COMPLAINT
I. The Plaintiff, PNC Bank, Kentu~ky, In~" is a Kentu~ky ~urpuration authorized to do business in the
Commonwealth of Pennsylvania, trading and doing husiness as PNC Mortgage Company with a principal office at 539
South Fourth Avenue, Louisville, Kentucky.
2. The Defendants, James M. Kost and Teresa L. Kost, his wife, (hereinafter sometimes referred to as
"Mortgagors"), are adult individuals residing at 138 Campground Road, Dillshurg, York County, Pennsylvania,
), At all times material to this ~ause of a~tion, the Mortgagors have been the owners of a tra~t of land
and the building thereon erected (hereinafter referred to as the "land"), lucated at 55 West Louther Street, Carlisle
Borough, Cumberland County, Pennsylvania.
4. The land is described in Exhihit "A" attached hereto and made a part hereof by reference,
5, On November 9, 1989, in ~onsideration of a loan uf Sixty Thousand ($60,000,00) Dullars made by
the First Bank and Trust Company of Mechanksburg, Pennsylvania. (hereinalier sometimes referred to as
"Mortgagee'), to the Mortgagors, James M, Kost and Teresa L. Kost, his wife, said Mortgagors executed and
delivered to the Mortgagee a Note secured by a Mortgage on the land obligating the Mortgagor to pay the Mortgagee
the principal sum together with interest therll(lO at the rate of eleven and une,half (11.5%) percent per annum on the
unpaid balance in equal monthly installments of Seven Hundred Dollars and Ninety One ($700,91) Cents each, together i
with other terms and cunditions set forth in the said Mortgage, The Mortgage is re~orded in the Office uf the Recorder i
of Deeds of Cumberland County in Mortgage Book 958, Page 968. A ~opy of said Mortgage is set forth in Exhibit
II "B' altached hereto and made a part heroof by referen~e.

6, The Mongageo assigned the Mongage to the Plaintiff by an Assignment dated November 9, 1989, and
rlleordo:d in Cumberland County Miscellaneous Book , Pase _' A true and corrllet copy of the Mongage
Assignment Is attached hereto as Exhibit 'C' and Is made a pan hereof by reference.
7. The Defendant Mongagors are In default on the Mungage In that they have failed to make the monthly
payments as required from and after July 9, 1993.
8, The Defendants, James M. Kost and Teresa L. Kust, are the present real owners of the land.
9. Under the terms of the Mongage, the Defendants are alsu obligated to pay to Plaintiff the expense of
the collection, Including reasonable atturneys fees.
10. The usual customary charge by attorneys fur the cullectiun of a delinquent mongage Is five (5%)
percent uf the unpaid balance of the Mongage.
II. The amount due the Plaintiff under the Mongage is computed as follows:

14. The Defendants are not members of the armed furces of the United States and are not entitled to any

I benefits of the Soldiers and Sailors Relief Act as amended.

WHEREFORE, Plaintiff demands judament aaalnstthe Defendants, James M, Kost and Teresa L. Kost, in
the amount of Fifty Five Thousand Three Hundred Ninety Three Dullars and Seventy ($55,393.70) Cents, with
interest thereon at the rate of eleven and one-half (I 1.5'lL) percent per annum from September 7,1994, and the costs
of suit.

ALL THAT CERTAIN three story brick house and lot or ground situate in the Borough of Carlisle,
Cumberland County, PeMSylvania, bounded on the south by West Louther Street, on the west by lot now or formerly
of R.R. Todd, on the north by West Locust Alley and on the east by property now or formerly of lohn Outrey;
containing (30) feet in frOnl on West Louther Street and extending in depth two hundred forty (240) feet to Locust
Alley.
TOGETHER with a right of way over the adjoining half of lot three (3) feet wide, extending along the w~t
gable wall of the brick house hereby conveyed, from West Louther Street three feet six inches (3'6") beyond the
present brick building, being a distancfl of about forty-three feet six inches (43'6') and being the east half of Lot No,
103 in the plan of the Borough of Carlisle,
