6. At all times material hereto, Delcndants leased the property located at 15
Mountain Street, Mt, Holly Springs from Plaintiffs, Chesler and Romaine McCommons. A true
and correct copy of the Lease Agreement is attached hereto, incorporated herein by reference,
and marked as Exhibit "A",
7, Pursuant to the terms of the aforesaid Lease Agreement, Delendants were
responsible for supplying and maintaining the heating fuel for the furnace, the property leased
from the Plainti ffs,
8. Pursuant to the terms of the aforesaid Lease Agreement, Defendants were
responsible for any damages to all plumbing equipment caused by misuse or negligence, the
tenants were required to pay the cost of any and all repairs of any kind whatsoever, after the
beginning of the lease due to the tenant's neglect.
8, On or before January 16, 1994, Delendants departed the Mt. Holly Springs area
for a vacation in Florida,
9. On or about January 16, 1994, Plaintiff McCommons stopped by to inspect the
property and noted that the hot water baseboard heat had frozen causing water damage and
other damages to the residence,
10, On or before January 16, 1994, Delendanls, their agents, servants, or employees
had tampered with the fuel tank and/or furnace, and had adjusted the 110at gauge so that it
always registered between 1/4 and 1/2 tank of fuel being in the tank,
I L On or about January 16, 1994, the two Delendants' tampering with the tank,
furnace and/or tank gauge, the heating system was out of fuel causing the pipes to freeze and
causing considerable damage to the property,

12. Plaintiffs, Chester and Romaine McCommons have executed a sworn statement
in proof of loss substantiating $2,859,20 in property damages resulting from Defendant's
conduct
13. Plaintiff, Lititz Mutual Insurance Company provided coverage for the property
damages sustained by the McCommons, minus the amount of the deductible ($100).
COUNT ~
BREACH OF CONTRACT
14. Plaintiffs incorporate by reference the averments of paragraphs 1 through 13 as
if fully set forth at length herein,
15, Pursuant to the terms of the Lease Agreement, Defendants were responsible for
supplying and maintaining the heating fuel for the furnace of the residence, were responsible
for defraying the cost of repairs to the property due to the tenants' neglect
16, At all times material hereto, Plaintiffs, Chester and Romaine McCommons, filled
their lease, obligations and responsibilities under the Lease Agreement
17, On or before January 16, 1994, Defendants breached a material provision of the
Lease Agreement by failing to maintain an adequate supply of fucl for the heating system by
tampering with the float portion of the t.mk gauge so that it registered the quantity of fuel
which was not present in the tank. and by otherwise tampering with the furnace, tank and
heating system,
18, As a direct and proximate result of Defendant's breach of the Lease Agreement,
the pipes in Plaintiffs' property froze causing $2,859.20 in water and other damages to the
property,

WHEREFORE, Plaintiffs respectfully request that this Honorable Court enter judgment
against the Defendants in the amount of $2,859.20. plus costs and interest as allowed by law.

NE(,L1GENCE
19. The averments of paragraphs I through 18 are incorporated by reference as if
fully set forth at length herein,
20. At all times material hereto, the Defendants owed a duty to the Plaintiffs to
supply and maintain heating fuel for the furnace of the residence and to maintain the
21, The Delendants breached said duty in that they failed to provide an adequate
supply of heating fuel for the furnace; tampered with or manipulated the heating oil storage
tank and gauges to always register 1/4 to 1/2 full; allowed the residence to go without heat for
a period of time during severe winter weather; failed to notify the Plaintiffs that the noat gauge
had been tampered with and that the tank was out of fuel; and in being otherwise negligent
under the circumstances,
22, As a direct and proximate result of the defendant's negligent, careless, reckless,
and/or intentional conduct, Plaintiffs suflered property damages in the amollnt of $2,859.20.
23, Delendants created an unsafe and dangerolls condition which resulted in a
reasonably foreseeable risk of harm to the Plaintiffs' property,
24, Defendants knew or should have known that tampering with the fuel gauge and
failing to provide an adequate supply of healing fuel. and severe winter weather would cause
the pipes to freeze that would intlict dumul!es to the residence,
