referred to as CONTRACTOR, and PETERSBURG ROAD ASSOCIATBS, a
Pennsylvania general partnership, with offices at 163 North
Hanover street, Carlisle, Pennsylvania, hereinafter referred to
as OWNER, whereby the former undertook and agreed to conduct
earth moving and excavation services and provide materials and
labor for construction of streets and other municipal
improvements on that certain lot of ground situate in South
Middleton Township, Cumberland County, Pennsylvania, more
particularly described as being the Cobblestone Estates
Development as shown on Subdivision Plan prepared by Statler-
Brehm Associates, Inc., dat~d January 20, 1994, revised through
May 19, 1994, and fronting on the eastern side of Petersburg
Road.
NOW THEREt'ORE, THIS AGREEMENT WITNESSETH That the said
CONTRACTOR, for and in consideration of the sum of One ($1.00)
Dollar to it in hand paid by OWNER, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by
them or any of them against the said improvements and the lot of
ground appurtenant thereto for or on account of any work done or
