisdiction.
Plaintiff knows of no other person not a party to this
action already who has physical custody of or claims to have
custody or visitation rights with the said children.
13. The best interest and permanent welfare of the
children will be served by granting the relief requested by
Plaintiff because the children should have regular and consistent
visitation with their father.
14. Each parent whose par.ental rights to the children have
not been terminated and the person who has physical custody of
the children have been named as parties to this action.
WHBRBFORB, Donald W. Chesbro requests this Court to grant
him periods of visitation with the children, Dana Jean Chesbro,
David William Chesbro, and Devin William Chesbro.

CONCILIATION CONJi'ERENCE SUMMARY REPORT
IN ACCORDANCE WITH CUMBERLAND COUNTY RULE OF CIVIL PROCEDURE
1915.3-8(b), the undersigned Custody Conciliator submits the
following report'
1. The pertinent information pertaining to the children who
are the subject of this litigation is as follows,
Dana Jean Chesbro, born April 2, 1982, David William
Chesbro, born July 29, 1983, and Devin William Chesbro,
born January 6, 1985.
2. The Conciliator held a telephone conference call on
November 2, 1994, with legal counsel for the parties.
The Father, Donald W. Chesbro, was represented by
Michael Bangs, Esquire, and the Mother, Tina C, Donnelly,
was represented by Michael Rundle, Esquire.
3. The Mother is currently residing in Germany with her new
husband. The children are 9, 11, and 12 years of age. The
Father has not seen the children for four or five years.
The Mother's current husband is in the military. The
Father has maintained contact with the children by letters
and phone calls. The Father is seeking a Custody Order
whereby he will be given an opportunity to have the
children for an extended period of time over the summer
mont/Is. The Mother relates that the children are reluctant
to go to see the Father because of the long period of time
during which the Father has had no contact at all with the
children.
4. The Mother is available to return to the United States in
April of 1995 along with the children. The Father is
in agreement that a Hearing be scheduled in April of 1995
and the Father does not desire any custody pending the
April Hearing.
