STIPULA nON AGAINST LIENS
THIS AGREEMENT made and concluded this 13th day of September, 1994. between
BLAINE E. HENCH and HEI.EN T. HENCH, husband and wife, of 820 South Humer
Street. Enola, Cumberland County, Pennsylvania, pllrties of the first part, hereinafter called
Owner.
AND TH~~ McNAUGHTON COMPANY, of 1800 Linglestown Road. Harrisburg,
Pennsylvania, pllrty of the second part, hereinartercalled Contlaclor,
WHEREAS the said ,Parties have a duly executed Agrecment under selll. bearing even date
herewith, entered into a wnllen contract for Ihe erection, construction, and completion of two-
story frame dwelling house to be erected on Lot No, 7, Westbury Phase I, Section I, in Hampden
Township, with mailing address of 5485 Eagles Ridge Lane, Enola, Pennsylvania,
NOW THIS AGREI<:MENT WITNESSETH: That the Contractor for and in
consideration of the eonlratt aforesaid and the consideration mentioneJ thereunder, as well as the
further consideration of One ($1.00) Dollar 10 him in hand pwd by the Owner at or before the
scaling and delivery of these presents, the receipt whereof is hereby acknowledged, does hereby,
covenant, promise, and agree that no mechanics' lien or claim or other lien or claim of any kind
whatsoever shllll be tiled or maintained against the said building or buildings or the eUltilage or
curtilages appurtenant thereto, by Contractor or by any sub-contractor, materialman, or laborers
for work done, or male rials fUl'~ishcd under said contract or by any other party acting Ihrough or
under them or any of them for and about sllid building or buildings or unr part thereof, or on
creditthereof,k and that all sub-contractors. materia!men and laborers on swd work shall look to
and hold Contractor penorrll1ly liable for all sub-contracts, materials of any kind whatever against
Owner for any work done or labor or materials furnished under said contract for and about the
erection, construction, lUld completion of said buildings as aforesaid, or under any contract for
extra work or for work supplementaltherelo or otherwise,
AND this Agreement waiving the right of lien shall be an independent covenant and shall
operate and be effective as well with respect to work done and materials furnished under any
SU{lplemental contract for extra work in the erection, construction, and completion of the said
bUl[din~ or buildings a~ any work and labor done and materials furnished under thll contract
aforesaid,
AND in order to give the Owner full power and authority to prot~ct himself and the lot or
lots of ground against any and all claims flied by the Contractor or anyone action under or through
him or it in violation of the foregoing covenant, the said Contractor for himself, themselves,
itself, hereby irrevocably authoril.es and empowers any Attorney of any Court of Common Pleas
of the Commonwealth of Pennsylvania, to appear for him, them, it or any of the said Courts of
Common Pleas as Allorney for him, them, or it and in hil11, their, its, name, mark satisfied of
record at the cost and expense of the Contractor or of any Sub-Contractor or Materialman, or
Materilllmen, any and all c."4Wms or claim, lien or liens, filed by or for the Contractor, or any Sub-
Contractor or Materialman, or in his or their name against said building or buildings, lot or lots of
ground or any pllrt thereof and for such act, or aclS this shall be good and sufficient warrant and
authority, and a reference to the Court, Term and Number in which and where this Agreement
sha,lI have been filed shall be a surlicient exhibit of the Authority herein contained to warrant such
actlO,n, and the Contractor for hlmself,them~lves, itself, do hereby remi~e, release and quit.claim
all nghts and all manner of error~, defects and imperfeclions whatsoever in entering such
satisfaction or in anywi~e touching or concerning the same,
