upon presenlation and consideralion of the wilhin Petilion, and upon finding that plaintiff,
Patricia Clapp, residing al an address known to counsel within Cumberland Counly,
Pennsylvania, is in immediale and present danger of abuse from defendant, Walter John Clapp,
Sr., the following Temporary Order is enlered.
Defendant, Walter John Clapp, Sr., is hereby enjoined from physically and emolionally
abusing plaintiff, Patricia Clapp, either personally or through his agents.
Plaintiff may enler the marilal home at 163 Castle Drive, Mechanicsburg, Cumberland
County, Pennsylvania, for the purpose of collecling her clothes and personal hygiene items,
Temporary partial physical custody of Ihe following children: James Edward Clapp
(d.o.b. 2-1-84), William Eli Clapp (d.o.b. 9-24-87), Ashley Louise Clapp (d.o.b. 1-16-90), and
Alan Michael Clapp (d.o.b. 5-6-93), is hereby awarded to plaintiff, Patricia Clapp. Said
temporary partial physical cuslody is 10 be exercised from 12:00 noon 106:00 p.m.. Salurdays
and Sundays, at plaintiffs parenls house at 184 Holiday Avenue, Mechanicsburg. Pennsylvania

COUNT I. PROTECTION FROM ABUSE
1. Plainliff is Patricia A. Clapp, an adull individual who is residing al an address
known only 10 counsel as wilhin Cumberland County, Pennsylvania. because of her fear of
further abuse. Plaimiff brings this action for herself and on behalf of her minor children: James
Edward Clapp (d.o.b. 2-1-84). William Eli Clapp (d.o.b. 9-24-87), Ashley Louise Clapp (d.o.b,
1-16-90), and Alan Michael Clapp (d.o.b. 5-6-93).
2. Defendam is an adult individual who is residing al 163 Caslle Drive,
Mechanicsburg. Cumberland Coumy, Pennsylvania 17055.
3. Plaimiff and dt:fendam were married on May 19. 1978, in Moum Union,
Pennsylvania.
4. Plaimiff and defendam are Ihe natural parenls of Ihe following children: James
Edward Clapp, born 2-1,84. William Eli Clapp. born 9-24-87. Ashley Louise Clapp, born 1-16-
90. Alan Michad Clapp, born 5-6-93.
5. Over the course of their relationship, defendant has allempted to cause and has
illlentionally, knowingly, and recklessly ",uscd hodily injury to plaintiff. Furth('rmore, plaintiff
has hcen placed in fear of imminclll hodily injury and or death. This has included bUI is nol
limitcd to the following instances of ahusc:
A. On Septcmher 2, 1994, plaillliff, defendalll and IWo witnesses were playing cards
al plaillliff and defendalll's trailcr. Defendalll was drinking and hecame verbally abusive when
he realized he was losing the card game. Dcfendalll struck plaillliff in her rib cage with his fist.
The force of defendant's blow knocked the v. ind oUI of plaillliff. Plaillliff left the Irailer and
spellllhe next few minutes outside on the lawn attempting to regain her breathing. One of the
wilnesses, Don Neral, residing al 321 Marlclle Drive, Mechanicsburg, Pennsylvania 17055,
offered to lake Ihe plainliff from the trailcr. Plaintiff. injured and in shock, left the Irailer
wilhout any spare clothing, money or pcrsonal belongings. The second witness 10 defendalll's
abusive aCls is Robcrt Toy, residing at 120 Castle Drive, Mech,lIlicsburg, Pennsylvania.
B. Beginning in May I 1194, dcfcndant has repeatedly gOllen drunk and suhjecled
plaintiff to Ihreats of violence by shoving plaintiff and shJking his lists in plaillliff's face, On
numcrous occasions, defendalll has Ihreatene~ 'G kill plaintiff.
6. Plaillliff belicves and Ihcrefore avers that she is in immediate and preselll danger
of serious abuse from dcfendalll and Ihal she is in need of protection from abuse.
WHEREFORE, pursuant to the provisions of the "Protcclion From Abuse Acl" 23
Pa,C.S. ~6101 el seq., plaillliff prays this Honorable Courlto grant the following relief:
A. Gralll a Temporary Ordcr pursuant to Ihe "Proteclion From Abuse ACI".
I) Requiring Ihe defendalll to refrain from abusing the plainliff and her minor
children, either personally or through his agellls.
B. Schcduh: a hcaring in accordancc with thc provisions uf Ihc "Prutc(.;tion From
Ahusc ACI", and
C. After such hcaring. cnlcr an ordcr againstthc dcfcndanl, to hc in cffcC1 for onc
ycars, as follows:
I) Directing Ihc dcfendanl 10 rcfmin frum abusing Ihc plainliff or any of thc minor
childrcn.
2) Prohibiting Ihe dcfcndanl from having any contacl wi(h Ihe plaintiff, (excepl for
thc purposc of cxchanging custody of Ihc childrcn) including, bul nOllimited 10, rcslraining Ihc
dcfendanl from cntering the placc of cmploymcnt or busincss of thc plainliff and from harassing
thc plainliff or plaintiff's rclativcs or minor childrcn.
D. Direcllhe appropriatc Policc Departmcnllo ~ssisl plainliff in rccovering hcr spare
clothing and personal hygiene ilems at 163 Casllc Drivc, Mechanicsburg, Pennsylvania.

8. Plaintiff does not have funds available 10 pay Ihc costs of filing and service.
