AND NOW, this

day of October, 1994, comes the
Plaintiff, FRANK T. PERANO, t/d/b/a Country Manor West, by his
attorneys, Cleckner and Fearen, and files the within Complaint and
in support thereof avers the following:
1. The Plaintiff is Frank T. perano, an adult individual,
t/d/b/a Country Manor West, a mobile home park (hereinafter "Country
Manor") with its principal place of business located at 2 Apple
Alley, Carlisle, Cumberland County, Pennsylvania, 17013.
2. 'rhe Defendant is Eileen Silver, an adult individual who
resides at 193 Birch Lane, Carlisle, Cumberland County, Pennsyl-
vania.
3. The Defendant has leased a mobile home lot from Plaintiff
in Country Manor, which lot is known and numbered as 193 Birch Lane,
Carlisle, Pennsylvania (hereinafter "Premises") under an oral,
month-to-month lease.
The agreed upon rent for said Premises is
$280.00 per month.
4. As part of her lease agreement with Plaintiff, Defendant
agreed to comply with Country Manor West Rules, Regulations and
Agreements (hereinafter "Tenant Agreements"). A true and correct
copy of ssid Tenant Agreements is marked Exhibit "A", attached
hereto and incorporated herein by reference.
5. Pursuant to the aforesaid Tenant Agreements, Defendant
agreed to be responsible for the costs to maintain sewer and water
lines, and to maintain her lawn.
6. Pursuant to the aforesaid Tenant Agreements, Defendant
agreed to pay $1.00 per day for each day rent remains unpaid, plus a
$10.00 billing charge if full late charges are not paid with her
late rent payment.
7. Despite her obligations under her lease and the 'renant
Agreements, and despite demand by Plaintiff, Defendant has failed to
pay Plaintiff any rent since May, 1994.
8. On or about June 8, 1994, Plaintiff, by his agent, notified
Defendant to repair a broken sewer line at the Premises within seven
(7) days of the date of said notice.
9. On or about June 21, 1994, as Defendant had failed to
repair the broken sewer line at the Premises, Plaintiff made the
required repair and provided Defendant with an invoice for such
repair. A true and correct copy of said invoice, dated June 28,
1994, is marked Exhibit "B", attached hereto and incorporated herein
by reference. Defendant has failed to pay this invoice.

COMES NOW the defendant, Eileen Silvor, by counsel, Philip
C, Briganti, Esquire, Legal Services, Inc., and as har Answer to
Plaintiff's complaint, states as followSl
1. Admitted.
2. Admitted.
3. Admitted in part and denied in part. Defendant admits
that she has leased a mobile home lot from Plaintiff in country
Manor, which lot is known and numbered as 193 Ilirch Lane,
Carlisle, pennsylvania, and that the agreed upon rent for said
premises is $280.00 per month. Defendant denies that she rants
the mobile home lot from Plaintiff under an oral month-to-month
lease, but rather pursuant to a lease of indefinito duration
which can only be terminated for grounds set forth under the
Mobile Home Park Rights Act (68 P.S. S398.1 qt 5~.), by
following the procedures set forth in said Act.

6. Admitted. However, as set forth below in Defendant's
New Matter, Defendant avers that the provisions of the Tenant
Agreements setting forth a $1,00 per day late charge plus a
$10,00 billing charge, are unenforceable as a penalt.y for the
late payment of rent.
7. Denied. Defendant has paid her rent for September, 1994
and October, 1994 into escrow with the Prothonotary of the
Cumberland County Court of Common Pleas, pursuant to Rule 357 of
the Cumberland county Rules of Procedure.

9. Admitted.
10. Denied. Defendant denies that on or about June 22,
1994, Plaintiff notified Defendant of the alleged breach of her
lease and Tenant Agreements, due to non-payment of rent, in the
manner prescribed by the Mobile Home Park Rights Act, 68 P.S.
5398.1 ~~. Defendant does not recollect receiving the notice
marked as Plaintiff's Exhibit "C", and therefore denies that she
was notified in accordance with the Mobile Home Park Rights Act.
11. Admitted in part and denied in part. Defendant admits
that on or about September 10, 1994, Plaintiff mowed the lawn at
the rental premises because Defendant had failed to do so, and
that the invoice attached to Plaintiff's complaint as Exhibit "0"
was presented to Defendant. Defendant also admits that she has
not paid this invoice for lawn care services. Defendant does not
believe that the lawn had grown to a height of more than three
inches on September 20, 1994, and therefore denies that Plaintiff
was required to mow the lawn on that date. Defendant further
avers that any failure on her part to mow the lawn was caused by
her pregnancy and hospitalization to have her baby.
12. Admitted in part and denied in part. Detendant admits
that she has failed to remove her mobile home from the premises.
However, Defendant denies that she owes the amounts claimed to be
due and owing by Plaintiff, and therefore denies that she has
"failed" to pay these amounts. Defendant repe~ts and
incorporates by reference her averments set forth in paragraphs 6
through 11 herein.
13. Defendant repeats and incorporates by reference her
averments set forth in paragraphs 1 through 12 herein.
14. Admitted in part and denied in par.t. Defendant admits
that she owes $280.00 in rent for the months of June, July and
August, 1994. She also admits that she owes a sewer line repair
charge of $25.00. Defendant denies that she owes any rent for
september, 1994, as this rent has been paid into escrow with the
Prothonotary, pursuant to Rule 357 of Cumberland County Rules of
Procedure. Defendant further denies that she owes the late
charges set forth in Plaintiff's complaint, in that these charges
are excessive and constitute a penalty for the late payment of
rent. Defendant also denies that she owes Plaintiff $40.00 for
lawn care service. Defendant denies that she owes Plaintiff all
of the "totals" set forth in Paragraph 14 of Plaintiff's
complaint, and specifically denies that she owes Plaintiff a
total amount of $1330.00.

averments contained in Paragraphs 1 through 14 herein.

17. Admitted in part and denied in part. Defendant admits
that she has not vacated or surrendered possession of the
premises to the Plaintiff. However, Defendant denies that she
received the alleged notice as averred in paragraph 10 of
Plaintiff's Complaint. Defendant repeats and incorporates by
reference her averments set forth in paragraph 10 herein.
NEW MATTER
18. The late charges set forth in Paragraph 3 of the
"Registration and Rent" section of Plaintiff's Rules, Regulations
and Agreements, consisting of $1.00 per day for each day the rent
is not paid after the seventh day of each month, and an
additional $10.00 billing charge if full late charges are not
paid with late rent payment, are excessive and exceed Plaintiff's
actual or reasonably anticipated losses occasioned by the late
payment of rent, and are unenforceable as a penalty. Plaintiff's
Rules, Regulations and Agreements are attached to Plaintiff's
Complaint as Exhibit "A", and are incorporated herein by
reference.
19. The late charges set forth in paragraph 3 of the
"Registration and Rent" section of Plaintiff's Rules, Regulations
and Agreements, are not fair or reasonable rules reasonably
related to the health or safety of residents in the park or to
the upkeep of the park, in violation of 68 P.S. S 398.4.
Plaintiff's Rules, Regulations and Agreements are attaohed to
Plaintiff's Complaint as Exhibit "A", and are inoorporated herein
by reference.
20. Defendant did not receive an eviction notice by
certified or registered mail for nonpayment of rent prior to the
commencement of this action, in violation of 68 P.S. S398.3(b).

21. Plaintiff did not serve Defendant with an eviction
notice by certified or registered mail advising her that she had
breached park rules concerning lawn maintenance or sewer repair
before the commencement of this action, in violation of 68 P.S.
S398.3(b) .
22. Defendant did not commit a second or subsequent
violation of park rules concerning maintenance of sewer lines or
her lawn within a six-month period, as must be established by
Plaintiff in order to evict her on these grounds, pursuant to 68
P.S. S398.3(b).
23. Paragraph 4 under the "Lawn and Water" section of
Plaintiff's Rules, Regulations and Agreements, which requires
residents' lawns to be mowed to a height of three inches at all
times and reserves management's right to "mow any lawn that is
neglected at a cost of $20.00," is not enforced with respect to
the other mobile home residents or nonresidents on the park
premises, and therefore cannot be a ground for Defendant's
eviction pursuant to 68 P.S. S398.3(c). Plaintiff's Rules,

of f5aid notice waB attached to Plaintiff's complaint af5 Exhibit "CO
and is hereby incorporated herein by reference. Attached hereto af5
Exhibit "A" and incorporated herein by reference if5 a true and
correct copy of the U.S. Postal Service Receipt showing that said
eviction notice was delivered to Defendant on July 18, 1994.
21. Plaintiff admits that the eviction notice did not purport
to evict Defendant on the basis of her breach of park rules
concerning lawn maintenance and B6wer repair. By way of further
reply, Defendant'B non-payment of rent is, independent of her other
breaches of park rules, suf.ficient cause to evict her and Plaintiff
did provide Defendant with notice of eviction on that basiB prior
to' commencement of thiB action.
22. The averments in paragraph 22 are legal conclusions to
which no reply is required. To the extent that a reply is
required, Plaintiff avers that Defendant violated park rules other
than non-payment of rent at least three (3) times within a six (6)
