Defendant COMPLAINT AND NOW comes Jeffrey S. Shultz, the Plaintiff, and by and through his counsel, Bratic & Portko, files the within Complaint against the Defendant above captioned, whereof the following is a more complete statement. 1. Plaintiff, Jeffrey S. Shultz, is an adult individual residing at 103 West Greenhouse Road, Dillsburg, PA 17019. 2. Defendant, AA Auto Warranty Corporation, is a corporation authorized to do business in the Commonwealth of Pennsylvania, with its principal offices located at 954 North Irving Avenue, Scranton, PA 18510. 3. At all times relevant hereto, Plaintiff was the -2- owner of a Limited Car Warranty, (hereinafter "warranty"), issued by Defendant through its authorized agent, Alan L. Auto World, of Cumberland County, Pennsylvania, for a 1988 Chevrolet truck, bearing a warranty coverage of 24 months/24,OOO miles, and being identified as Plan * 5 under Defendant's offered protection plan. 4. At all times relevant hereto, Plaintiff's truck, a 1988 Chevrolet, model 1500 VIN *2GLDL19Z6J1192580, (hereinafter "vehicle"), was the vehicle covered under the aforesaid warranty plan issued by Defendant. 5. Defendant approved Plaintiff's vehicle for the warranty coverage selected by Plaintiff. 6. At the time of purchase of the vehicle and the warranty on April 25, 1994, the only documentation regarding the warranty purchased by Plaintiff from Defendant was a one-page document, a true and correct copy of which is marked Exhibit "A", attached hereto and made part hereof by reference. 7. Within the first week after purchase of the vehicle, Plaintiff noticed that the fuel gauge was not operating properly and on May 6, 1994, the vehicle was taken to Twin Wheel Automotive (hereinafter "Twin Wheel"),located at 6 Texaco Road, Mechanicsburg, PA 17055, to determine the problem. 8. Plaint.iff informed Twin Wheel of the vehicle's -3- warranty coverage and on May 10, 1994, prior to performing any repairs, Twin Wheel contacted Defendant to submit a claim for cost of repairs for replacement of the fuel gauge. 9. Although Defendant gathered all necessary information from Twin Hill, Defendant failed to respond to Plaintiff's claim for coverage on the fuel gauge. 10. On or about May 23, 1994, Plaintiff received an information packet from Defendant which included the procedure for submitting a claim. A true and correct copy of the information package is marked Exhibit "B", attached hereto in the composite and made part hereof by reference. 11. Upon receipt of the aforesaid information packet Plaintiff immediately contacted Defendant, informing them of the repair claim, requesting an authorization number in accordance with Defendant's procedures, and asking Defendant to return Plaintiff's telephone call. 12. Contrary to Plaintiff's request, Defendant failed to acknowledge Plaintiff's claim, provide a claim authorization number or return Plaintiff's telephone call. 13. Due to the delay encountered by Plaintiff in his dealings with Defendant, and as a result of needing his vehicle, repairs to the fuel gauge were completed on June 3, 1994, and Plaintiff picked up his vehicle and paid a repair bill of $396.44. A true and correct copy of the aforesaid repair bill is marked Exhibit "C", attached hereto and made -4- part hereof by reference. 14. Plaintiff imnediately submitted a copy of the repair bill and the claim for reimbursement; however, approximately two weeks thereafter Defendant informed Plaintiff that the claim was being denied. 15. On or about June 1, 1994, Plaintiff discovered that the engine to said vehicle was showing excessive oil consumption. 16. Plaintiff had the vehicle inspected by automobile mechanics and discovered that the engine would have to be replaced. 17. PJ.aintiff immediately contacted Defendant about the oil consumption problem and, after Defendant investigated the claim and negotiated with Plaintiff regarding the manner of repair under the warranty, Defendant agreed to pay Plaintiff the sum of $1000 for said engine repairs. 18. Upon authorization of the warranty repairs, Defendant also informed Plaintiff that it was voiding the warranty and refunding to Plaintiff a portion of the premium paid by Plaintiff for the warranty. 19. On or about June 17, 1994, Defendant prepared and mailed to Plaintiff a written agreement for Plaintiff's signature, wherein Defendant authorized a claim payment in the sum of $1300.00, representing the engine repairs and a partial refund of the warranty premium. A true and correct -5- copy of said written agreement is marked Exhibit D, attached hereto and made part hereof by reference. 20. Plaintiff immediately signed and returned the aforesaid agreement and was informed by Defendant that the authorized payment would be mailed upon receipt of the signed agreement and that the defective engine would be picked up within five working days. 21. Contrary to the assurances, statements and undertakings of the Defendant, Defendant failed to mail the authorized payment sum or to pick up the defective engine. 22. As a result of Defendant's failure to comply with its warranty and its agreement of June 17, 1994, Plaintiff was required to borrow the sum of $1300.00 at an interest rate of 17.65' per annum in order to have the repairs made to the vehicle. 23. To date Defendant has failed to respond to Plaintiff's claim for the repairs to the fuel gauge in the amount of $396.44 or to pay the sum of $1300.00 representing repairs to the engine and a partial refund of the warranty premium in accordance with its agreement of June 17, 1994. COUNT I - BREACH OF CONTRACT 24. Plaintiff hereby realleges each allegation of paragraph 1 through 23 of this complaint as if they were set forth herein. -6- 25. In breach of its obligation to Plaintiff, Defendant denied Plaintiff recovery for repairs to the fuel gauge and repairs for replacement of the engine. 26. Defendant breached its express warranty that they would repair or replace the defects in the vehicle. 27. Defendant breached its agreement to pay Plaintiff the sum of $1300.00, representing the engine replacement and partial premium refund. 28. Defendant has breached the terms of the limited warranty coverage and its duty to exercise "good faith" in its dealings with Plaintiff, all to Plaintiff's damage in the amount of $1,696.44. WHEREFORE, Plaintiff requests judgment against the Defendant in the amount of $1696.44, with interest thereon and cost of suit. COUNT II Plaintiff hereby real leges each allegation of paragraph 1 through 28 of this complaint as if they were set forth herein. 29. The conduct of Defendant constitutes misrepresentation, fraud and deceit in that, inter alia, Defendant knowingly and willfully: A. Misrepresented pertinent facts or policy or contract provisions relating to coverages at issue; B. Failed to acknowledge and act promptly upon -7- written or oral communication with respect to Plaintiff's claim; C. Refused to pay Plaintiff's claim without conducting a reasonable investigation based upon all available information; D. Failed to promptly provide a reasonable explanation of the basis in the warranty in relation to the facts or applicable law for denial of Plaintiff's claim; E. Failed to exercise good faith in its dealings with Plaintiff o~ to act in a reasonable and prompt manner in responding to Plaintiff's claim for coverage under the warranty contract. F. Breached its express warranty that it would properly repair or replace all defects in the vehicle covered by the warranty; G. Failed to repair the defects in the vehicle contrary to its advertisements and promises that such warranty services would be delivered or provided to Plaintiff; H. Failed to comply with the terms of the warranty after purchase of the vehicle in that Defendant failed to pay for the repairs within 30 days after it authorized payment of the claim; and I. Engaged in fraudulent conduct regarding the -8- .tatement. made as to term. of the warranty and a. to Defendant's agreement to remedy the problems. 30. The actions of the Defendant alleged above constitute a transaction, practice or course of business which operated as a fraud or deceit upon Plaintiff. 31. By failing to provide to Plaintiff a copy of their information packet in a timely manner and by failing to fully and fairly disclose all material facts regarding the investigation of Plaintiff's claims, Defendant has engaged in unfair or deceptive acts or practices within the meaning of the Pennsylvania Unfair Trade Practices and Consumer Protection Law, 73 Pa.C.S.A. Section 201.2(4), which under section 9.2 of the Act, entitles Plaintiff to recover up to three (3) times the actual damages caused by Defendant's unlawful conduct. 32. The conduct of the Defendant in refusing to pay Plaintiff's claims under the subject warranty as described aforesaid, constitutes unfair or deceptive acts or practices under the Consumer Protection Law, entitling Plaintiff to initiate a private action. WHEREFORE, Plaintiff request judgment against the Defendant for the following: (1) treble damages in the amount of $5,089.00 pursuant to 73 Pa.C.S.A. Section 201-1 et seq. Paragraphs 1-32 of defendants answer are incorporated herein by reference as if fully set forth. 34. Plaintiff's complaint seeks to recover the I!\um of $5,089.00, $20.00 and a $3.00 a day storage charge that commenced on August 11, 1994 from the Defendant, alleging breach of a contract dated April 25, 1994, for purchase of a warranty for a 24 month/24,0000 automobile warranty. A copy of the contract is attached as Article 11. 35. Before defendant executed the contract, plaintiff represented to defendant the following: a) Plaintiff was the owner of a 1988 Chevrolet truck VIN 12GLDL19Z6J1192580 b) That the vehicle was free of any preexisting defects. 36. The aforesaid representations were false and fraudulent. Defendant did not know these representations to be false. (see article 2) 37. By theae false and fraudulent representations plaintiff induced defendant to enter into the said contract and defendant justifiably relied upon plaintiff's misrepresentations in 80 doing. 38. As a proximate result of plaintiff'S false and fraudulent misrepresentations and defendant's justifiable reliance upon same, defendant has suffered legal fees in the amount of $1000.00 which amount serves to offset or diminish plaintiff'S claim for recovery. 39. Because plaintiff so engaged in fraudulent misrepresentations with regard to this contract, plaintiff is precluded from unjustly enriching himself by here seeking performance and/or damages under the contract, and plaintiff's action is barred.
