themselves. A Pet Clause Addendum was not included in
Defendants' Exhibit "A". A true and correct copy is attached
hereto and made a part hereof as "Exhibit A",
6. Denied. Defendants were provided with all notices
required under the terms of the Lease.
7. Admitted in part and denied in part, It is admitted
that Defendant and Plaintiff's Agent met on August 9, 1994, at
the District Justice's office. It is denied that Defendants were
first served with the Landlord and Tenant Complaint at that time.
District Justice Farner coordinates service of process of
Landlord and Tenant Complaints, Plaintiffs paid all service
costs when the Complaint was filed,
8. Admitted in part and denied in part. It is admitted
that Pamela L. Davis paid $600.00 to Plaintiffs. It is denied
that the payment was in full satisfaction of the Landlord and
Tenant Complaint.

10. Denied. Plaintiffs are without knowledge or
information sufficient to form a belief as to the truth of the
averment contained in paragraph 10 of Defendants' Petition. By
way of further response, District Justice Farner coordinates
service of Possession Orders, and on August 29, 1994, when the
Request for Order for Possession was filed, Plaintiffs paid all
costs for service.

11, Denied. It is denied that Defendants had no prior
notice of their eviction. Defendants were sent and received
several notices.
12, Denied, Paragraph 12 contains a conclusion of law to
which no responsive pleading is required, By way of further
response Plaintiffs have followed all procedures required by the
Lease and law in an effort to lawfully regain possession of the
Premises. Defendants have defaulted under the terms and
conditi.ons of the Lease. The Lease term ended July 31, 1994.
Plaintiffs were awarded Jud~nent and possession by District
Justice Glenn R. Farner. True and correct copies of the
Complaint, proof of payment, Notice of Hearing, Notice of
Judgment, Request for Order of Possession, proof of payment for
Order of Possession and letter dated May 25, 1994, advising of
termination are all attached hereto and made a part hereof
collectively as "Exhibit B".
13. Denied. Paragraph 13 contains a conclusion of law to
which no responsive pleading is required.
WHEREFORE, Plaintiffs respectfully request this Honorable
Court to grant possession of the premises to Plaintiffs and to
deny Defendants' request to file an appeal Nunc Pro Tunc,
COUNT II
PRAECIPE FOR WRIT OF CERTIORARI
14. The answers to Paragraphs 1-13 are incorporated herein
by reference.

15. Denied. Paragraph 15 contains a conclusion of law to
which no responsive pleading is required, By way of further
response Plaintiffs provided all required notices to Defendants.
16. Denied, The response to paragraph 12 is incorporated
herein by reference.
WHEREFORE, Plaintiffs respectfully request this Honorable
Court to grant possession of the premises to Plaintiffs and to
deny Defendants' request to file an appeal Nunc Pro Tunc.

17. paragraphs 1 through 16 are incorporated herein by
reference.
18. District Justice Farner issued judgment against
Defendant for money damages and possession on August 9, 1994.
19. Defendants were provid~d with Notice of the Judgment.
20. Defendants had thirty (30) days to appeal the Judgment.
21. Defendants were informed of the thirty (30) day appeal
period.
22. Defendants uid not appeal the Judgment on or befo~e the
expiration of thirty (30) days,
23. On September 19, 1994, forty (40) days after Judgment,
Defendants filed this Petition.
24. On September 21, 1994, upon consideration of
Defendants' Petition, the Court issued a Rule to Show Cause upon
Plaintiffs.

25. The Rule is returnable at a hearing to be held on
friday, October 7, 1994,
26, In addition to the issuance of the Rule, the "::ourt
Order provided that eviction of Defendants would be stayed if
Defendants posted a bond with corporate surety or cash with the
~rothonotary in the amount of $2,000,00 by 4:30 p.m. on September
22, 1994,
27. Defendants did not post the bond as required by the
Court Order on September 22, 1994, or thereafter.
28. Defendants are in violation of the Court Order.
29, Defendants should not be permitted further relief when
they have violated a Court Order issued at their request and on
their behalf.
WHEREFORE, Plaintiffs request the Court Order dated
Septe~er 21, 1994, be vacated, that Defendants be ordered to
leave the ~remises and that Defendants' request to file an appeal
Nunc Pro Tunc be denied.

AND NOW, this 2\~\ day of September, 1994, upon consideration
of Defendants' motion to file an appeal nunc pro tunc, a Rule is
issued upon Plaintiffs to show cause why the relief requested
should not be granted.
RULE RETURNABLE at a hearing to be held on Friday, October 7,
1994, at 11100 a.m., in Courtroom No.5, Cumberland County
Courthouse, Carlisle, Pennsylvania.
SERVICE of this Rule shall be made upon Plaintiffs by
Defendants' counsel.
EVICTION of Defendants is STAYED if by 4130 p.m. on September
22, 1994, Defendants have posted a bond with corporate surety or
cash with the Prothonotary in the amount of $2,000 to cover any
judgment against them, now or hereafter entered in this matter, and
on the further condition that rental payments are deposited with
the Prothonotary as they come due.

2, Plaintiffs are directed to forthwith surrender keys to
Defendants' residence at 5977 Eberly Dd ve, Mechanicsburg,
Cumberland County, Pennsylvania 17055,
3. A hearing on the foregoing Rule to Show Cause shall be
held on

Carlisle, Pennsylvania.
4. The requirement for the filing of a bond is waived,
BY THE COURT
J.
Road, Mechanicsburg, Cumberland County, Pennsylvania, from August
1, 1993, through July 30, 1994, thereafter automatically renewable
for 60 days with 60 days written notice. See Exhibit "A",
6, On August 8, 1994, without any prior Notice to Quit or
Notice of Legal proceedings, Plaintiff and/ or his agent notified
Defendants to meet at DJ Farners' office in Hampton Township on
August 9, 1994, at approximately 1:30 p.m,
7. On August 9, 1994, Defendant, Pamela L. Davis, met with
Plaintiff's Agent who served Defendant with a copy of the
Landlord/Tenant Complaint. See Exhibit "B".
8, Defendant, Pamela L. Davis, paid Plaintiff's Agent
$600.00, cash in full satisfaction of the Landlord/Tenant
Complaint.
9. On or about August 29, 1994, Plaintiffs obtained an Order
for Possession,
10. Defendants did not receive a copy of the Order for
Possession.
11. Cn September 16, 1994, State Constable Elfran Garcia,
without prior notice, appeared at the Defendants' residence to
evict the Defendants.
12. Plaintiffs have not properly commenced any legal court
proceedings to evict Defendants.
13. Plaintiffs above-described conduct violates Pennsylvania
law including, but not limited to, the Landlord Tenant Act of 1951
(68 Pa.C.S.A. Section 250.101 et, sea.l, and public policy of the
Commonwealth of Pennsylvania.
WHEREFORE, Defendants respectfully request this Honorable
Court to issue a Rule to Show Cause on the Plaintiffs to appear and
answer why the Defendants should not be permitted to remain in the
family residence and file an Appeal Nunc Pro Tunc.
COUNT II
PRAICIPE POR WRIT OP CERTIORARI
14. Paragraphs 1 through 13 are incorporated hereinafter as
if fully set forth below.
15. Service of a proper Notice to Quit is a jurisdictional
prerequisite to the Plaintifts bringing an eviction action against
the Defendants.
16. The Plaintiffs have failed to serve the Defendants with
a Notice to Quit in accordance with applicable law,
WHEREFORE, Defendants respectfully request this Honorable
Court to issue a Rule to Show Cause on the Plaintiffs to appear and

petition are true and correct.

that Plaintiffs and Defendants executed a Lease Agreement
("LEASE") for the premises at 5977 Eberly Road, Mechanicsburg,
Cumberland County, Pennsylvania, ("PREMISES") for a one year term

denied that the Lease terminates only upon sixty days written
notice. The Lease terminated on July 31, 1994. The Lease
terminates and becomes void upon Tenants' default. By way of

further response, the terms and conditions of the Lease speak for
themselves. A Pet Clause Addendum was not included in
Defendants' Exhibit "A". A true and correct copy is attached
hereto and made a part hereof as "Exhibit A".
6. Denied. Defendants were provided with all notices
required under the terms of the Lease,
7. Admitted in part and denied in part. It is admitted
that Defendant and Plaintiff's Agent met on August 9, 1994, at
the District Justice's office. It is denied that Defendants were
first served with the Landlord and Tenant Complaint at that time.
District Justice Farner coordinates service of process of
Landlord and Tenant Complaints. Plaintiffs paid all service
costs when the Complaint was filed.
8. Admitted in part and denied in part. It is admitted
that Pamela L. Davis paid $600.00 to Plaintiffs. It is denied
that the payment was in full satisfaction of the Landlord and
Tenant Complaint.

10. Denied. Plaintiffs are without knowledge or
information sufficient to form a belief as to the truth of the
averment cOlltained in paragraph 10 of Defendants' Petition. By
way of further response, District Justice Farner coordinates
servi~3 of Possession Orders, and on August 29, 1994, when the
Request for Order for Possession was filed, Plaintiffs paid all
costs for service.
11. Denied, It is denied that Defendants had no prior
notice of their eviction, Defendants were sent and received
several notices,
12, Denied. Paragraph 12 contains a conclusion of law to
which no responsive pleading is required, By way of further
response Plaintiffs have followed all procedures required by the
Lease and law in an elfort to lawfully regain possession of the
Premises. Defendants have defaulted under the terms and
conditions of the Lease, The Lease term ended July 31, 1994.
Plaintiffs were awarded Judgment and possession by District
Justice Glenn R. Farner, True and correct copies of the
Complaint, proof of payment, Notice of Hearing, Notice of
Judgment, Request for Order of Possessi.on, proof of payment for
Order of Possession and letter dated May 25, 1994, advising of
termination are all attached hereto and made a part hereof
collectively as "Exhibit B".
13. Denied. Paragraph 13 contains a conclusion of law to
which no responsive pleading is required.
WHEREFORE, Plaintiffs respectfully request this Honorable
Court to grant possession of the premises to Plaintiffs and to
deny Defendants' request to file an appeal Nunc Pro Tunc.

PRAECIPE FOR WRIT OF CERTIORARI
14. The answers to Paragraphs 1-13 are incorporated herein
by reference.
15. Denied. Paragraph 15 contains a conclusion of law to
which no responsive pleading is required. By way of further
response Plaintiffs provided all required notices to Defendants.

Defendant for money damages and possession on August 9, 1994.

period.
22. Defendants did not appeal the Judgment on or before the
expiration of thirty (30) days.
23. On September 19, 1994, forty (40) days after Judgment,
Defendants filed this Petition.
24. On September 21, 1994, upon consideration of
Defendants' Petition, the Court issued a Rule to Show Cause upon
Plaintiffs.
