CIVIL ACTION P. MARX SHAFER and ROBERT E. GREENE, NO. 1994 Defendants COMPLAINT ACTION TO OUIET TITLE AND NOW comes plaintiff, Suzanne M. Keener, through her attorneys, Keefer, Wood, Allen & Rahal, and states as follows: 1. plaintiff Suzanne M. Keener is and was at all times relevant hereto an adult individual residing in Upper Allen Township, Cumberland County, Pennsylvania. 2. Defendant P. Mark Shafer is and was at all times relevant hereto an adult individual doing business in Cumberland' County, Pennsylvania. 3. Defendant Robert E. Greene is and was at all times relevant hereto an adult individual residing in Cumberland County, Pennsylvania, with a mailing address of P.O. Box 90, Mechanicsburg, PA 17055. 4. Plaintiff is the last deeded owner of that certain piece of real property described in Deed of April 18, 1988, by and between Miller OrChard's, Inc. and Suzanne M. Keener, a copy of which is attached hereto as Exhibit A and incorporated herein by reference, which real property shall hereinafter be referred to as the "Premises." 5. By reason of a document dated July 17, 1992, between Plaintiff and Defendant Shafer, Defendant Shaffer did purport to purchase the Premises from Plaintiff on an installment sale basis, a true and correct of which document is attached hereto as Exhibit B, incorporated herein by reference and hereinafter referred to as the "Installment Sales Document." 6. Said Installment Sales Document was recorded in the Office of the Recorder of Deeds of Cumberland county on or about July 17, 1992, in Book 42J, Page 205. 7. Defendant Shafer has failed to make the monthly in- stallment payments called for by the Installment Sales Document since October 1993 despite demand therefor, is in default of same, has abandoned the Premises, and has removed himself from the vicinity leaving Plaintiff without forwarding address or means of contacting Defendant Shafer. 8. Defendant Greene did, on or about AprilS, 1994, file with the Cumberland County Prothonotary's Office a confession of judgment note dated 9/1/92, a copy of which is attached hereto as Exhibit C and incorporated herein by reference (hereinafter the "Judgment Note"), which note purports to provide Defendant Greene with a judgment against Defendant Shafer's interest in the amount of $5,000 plus interest. 9. The JUdgment Note was given by Defendant Shafer as payment to Defendant Greene for arranging and assisting in -2- Defendant Shafer's purported installment purchase of the Premises and constitutes payment of real estate brokerage commission and/or payment for legal services to Defendant Greene. 10. Defendant Green is not licensed to collect real estate commissions in Pennsylvania nor is he licensed as an attorney in Pennsylvania, making collection of the Judgment Note violative of applicable Pennsylvania law. WHEREFORE, plaintiff requests the Court enter judgment in her favor and against Defendants declaring any and all rights respecting the Premises accruing under the aforementioned In- stallment Sales Document or Judgment Note to Defendants Shafer and Greene (or their successors and assigns), to be void A2 initio as to the Premises and discharging Plaintiff and the Premises from any and all obligations arising from either the Installment Sales Document or the Judgment Note with respect to the Premises.
