John Richard Neyer, Petitioner PROTECTION FROM ABUSE AND CUSTODY .BTITION rOR 8PBCIAL RlLIBr AND NOW, comes the Petitioner, by and through his counsel, R. Mark Thomas, Esquire, and tiles this Petition tor Special Reliet and in support thereot respecttully represents: 1. On September 21, 1994, the above-captioned Respondent, on behalt ot het'selt and her minor child, Valerie Neyer, tiled a Petition For Protection From Abuse and tor custody ot the two minor children ot the parties. 2. The Court entered a Temporary Protective Order enjoining the Petitioner trom physically abusing his daughter, or placing her in tear ot abuse, and excluded the Petitioner trom the marital residence. In addition, the Court granted temporary custody of thQ two children to the Respondent and directed the Petitioner not to have any contact with his daughter, Valerie Neyer. 3. Pursuant to this Court's Order your Petitioner was removed trom his home until such time as this Court conducted a hearing to determine the validity ot the allegations contained within the Petition For Protection From Abuse. 4. The hearing originally scheduled for September 29, 1994, was continued at the request ot the Respondent with Petitioner's concurrence. 5. The hearing scheduled for October 17, 1994 was continued at the request of the Respondent with the concurr.ence of the Petitioner. 6. Finally, a hearing was conducted on November 23, 1994 with regard to the allegations contained in the original Petition. 7. Following the testimony this Court stated on the record that it was of the opinion that no abuse, as such is defined under the Protection From Abuse Act, occurred as had been set forth in the Petition. 8. In an attempt to provide the Respondent with an opportunity to convince the Court that the actions of the Petitioner herein rose to the level of constituting abuse, the Court directed counsel for the Respondent to provide the Court with legal authority to establish that the acts complained of were abusive. Counsel for the Respondent was to provide the Court with that authority within seven (7) days, at which time the Court would render a decision. 9. It has now been 15 weeks since the hearing on November 23, 1994, and still no Order has come forth with regard to the Petition For Protection From Abuse. 10. since september 21, 1994, your Petitioner has been compelled to rent space from friends who had agreed to allow Petitioner to live with them temporarily. 11. Despite the delay in the outcome of this case your Petitioner has been allowed to remain in the home of his friends. 12. Although your Petitioner is paying support to the Respondent for the benefit of Respondent and the children, the Respondent is not paying the monthly bills at the marital residence, and your Petitioner's c~edit rating is beginning to be adversely affected. 13. Your Petltioner has not had any contact with his daughter, Valerie Neyer, since September 21, 1994. 14. Your Petitioner has only had one visit with his minor son, and that visit was conducted with the Mental Health Clinic at Holy Spirit Hospital, which required your Petitioner to pay $30.00 for a one-half hour visit with hie son. 15. Based upon statements made by your Petitioner's son, your Petitioner believes that neither the Respondent nor the children are living in the marital residence on a full-time basis and, in fact, the marital residence may be unoccupied. 16. Your Petitioner denies that he at any time engaged in any acts which rose to the level of physical or sexual abuse with regard to his daughter, and denies engaging in any acts which reasonably could have caused his daughter to fear such abuse. 17. The investigation by the Cumberland County Children and Youth Services determined that the allegations of abuse in this case were unfounded. 18. Your Petitioner has been placed under a tremendous hardship due to his complete separation from his family and the instability of his living arrangements. ,,,; '\. The only thing that could possibly constitute a violation of the Protection From Abuse Act under these facts would be the first sentence of Bectlon 4 which describes abuse as physically or sexually abusing minor children. I would like any cases that Plaintiff has to indicate that assuming that he was standing naked in front of his daughter who was sitting on the commode, that that would constitute physically or sexually abusing minor children. pending that the Court makes no decision on this case, and also at this time I am making no decision on whether or not the Defendant should be entitled to some type of partial custody or visitation with his two children. I will do that at the same time I hand down a decision as to whether or not there was any abuse. I will give counsel for the Plaintiff seven days from today to give me any cases that she wishes to give me on the issue as previously related.
