SMITH, now residing ~ 1878 " Spring Road, Carlisle, Cumberland County, Pennsylvani~, is'~n c.D I ~ immediate and present danger of abuse from the defendant, CHARLES L. CAROTHERS, the fOllowing Temporary Order is entered. The defendant, CHARLES L. CAROTHERS, now residing at 100 Meadowbrook Road, Carlisle. Cumberland County. Pennsylvania, is hereby enjoined from physically abusing the plaintiff, BRANDY W. SMITH, or placing her in fear of abuse and is ordered to stay away from the residence located at 1878 Spring Road, Carlisle, Cumberland County, Pennsylvania, a residence which is owned by the plaintiff's mother. The defendant is hereby notified that if he goes to the plaintiff's domicile contrary to this Order, he may be in indirect criminal contempt which is punishable by ft fine not to exceed $1,000.00 and/or by a sentence of up to six months in jail and any other appropriate punishment. Resumption of co-residence on the part of the plaintiff and defendant shall not nullify the provisions of the Court Order directing the defendant to refrain from abusing the plaintiff. The defendant is ordered to refrain from having any contact with the plaintiff including. but not 1 imited to, entering the plaintiff's place of employment, harassing or stalking the plaintiff, and harassing the plaintiff's relatives. This Order shall remain in effect until a final order is entered in this case. The plaintiff may proceed in f~Lm~ ~~~ pending a further order after the hearing. The Cumberland County Sheriff's office shall attempt to make service at the plaintiff's request, but service may be accomplished under any applicable rule of Civil Procedure. The North Middleton and Carlisle Police Departments will be prOVided with a copy of this Order by attorneys for plaintiff. This Order shall be enforced by any law enforcement agency where a violation occurs by arrest for indirect criminal contempt witnout warrant upon probable cause that this Order has been violated, whether or not the violation is committed in the presence of the police officer. In the event that an arrest is made under this section, the defendant shall be taken without unnecessary de 1 ay before t he court t hat issued t he Order. When BRANDY W. If you wish to defend against the claims set forth in the following pages. you must take action promptly after this Petition, Order and Notice are served, by appesrina personally or by attorney at the hearing scheduled by the Court and presenting to the Court your defenses or objections to the claims set forth against you. You are warned that if you fail to do so the Court may proceed without you. and a jUdgment may be entered against you by the Court without further notice for any money claimed in the Petition or for any other claim or relief requested by the plaintiff. Later that day when the plaintiff and her mother were in their vehicle, the defendant was in a car which tailgated the plaintiff's car. The defondant's car passed the plaintiff's and stopped at the stop sign in front of the plaintiff refusing to move so that the plaintiff's car could not proceed. When the plaintiff's car went around the defendant's car, the defendant's car drove beside the plaintiff's car and rammed into the plaintiff's car. The next week, the defendant admitted to the plaintiff that he ran into her car. b. In or around July 1994, the defendant telephoned the plaintiff's house approximately twenty-five times and threatuned the plaintiff comparing the fate of the plaintiff and defendant to Romeo and Juliet saying that he would kill her and then kill himself rather than sit in jail. c. Throughout the summer of 1994, on several occasions. the defendant went to the plaintiff's home and workplace. harassed her, and threatened to kill her, causing the plaintiff to fear for her safety. d. On or about February 14, 1994, the defendant became angry, grabbed the plaintiff by the nose and twisted it with enough force to cause it to bleed. A teacher came out and stopp~d the incident. The plaintiff filed charges against the defendant for simple assault. e. On or about February 10, 1994. the defendant punched the plaintiff in the nose with enough force to cause the plaintiff to fall to the ground. The plaintiff suffered a bloody nose and pain. f. In or around November 1993, the plaintiff requested Legal Services to send the defendant a letter stating that his behavior could result in her filing criminal charges or a Petition for a protective order hoping to stop the defendant's violent behavior. When the defendant received the letter at school, he ripped the letter up in front of the plaintiff. g. During the relationship which ended February 14, 1994, the defendant physically abused the plaintiff in ways including, but not limited to the following: shoving. pushing, pulling hair. burning her with cigarettes, slapping, punching, pinching, biting, kicking, and grabbing the plaintiff. 5. The plaintiff believes and therefore avers that she will be in immediate and present danger of abuse from the defendant. and that she is in need of protection from such abuse. 6. The plaintiff desires that the defendant be restrained from entering her place of employment, having any contact with her, harassing or stalking the plaintiff, and from harassing the plaintiff's relatives. ~~__~.!J~B~~~.EEf~ 7. The plaintiff currently is employed at Long John Silver's and Hardee's and receives 14.25 per hour. 10. The plaintiff does not have funds available to pay the fees for filing and service. WHEREFORE, pursuant to the provisions of the "Protection from Abuse Act" of October 7, 1976, 23 P.S. Section 6101 .t! lUlQ., as amended. the plaintiff prays this Honorable Court to grant the following relief: A. Grant a Temporary Order pursuant to the "Protection from Abuse Act:" 1. Requiring the defendant to refrain from abusing the plaintiff or placing her in fear of abuse. 2. Requiring the defendant to refrain from having any contact with the plaintiff, including, but not limited to, entering the plaintiff's plllce of employment, harassing or stalking the plaintiff, and harassing the plaintiff's relatives. 3. Ordering the defendant to stay away from the residence located at 1878 Spring Road, Carlisle. 4. Ordering the defendant to stay away from any residence the plaintiff may in the future establish for herself . B. Schedule a hearing in accordance with the provisions of the "Protection from Abuse Act." and, after such hearing, enter an order to be in effect for a period of one year: 1. Requiring the defendant to refrain from abusing the plaintiff or placing her in fear of abuse. 2. Requiring the defendant to refrain from having any contact with the plaintiff, including, but not limited to, entering the plaintiff's place of employment, harassing or stalking the plaintiff, and harassing the plaintiff's relatives. 3. Ordering the defendant to stay away from the residence located at 1878 Spring Road. Carlisle. 4. Ordering the defendant to stay away from any residence the plaintiff may in the future establish for herself. 5. Ordering the defendant to pay attorney fees to Legal Services, Inc. pursuant to the Protection From Abuse Act. The plaintiff further asks that this Petition be filed and served without payment of costs, pending a further order at the hearing, and that a copy of this Petition and Order be delivered to the Carlisle and North Middleton Township Police Departments as the Police Departments with jurisdiction to enforce this Order.
