COMPLAINT
COUNT I . REPLEVIN
AND NOW comes Green Tree Consumer Discount Company. by and through its ettorney Erin P. Dyer end
evers the following in support of its Complaint in Replevin:
1. Green Tree Consumer Oiscount Company. hereinafter referred to as "Plaintiff." is a corporation
duly authorized to conduct business in the Commonwealth of Pennsylvania and has its principal place of business
located at 300 Weyman Plaza, Suite 480. Pittsburgh, PA 15236,0306,
2, Dale L. Weigel. hereinafter relerred to as "Defendant." is an individual whose last known
address is at 68 Ragency Woods North, Carlisle. PA 17013,
3. On or about Jun9 7. 1993, Dafendant purchased a 1977 Zimmer Homes Corp" manufactured
home. Serial Number ZZP16918, IIhe "Mobile Home"). from Green Tree Consumer Discount Company. (the
"Seller"). and entered into a written Manufactured Home Retail Installment Contract and Security Agreement,
!the "Security Agreement'" for the payment of a portion of the purchase price thereof. A true and correct copy
01 the Security Agreement is alleched hereto as Exhibit "A,"
4. Seller perfected ils security interest in said Mobile Home by having an encumbrence pieced on
the title thereto. A true end correct copy of the Certilicate of T;lIe is alleched hereto as Exhibit "B."
5. Plaintiff evers that the approximate retail value of said Mobile Home is $8.700,00 and thatlhe
said Mobile Home is in Oelendant's possession but its exact whereabouts ore uncertain.
6. Delendant defaulted under the terms 01 the Security Agreement by failing to meke payments
when due. As of September 13, 1994, the Defendant's payments of interest and principal were in arrears in
the amount of $468.90. Pursuant to the Acceleration Clause in the Security Agreement the amount outstending
as of September 13, 1994, is $9,541.19,
1. Plaintiff provided Defendant with thirty 1301 days notice of intent to repossess the Mobile Home.
A true and correct copy of the notice 01 intent to repossess the Mobile Home is all ached herelo as Exhibit "C."
8. Defendant has failed to cure the default or return the Mobile Home upon Plaintiff's demand.
9, Plaintiff avers that under the terms of the Security Agreement and Pennsylvania law it is now
entitled to immediate possession of said Mobile Home,
10. The Security Agreement provides that in the event of default:
a. Defendant will pay seller's reasonable allorney's fees, provided that prior to
commencement of legal action such fee shall r.ot exceed $50,00;
b. Court costs and disbursements; and
c. Costs incurred by seller to foreclose on the Mobile Home including the costs of storing,
reconditioning and reselling the Mobile Home.

Mary M. Rytal, Collaction Manager and duly authorizad rapresentative of Grean Traa Consumar Discount
Company, deposes and says subject to tha penalties of 18 Pa. C.S. ~ 4904 ralating to unsworn falsification to
authorities that tha facts set forth in tha foregoing Complaint are trua and correct to the best of her knowledge,
informetion end belief.

you, fail to cure your default by taking the sleps listed above wilhin the cure period described above, then as of

shall also be due and payable. II this default is not cured, Green Tree will report the dllfaulted loan to the appropriate credit
reporting agency,
If Ihis loan is FHA insured, It is Insured against nonpayment by the federal government. II you do not repay the loan as agreed,
we may assign the debt to the U,S, Department of Housing and Urban Development (HUD) for collection, Failure to pay the debt
in accordance with the terms set by HUD may result in any or all of the following aclions:
- Seizing your federal Income tax refunds,
- Gamishment of your wages if you are a federal employee,
- Referring the debt 10 the U,S, Department of Justice for collection,
If your loan is FHA insured and you are unable to cure the default due to an involunlary loss of employment or other reason,
counseling assistance may be available to your from certain agencies that are HUD-approved mortgage counseling agencies,
