Liens was properly filed before the commencement of the work on the property In accordance
with 49 P,S, Section 1402,
IT IS HEREBY ORDERED that the Mechanics Lien claim of JOSEPH M. GOHN
t/d/b/a JOSEPH M. GOHN, ELECTRICAL CONTRACTOR, be struck off,

Claimant.
3, As is set forth in paragraph B of Claimant's Mechanics' Lien claim, the first
work dcme and materials furnished by Claimant were on or about December 13, 1993,
4, Claimant was a subcontractor operating under the general contractor for the
aforasaid project, T, R. Rollason, lnc,
5, T, R. Rollason, Inc. executed a valid Stipulation Against Liens in favor of
owners Robert A. Brenneman and Sherry L. Brenneman, on October 15, 1993, $peclflcally
pertaining to the property In question, which Stipulation Against Liens provided In pertinent part
that:
the said Contractor,.,for themselves, their subcontractors, and all
parties acting through or under them, covenant and agree that no
mechanics' liens or claims thereunder for or on account of any work
done or materials furnished by them or any of them under said
Contractor otherwise for, towards, In or about the erection or
construction of the said buildings on the lot above described,
and..,hereby expressly waive and relinquish the right to have, file and
maintain any mechanics liens or claims against the said buildings or
any of them....
6, Said Stipulation Against Liens was filed on October 15, 1993, In the Office
of the Cumberland County Prothonotary to No, 32344 MLD 1993, A copy of the aforesaid
Stipulation Against Liens Is attached hereto as Exhibit "B",

5. Claimant is an electrical contractor and gave notice c
his intent to file a claim by letter on June 8, 1994.
6. Owners owe claimant $3639.21 for electrical contractir
work performed on the premises as shown by the attached bill markf
Exhibit "B", four attached invoices marked Group Exhibit "C" ur
two attached work change orders marked Group Exhibit "0".
7. The contract with changes provided for full payment 0
$10,985.93.
Of that total amount $7346.72 has been received
leaving a balance due of $3639.21.
8. The first work was done and materials were furnished t
the claimant on December 13, 1993 and the last work was done an
the materials were furnished on February 28, 1994.
9. The aforesaid work was done and materials were furnishe
in connection with the providing of electrical contracting work 0
the owners' residence at 10 nogwood Drive, Newville, PA 17241.
10. This lien is claimed for electrical contracting wor
performed from February 4, 1994 to February 28, 1994 and ageins'
the fee simple interest of the owners of the aforesaid premises.

Exclusions Clarifications
A Mirrors - Electrical Contractor Is not responsible for any mirrors
which may have light fixtures. switch. receptacle or any other
Items which may be mounted to mirror. Costs which may be incurred
if a mirror breaks, will be the responsibility of others to repair
and financially.
B) Before rough wire begins, the General Contractor guarantees
Electrical Contractor that:
1.) All partitions, walls, soffits etc, which are to contain
wiring outlets will be completely Installed,
2.) Electrical Contractor will have kitchen and bathroom print
from cabinet manufacturer,
3.) Rough-in of heating, cool ing and plumbing system Is complete.
so as not to intet'fere with electrical installation and/or
electrical installation will not be altered due to mechanical
contractor.
C) Changes/Revisions - Any changes, revisions from the design of the
job wi 11 on I y be performed after a "Work Change Order,lI has been
signed, at which time the person. persons and/or company agree to
pay all costs involved to cover the requested change.
D) Temporary electrical power - as per OSHA and the 1993 National
Electric Code, all power used on construction jobsites is to be
a Ground Fault Protected power source.
1.) RouQh Phase - during this phase of work, Joseph M. Gohn
Electrical Contractor will provide circuits which are Ground
Fault Pr'otected.
2.) Finish Phase - During this phase of work, it will be the re-
sponsibility of all trades to provide their own Ground Fault
Protected cords and/or positive grounding program.
This electrical scope of work is based on Joseph H. Gohn Electrical
Contractor's interpretation of specifications provided by T,R, Rollason
Inc. and also the standards of the electrical trade.

hi. intent to file a claim by letter on June 8, 1994.
6. OWnere owe claimant $3639.~1 tor electrical contracting
work performed on t,he premise. as Bhown by the attached bill marked
Exhibit "B", four attached invoiceB IlIlSrked Group Exhibit "C" and
two attached work change orders marked Group Exhibit "D".
1. The contract with changes provided tor full payment of
$10,985.93.
Of that total amount $7346.72 has been received,
leaving a balance due of $3639.21.
8. The firet work was done and materials were furnished by
the claimant on Deoember 13, 1993 and the last work waB done and
the materialB were furnished on February 28, 1994.
9. The aforesaid work was done and materials were furnished
in connection with the providing of electrical contracting work of
the ownerB' residence at 10 Dogwood Drive, Newville, PA 11241.
10. This lien is claimed tor electrical contracting work
performed from February 4, 1994 to February 28, 1994 and againBt
simple interest of the owners of the aforesaid premises.

A rrors - E ectr ca Contractor Is not responsible for any mirrors
which may have light fixtures, switch, receptacle or any other
Items which may be mounted to mirror. Costs which may be Incurred
If a mirror breaks, will be the responsibility of others to repair
and financially.
B).Before rough wire begins, the General Contractor guarantees
Electrical Contractor that:
1.) All partitions, walls, soffits etc. which are to contain
wiring outlets will be completely Installed.
2.) Electrical Contractor will have kitchen and bathroom print
from cabinet manufacturer.
3.) Rough-In of heating. cooling and plumbing system Is complete.
so as not to Interfere with electrical Installation and/or
electrical Installation will not be altered due to mechanical
contractor. '
C) Changes/Revisions - Any changes. revisions from the design of the
job wi 11 only be performed after a "Work Change Order" has been
signed, at which time the person, persons and/or company agree to
pay all costs Involved to cover the requested change.
D) Temporary electrical pow~r - as per OSHA and the 1993 National
Electric Code. all power used on construction jobsltes Is to be
a Ground Fault Protected power source.
1.) ROUQh Phase - during this phas~ of work, Joseph H. Gohn
Electrical Contractor will provide circuits which are Ground
Fault Protected.
2.) Finish Phase - During this phase of work, It will be the re-
sponsibility of all trades to prov'lde their own Ground Fault
Protected cords and/or positive grounding program.
This electrical scope of work Is based on Joseph M. Gohn Electrical
Contractor's Interpretation of s~eclflcatlons provided by T.R. Rollason
Inc. and also the standards of the electrical trade.
